C,ciQ,C, D U r 3-36 1306 ORDINANCE NO. 1306 AN ORDINANCE AMENDING ORDINANCE NO. 962, ZONING ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA, TO ESTABLISH RESIDENTIAL DEVELOPMENT STANDARDS FOR ALL ZONES WHEREIN MULTIPLE RESIDENTIAL USES ARE PERMITTED, AND TO ESTABLISH SITE PLAN REVIEW PROCEDURES THEREFOR. WHEREAS, pursuant to the terms and provisions of the Government Code of California, proceedings were duly initiated for the amendment of Ordinance No. 962, Zoning Ordinance of the City of National City, and WHEREAS, pursuant to due and legal notice, hearings were held by the City Planning Commission of said city and also by the City Council of said city and all persons interested were given opportunity to appear and be heard before said Planning Commission and said City Council, and WHEREAS, the City Planning Commission of the City of National City has legally and duly certified to the City Council its report and has recommended such amendments, and WHEREAS, the City Council has approved the recommendation of the City Planning Commission; NOW THEREFORE THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Ail protests, if any, against said amendments to Ordinance No. 962 and each of them be and hereby are' denied and overruled. SECTION 2. In all zones within the City of National City wherein multiple residential development is permitted, the following regulations shall apply. When conflicting regulations exist in the Zoning Ordinance or any amendment to said Zoning Ordinance, the regulations established by this ordinance shall apply. Section 3. There is hereby added to Section 10 of Ordinance No. 962 an additional sub -paragraph S: S. Apartment House Design Standards. 1. Apartment projects of 9 units or more shall be designed to meet the following standards: a. Parking 1) Quantity of off-street parking: 1.3 parking spaces for 'one -bedroom units and studios. 1.5 parking spaces for two -bedroom or more units. 2) Parking may not be located in required front yards. Driveways shall have a minimum 10' width (one-way) and parking stalls shall be a minimum of 9' wide. 3) Parking facilities shall conform to the attached design standards. b. Front yards shall be a minimum of 15' when units face a street; side yards shall be a minimum of 15° when units face such yards; rear yards shall be a minimum of 15' when units face such yards. c. Courts shall be a minimum of 20' when units face courts. A court shall mean an area on the same lot with a building which is bounded on two (2) or more sides by the exterior walls of a building or buildings on the same lot. d. An additional 5' shall be added to all yards and courts for each story above the third floor. Zero side yards may be allowed when two lots are developed as one with a common wall separating units. e. A minimum of 100 square feet of useable open space, exclusive of required yards and courts shall be provided for each dwelling unit. Such space shall be improved for recreational uses with feasible and logical design. Covered recreation areas may be substituted for up to 25% of the required area. Pool areas may be included in required area. f. Landscaping. All yards, courts, and open space that is not otherwise used for walkways, driveways or improved useable open space shall be landscaped. Fencing and screening shall be placed around all useable open areas for privacy, safety, and visual control. Clothes drying yards, trash areas, utility areas, carports, and parking lots shall be screened. Mechanical irrigation systems shall be installed for all landscaping. Landscaping is the planting and maintenance of some combination of trees, ground cover, shrubs, vines, flowers; or lawns. In addition, the combination or design may include natural features such as rock and stone and structural features including but not limited to fountains, reflecting pools, art work, screens, walls, fences, and benches. Screening can be solid walls, solid fences, or dense living hedges for the purpose of concealing from view the area behind such structures or hedges. Fencing is a free standing of metal, masonry, composite or wood, or any combination thereof, resting on or partially buried in the ground and rising above ground level, and used for confinement, privacy, protection screening or partition purposes. Landscaping shall be in accordance with development standards to be prepared by the Planning Department. g. Landscaping and all non-structural site improvements shall have proper maintenance. h. On -site signs. The following signs are to be permitted in residential zones: 1) Residential identification signs, providing that they do not exceed twenty (20) sq. ft. in area, are stationary, non - flashing, and contain no advertising matter other than the name and address of the building upon which it is displayed. 2) One (1) non -flashing sign not exceeding twelve (12) sq. ft. in area pertaining only to the sale, lease or hire of only the particular building, property, or premises upon which displayed. Signs described in paragraphs 1) and 2) may be combined into one (1) dual purpose sign which will not exceed 32 sq. ft. in area. 3) Location: Wall, flat except that a free standing sign may occupy the front yard, but not closer than ten (10) feet to the front lot line, and be not more than eight (81 feet in height. 4) Maintenance. All signs will be maintained in a safe structural condition and shall be painted on all exterior parts unless previously coated or made of a rust -inhibitive material. Further, they will be kept up in appearance and condition and shall be compatible with the architectural character of the building. i. Accessory uses. Parking areas shall be used only for parking of vehicles used by tenants and their guests. No auto repair allowed. No commercial uses allowed in dwelling areas. No storage of boats, campers, or other equipment in required yard areas. j. Accessory storage space of not less than 64 cu. ft. shall be provided. Utility storage area of not less than 5 sq. ft. per dwelling unit is required. Screened or enclosed trash areas with not less than 30- gallon trash receptacles shall be provided not more than 250 ft. from the farthest unit. Laundry and dryer facilities will be provided according to the following formula: 1) One washer to 12-15 living units or one washer to 18-25 bedrooms, with the exception of units for singles which shall be at a ratio of one washer for every 20 units and units for senior citizens which shall be at a ratio of one washer for every 40 units. 2) One small dryer to each washer or one large dryer to each two washers. 3) Adequate deep sink and folding table facilities shall be provided. k. All types of open ouraoor storage are prohibited. 1. The following minimum floor area per dwelling unit are required. 1) Bachelor (snit, 360 sq. tt. 2) One -bedroom Unit, 500 sq. ft. 3) Two -bedroom Unit, 650 sq. ft. 4) Three -bedroom Unit, 800 sq. ft. 5) Additional Room, 150 sq. ft. 6) Guest Unit, 250 sq. ft. m. Elevators shall be provided for all buildings more than three stories in height. n. Outdoor lighting for security. Light fixtures for walks, steps, parking areas, driveways, on -site streets and other facilities shall be provided in keeping with the type of development and at locations to assure sate and convenient nighttime use. Fixtures shall be designed in keeping with the project and properly shaded to screen the windows of habitable rooms from the direct rays of light. o. Site Drainage. Adequate site drainage shall be provided to protect property from storm water runoff or ground water, and to provide for the safety and convenience of occupants by installation of adequate facilities for the collection and disposal of surplus runoff and subsurface waters. A minimum slope of 1.0 percent (I ft. in 100 ft.) is required. Steeper slopes are recommended. Resolution of more specific problem areas in this regard shall be in accordance with attached guidelines. 1) Protective slopesadjacent to buildings. a) Minimum Gradient: (1) impervious surfaces, 1/8 inch per foot (1 per —tent) (2) Pervious surfaces, 1/4 inch per foot, (2 percent). b) Maximum Gradient: (1) One inch per foot (8 percent) for a minimum of 4 feet away from all building walls. (2) Balance of protective slope, maximum3to I ratio. 2) Useable Lawn Area and Other Slopes. ) Minimum Gradient: (1) Pervious surfaces 1/8 inch per foot (I percent). b) Maximum Gradient: (I) Two (2) horizontal to one (1) vertical, however, (2) Planning Department may, after analysis, accept steeper slopes or require flatter slopes. 3) Parking Sites. a) All parking stalls shall be sloped to drain with a maximum 3% gradient and a 5% maximum in extreme hardship cases. p. Pedestrian walkways. Safe, convenient, well -drained pedestrian access to dwelling units, parking lots, and service areas by provision of walks, steps and stepped ramps, so constructed as to assure reasonable durability and economy of maintenance shall be required. 1) Pedestrian walkways shalt be a minimum width of 36". 2) Pedestrian walkways shall be graded or ramped not more than 12'Z, as necessary. 2. Apartment projects of 8 units or less shall be designed to meet the following standards: a. Parking. 1) Quantity of off-street parking: 1.3 parking spaces for one -bedroom units and studios. 1.5 parking spaces for two -bedroom or more units. 2) Parking in required front yards to within four feet of the front property line may be allowed provided the front yard setback is properly landscaped. Driveways shall have a minimum 10' width and parking stalls shall be a minimum of 9' wide. 3) Parking facilities shall conform to the attached design standards. b. Front yards shall be a minimum of 15' when units face a street; side yards shall be a minimum of 15' when units face such yards; rear yards shall be a minimum of 15' when units face such yards. c. Courts shall be a minimum of 15' wide when units face courts. Height limit. 1) Buildings shall not exceed a height of thirty-five feet (35'). 3. Any apartment project of eight (8) units or less, on any building site, for which a building permit is issued subsequent to the adoption of this ordinance, may be enlarged to exceed eight (8) units only if the enlarged project provides the number of off-street parking spaces, the useable open space, and laundry and dryer facilities required for apartment projects of nine (9) units or more, and calculated on the total site development, including the existing apartment units. 4. Any apartment project for which a building permit is issued prior to the adoption of this ordinance may be enlarged, provided that the enlarged portion conforms to the above listed standards. Applicable standards will be chosen based on the total number of units on the site. 5. Appendix A. Attached hereto and incorporated herein by this reference is that certain document entitled, "Appendix A — National City Apartment House Parking Design Standards" dated January 18, 1972, which contains certain charts, diagrams and standards relating,. to off-street parking facilities. All off- street parking facilities shall be constructed and maintained in accordance with the charts, diagrams and standards as set forth in said "Appendix A." SECTION 4. There is hereby added to Section 10 of Ordinance No. 962 an additional sub -paragraph T: T. Site Development Plan Approval for Multiple Dwelling Projects. 1. Submission of Site Development Plan. a. Prior to, or concurrently with the submission of building plans for plan check or application for issuance of a building permit for any multiple dwelling to be erected in any zone, accurately dimensioned architectural drawings and plot plans for all proposed construction shall be submitted to the Planning Department for approval. Such plans shall show all the items listed in the "Site Development Plan Check List" (Appendix B) attached hereto. 2. Plan Review. a. The Planning Department shall review all plans submitted, pursuant to the preceding paragraph, and shall endorse its approval on a copy thereof, if it determines that the same shows: (Continued) IT 1.) Compliance with all applicable city ordinances; 2) Desirable site layout and design; 3) Utility of open recreation areas; 4) Adequacy of landscaping; 5) Compatibility with neighboring property; and 6) Compliance with the General Plan. If it determines that the plans thus submitted do not conform or adequately provide for one or more of such provisions, it shall endorse its disapproval thereof, together with a statement of the provisions of this ordinance with which such plans do not conform. b. When referred to the Engineering Department, Fire Department, Building Department, or other city agency as appropriate by the Planning Department, said Department shall evaluate such plans as to compliance with all applicable city ordinances and standards and may require additional plans to be submitted and approved prior to final approval of such plans. The conditions of approval of development plans by the Planning Department may include the recommendations of other city department heads required to be made by him by the terms of this Section. 3. Building or Occupancy Permits. No building permit or certificate of occupancy shall be issued until the approvals required by this Section have been obtained. 4. Disapproval and Appeals. Whenever a Site Development Plan has been disapproved, as provided for herein, the Planning Department shall notify the applicant thereof, in writing, by United, States Mail, addressed to the applican at his last known address. Such notice shall 'contain a brief statement advising the applicant of the reason or reasons for the disapproval. The decision shall be final and conclusive, unless within 90 days after the mailing of the notice to the applicant, the applicant may appeal the decision of the Planning Department to the Planning Commission, by filing a written letter of appeal with the Planning Department. The Planning Department, upon receipt of such an appeal, shall forward its files in the case being appealed to the Secretary of the Planning Commission, who shall thereafter set the matter for a hearing before the Planning Commission, as soon as is practicable. The Secretary of the Planning Commission shall give the appealing party at least five days notice in the same manner as the Planning Department's notice, of the time and place of such hearing. At the time set for such hearing, the Chairman shall give the appealing party a reasonable opportunity to be heard on the matter, and may require reports from any city department. After said hearing, the Planning Commission shall affirm, disaffirm, or modify the decision appealed from. 5. Effective Date of Planning Commission Action. Time for Appeal. The action of the Planning Commission in granting or denying the appeal shall become effective and final, twenty (20) days following such action, unless within such period of time an appeal in writing is filed by the applicant or an opponent with the City Clerk. Within this period of time, the City Council, on its own motion, may appeal the decision of the Planning Commission in the same manner as an applicant. The timely filing of an appeal shall stay the effective date of the Commission's action, pending action by the City Council. The City Clerk shall notify the Secretary of the Planning Commission of the filing of such an appeal. 6. Transmission of Planning Commission's Record to the City Council. The Secretary of the Planning Commission, upon notice from the City Clerk that an appeal has been timely filed, shall transmit to the City Clerk the Planning Commission's complete record of the case. 7. City Council Action on Appeals. The City Council shall hold a hearing on the matter so appealed, in the same manner as the Planning Commission. The decision of the Council affirming, modifying, or disaffirming the Planning Commission determination shall be final and conclusive. 8. Appendix B. Attaceed heret' and incorporated herein by reference is that certain document entitled, "Appendix B - National City Site Development Plan Check List" dated January 18, 1972, which contains a list of all information items and .requirements for preparation of multiple dwelling project development site plans. All site development plans submitted pursuant to this ordinance shall conform to the provisions as set forth in said "Appendix B." "APPENDIX A" NATIONAL CITY APARTMENT HOUSE PARKING DESIGN STANDARDS January 18, 1972 Parking Facility Access Driveways Access driveway, shall be provided between each parking facility and a street or alley. Residential driveways shall only be permitted to open upon an arterial street where no other access to the property exists. Aeaure a sloping ramp is considered necessary, the maximum slope should not be more than 15`>.. For slopes over 10%, a transition at least 8 feet long should be provided at each end of the ramp itself. Conversely, a ramped driveway ex11 rising up to a public sidewalk must have a transition section that is almost level (maximum slope of 5%) before intersecting the sidewalk so as to prevent the hood from obscuring pedestrians on the walk. Driveway and lane gradients shall be suitable to provide adequate and sate access. Gradients of less than 7 per cent are desirable; however, steeper gradients are preferable under some circumstances. Drive and lane gradients are acceptable as determined by individual analysis considering topography, the desirability of preserving existing site features, and the character of the facilities being served. It should be recognized that minor inconvenience is less significant on a drive or lane than on a street. Parking Facility Circulation and Arrangement Turn Around Areas. All parking facilities, except those serving not more than two dwelling units, shall be arranged so that: Any vehicle entering a public street can do so traveling in forward motion; A vehicle entering the parking facility shall not be required to enter a street to move from one location to any other location within the parking facility or premises. Turn Around Areas - Single and Two - Family Dwellings. Parking facilities serving not more than two dwelling units shall be arranged so that any vehicle entering a street can do so traveling in forward motion where: The parking facility is served by a single access driveway that .is less than 20 feet in width and more than 100 feet in length, or The access driveway opens upon an arterial street. Maneuvering and Parking Stall Accessibility. All parking facilities, except those serving not more than two dwelling units, shall be arranged so that parking maneuvers can be accomplished without driving, maneuvering, or encroaching into or upon any public right-of-way, walkway, or unpaved landscaped area within or adjoining the parking facility. All parking stalls shall open directly upon a maneuvering or turn around area, an access driveway, or an aisle leading to an access driveway and shall be individually and continuously accessible. All parking stalls shall be so located and free of obstructions that parking can be accomplished in a continuous forward movement and unpacking can be accomplished with not more than one backing movement and one forward movement. Separation between Parking Stalls and Dwellings Served. All parking stalls in an open parking facility shall be separated from any dwelling unit wall on the same lot if said wall contains doors or windows which are on the same or approximately the same level as the parking facility. The separation shall he at least 10 feet in width, at least one-half the width of which shall be unpaved. Parking Stall and Aisle Dimensions Parking table and diagram. The following table provides the required minimum dimensions of parking facilities based on the explanatory diagram where: • "A" equals the parking angle, • "B" equals the stall width, • "C" equals the minimum stall width, • "D" equals the minimum clear aisle width, • "E" equals the stall distance at bay side, • "F" equals the minimum clear bay width, and • "G" is the maximum permitted decrease in clear aisle width for accessory parking facilities used exclusively by tenants, employees, or owners of the structures or uses served. Increases in Stall Width. For perpendicular parking, 3 feet shall be added to the width specified in column "B" of the Parking Table for end stalls abutting a building, fence, or other obstruction. Any stall which is adjoined on either side of its longer dimension by a fence, wall, column, post, or similar obstruction located within 31 2 feet of the opening to the stall, shall be increased in .width at least one foot if so obstructed on one side and at least 112 feet if so obstructed on both sides over the width specified in Column "B" of the Parking Table. 1. Name and address of the owner of the property. 2. Name and address of the person who prepared the plan. 3. North point. 4. Scale - preferably no Tess than 1" equals 30'. 5. Date of preparation. 6. Proposed use classification for each building or activity area. 7. All required street widening, street width and parkway widths, and alleys. 8. For two-way traffic, aisles, approach lanes, and maneuvering areas shall have a minimum width of 18 feet or as specified in Column "D" of the Parking Table, whichever is greater. Vertical Clearance. Each parking stall shall have a vertical clearance of at least 7 feet. "APPENDIX B" NATIONAL CITY SITE DEVELOPMENT PLAN CHECK LIST January8, 1972 SITE DEVELOPMENT PLAN CHECK LIST Planning Department, City of National City, California public or private easements. 9. Overall dimensions of entire property. Identify all property lines. 1b. Net area of site. 11. A complete legal description and site address. 12. Indicate the square footage of each building or activity area and total number of parking spaces provided. 13.
