HomeMy WebLinkAboutCC ORD 1971-1262 Interim zoning (Not codified)1262 262 AN ORDINANCE ORDINANCE NOOF THE CITY OF NATIONAL CITY PRO VIDING FOR TEM- PORARY INTERIM ZONING ESTABLISHING ALL COM- MERCIAL AND MULTIPLE RESIDENTIAL ZONES AS PLANNED DEVELOPMENT ZONES ON ALL THAT PROP- ERTY LOCATED EAST OF HA R B IS ON AVENUE BE- TWEEN DIVISION STREET AND SIXTEENTH STREET. WHEREAS, the Department of Planning of the City of Na- tional City in good faith is con- ducting studies for the purpose of holding public hearings by the Planning Commission of the City of National City re- garding proposed amendments to the Zoning Ordinance of the City of National City wherein and whereby all Commercial and Multiple Family Residential Zones lying East of Harbison Avenue between Division Street and Sixteenth Street shall be established as R-4-PD, Multiple Family Residential Planned Development Zones and C-2-PD, Limited Commercial Planned Development Zones; and WHEREAS, Section 65858 of the Government Code of Cali- fornia authorizes this City Coun- cil to protect the public safety, health and welfare, to adopt a temporary interim ordinance as urgency measure prohibiting any use of said territory which lnay be in conflict with such proposed zoning ordinance. NCITY COUNCIL OFORETHE CITY OF NAI ONAL DOES ORDAIN CITY, CALI- FORNIA, AS FOLLOWS: SECTION I. The City Council of the City of National City does hereby adopt this temporary in- terim zoning ordinance pursuant to the provisions of Section 65858 of the Government Code of the State of California. SECTION II. That all Com- mercial and Multiple Family Residential Zones lying within the City Limits of the City of National City east of Harbison Avenue between Division Street and Sixteenth Street as shown on map on file in the Office of the City Clerk of the City of National City, Document No. 45753 shall be established as R- 4-PD, Multiple Family Residen- tial Zones and C-2-PD, Limited Commercial Planned Develop- ment Zones with a height limit restriction in said zones to two stories or thity-five feet (35') whichever is the lesser. SECTION III. This Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety and shall take effect upon its adoption by the City Council. The emergency exists by virtue of there being pending developments inconsistent with the proposed zoning. If said developments occur irreversible damage by virtue of said development projects occurring prior to adoption of permanent zoning controls will occur.
