ORDINANCE NO.1309
AN ORDINANCE OF THE CITY OF
NATIONAL CITY, CALIFORNIA
PROHIBITING ANY USES OF CERTAIN
PROPERTY WHICH MAY BE IN
CONFLICT WITH CERTAIN
CONTEMPLATED ZONING
REGULATIONS AND ADOPTING SAID
ORDINANCE AS AN "INTERIM
ZONING ORDINANCE" PURSUANT TO
SECTION 65858 OF THE CALIFORNIA
GOVERNMENT CODE; AND
ADOPTING SAID ORDINANCE AS AN
URGENCY ORDINANCE and applying
said zoning regulations to certain
property within said city
WHEREAS, a multiple family dwelling
development project is pending on the
herein described real property, and
WHEREAS, the National City Planning
Commission has presented to this Council
recommendations for substantial changes
in the zoning regulations, some of which
would effect the design of said project;
and the City Council has scheduled public
hearings to consider said
recommendations in the near future, and
WHEREAS, it is found that to protect
the public health, safety, and general
welfare it is necessary to prohibit any uses
which may be in conflict with said
contemplated zoning regulations, and
WHEREAS, the City Council intends to
complete their study on said proposed
zoning regulations and render a decision
thereon within a reasonable time,
NOW, THEREFORE, BE IT
ORDAINED that all development of that
property in the City of National City,
California, described in exhibit "A"
attached hereto and made a part hereof as
though set forth in full shall be designed
and constructed in compliance with the
recommendations of the Planning
Commission in case A-3-72 (Amendment
to Ordinance 962 to Establish
Residential Development Standards for
all Zones wherein Multiple Residential
Uses are permitted, and to establish Site
Plan Review Procedures therefor) as
described in the minutes of their meeting
of March 27, 1972.
BE IT ORDAINED that this ordinance
is adopted as an interim zoning ordinance
pursuant to Section 65858 of the California
Government Code and shall expire 90 days
from the date of adoption unless extended
in the manner provided in said Section.
BE IT ORDAINED that the City Council
finds that a multiple family residential
development project is now pending on
said property and that the proposed
design thereof represents a threat to the
public health, safety and welfare in that
said proposed design does not contain
adequate provisions for open space and
off-street parking and the improvement of
said property pursuant. to said pending
design will create conditions inimical to
the health, safety and welfare of the
citizens of National City by virtue of
increased traffic congestion,
overcrowding and density of occupancy
higher than is necessary to preserve the
health, safety and welfare of the
community. Furthermore the City Council
finds that the proposed; pending projects
present special hazards and threats to the
health, safety and welfare by virtue of
geographical, geological, and
topographical problems due to soil and
terrain features.
BE IT FURTHER ORDAINED that this
ordinance is adopted as an urgency
ordinance to be effective immediately
upon its adoption.

Council of the City of National City,
California, this 2nd day of May, 1972, by
the following vote, to -wit:
AYES: Councilmen Camacho, Pinson,
Reid. Waters; Morgan
NAYS: COUNCILMEN NONE
ABSENT; NONE.
