HomeMy WebLinkAboutCC ORD 1972-1326 Adopts 1970 mechanical code (Repealed by 1422), _47 , 1326 ORDINANCE NO. 1326 AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA ADOPTING THE UNIFORM BUILDING CODE, VOLUME II, MECHANICAL, 1970 EDITION, AND APPENDIX A, CHAPTER 22 OF APPENDIX B, AND APPENDIX C THEREOF PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ALL OTHER ORDINANCES AND PARTS OF ORDINANCES OF .SAID CITY IN CONFLICT THEREWITH THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA DOES ORDAIN AS FOLLOWS: SECTION 1. That all other ordinances and parts of ordinances in conflict with this ordinance are hereby repealed. SECTION 2. There is hereby adopted by the City Council of National City for the purpose of prescribing regulations governing the installation and maintenance of heating, ventilating, comfort cooling, and refrigeration systems within the limits of National City, and providing for the issuance of permits therefor, that certain document known as the Uniform Building Code, Volume 11, Mechanical and Appendix A, Chapter 22of Appendix B, and Appendix C thereof, published by the International Conference of Building Officials and the International Association of Plumbing and Mechanical Officials, Being particularly the 11)Ib Edition thereof and the whole thereof. save and except such portions as are hereinafter deleted, modified, or amended, of which code not less than three (3) copies have been and are now filed in the office of the Clerk of the City of National City and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the City of National City. SECTION 3. Section 202 of the code adopted by this ordinance is hereby deleted. SECTION 4. Section 303 (e) is hereby added to the code adopted by this ordinance to read as follows: Section 303 (e) RE INSPECTION FEES: Whenever it shall be necessary to make an extra inspection field trip due to the applicant for a permit giving an incorrect address or location, or due to faulty, incomplete, or defective installation, an additional fee in the amount of TEN DOLLARS (S10.00) as a reinspection fee may be charged by the Director of Building and Housing. This subsection is not to be construed to mean that reinspection fees shall be required the first time work is rejected for failure to comply with the requirements of this code, but shall be used as a control over the practice of calling for inspections before work is ready for such inspections or reinspections. Reinspection fees may be assessed by the Director of Building and Housing whenever it is apparent that the City inspection staff is being used to provid on-the-job supervision of work rather for the performance of inspection as specified to this code. • TO obtain a reinspection, the permittee shall file an application therefore in writing upon a form. provided for that purpose ans shall pay the reinspection fee specified herein. Where reinspection fees have been assessed by the Director of Building and Housing no additional inspection work shall be performed until the required fees have been paid. SECTION 5. Severability: If any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent Jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have adopted this code, and each section, subsection, sentence, clause, phrase, or portion thereof irrespective of the fact that any one or more sections, subsections, clauses, phrases, or portions be declared invalid or unconstitutional. SECT ION 6. Penalty: 1t shall be unlawful for any person, firm, or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use. occupy, or maintain any building or structure in the city, or cause the same to be done, contrary to or in violation of any of the provisions of this code as amended. Any person, firm, or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than S500.00 or by imprisonment for not more than 100 days, or by both such line and imprisonment.
