CALIFORNIA, REPEALING
ORDINANCE NO. 1230 ESTAB-
LISHING PROCEDURES F. 0 R
THE INSPECTION, ANALYSIS,
A.ND DISPOSAL OF INDUS-
TRIAL WASTES

does ordain as follows:
SECTION 1. That City Ordi-
nance No. 1230 of the City of
National City, and all other
ordinances and parts of ordi-
nances in conflict with this ordi-
nance are hereby repealed.
SECTION 2. OBJECTION-
ABLE SEWAGE PROHIBITED.
It shall be unlawful for any per-
son, firm, or corporation, to
cause to enter or permit to
enter the public sewerage sys-
tem any substance, liquid, gas,
or solid, which would cause a
public nuisance or hazard to
life, or would be deleterious to
the plumbing system, public
sewerage system, or to the
waters receiving the discharge
of the public sewerage system.
SECTION 3. DISPOSAL PER-
14IIT REQUIRED. Any person,
firm, corporation, or govern-
mental agency desiring to dis-
charge industrial wastes into
the sewerage system shall ob-
tain a permit to discharge said
wastes into said system from
the Director of Building and
Housing.
SECTION 4. REGULATIONS.
The Director of Building and
Housing shall promulgate and
enforce regulations necessary to
the administration of this ordi-
nance. He may amend such
regulations from time to time
as conditions require. These
regulations shall be consistent
w it h the general policy
established by the City Council
and shall be approved by reso-
lution of the City Council.
SECTION 5. APPEAL. In the
event that any interested or
affected person shall be dis-
satisfied with any action or
determination of the Director of
Building and Housing, such
person shall be entitled to make
an appeal in writing to the City
Manager. If dissatisfied with
the determination of the City
Manager, said person shall be
entitled to make an appeal in
writing to the City Council. If
thirty (30) days or more shall
elapse following the action or
determination of any one of the
officials in the above designated
chain of appeal without an
appeal being taken therefrom,
then the action or determination
of such official or officials shall
be final.
SECTION E. NOTICE OF
VIOLATION. Any person, firm,
or corporation found to be
violating any provision of this
ordinance or a n y regnln.tion
promulgated relative thereto
shall be served by the Director
of Building and Housing with
a written notice which shall
state the nature of the violation
and shall provide a reasonable
time limit for the satisfactory
correction thereof. The offender
shall, within the period of time
stated in such notice, per-
manently cease all violation.
SECTION 7. SUSPENSION
OF SEWER SERVICE. When
deemed necessary by the Direc-
tor of Building and Housing for
the preservation of the public
health or safety or for the
protection of public or private
property, he may suspend sewer
service to any person, firm, or
corporation using', the sewer sys-
tem in any manner or way to
endanger the public health or
safety, or public or private
property. In suspending service
he may sever all pertinent
connections to the public
sewerage system. If such en-
dangerment shall be imminent,
then the Director may act
immediately to suspend sewer
service coincident with notice or
warning to said person, firm,
or corporation.
Section 8. TESTS AND IN-
SPECTION.
(A) The Director of Building
and Housing or other duly
a u t h or i z e d employees and
agents of the City shall be per-
mitted to enter onto all prop-
erties at any reasonable hour
for the purpose of (1) deter-
mination of the size, depth,
location, and condition of any
sewer or drain connection; (2)
determination of the location,
use, and discharge connections
of interceptors, and plumbing
fixtures; and (3) inspection,
observation , measurement,
sampling, and testing of the
quality and characteristics of
sewage or other liquids or
wastes being discharged into
the public sewerage system.
(B) Where warranted, in-
stallation of an appropriate
manhole or manholes for
purposes of sampling the final
industrial waste discharge may
be required by the Director of
Building and Housing.
(C) Whenever an analysis of
the sewage and wastes from
any plant, building, or premises
of an industrial or commercial
character confirms the presence
of any substance, liquid, gas,
or solids in sufficient quantity
or condition which would cause
a public nuisance or hazard to
life or would be deleterious to
the plumbing system, public
sewerage system, or to the
waters receiving the discharge
of the public sewerage system,
the owner of said plant,
building, or premises shall pay
to the City Treasurer of the City
of National City the cost of each
such sewage and wastes
analysis.
SECTION 9. DEFINITIONS.
The following words and
phrases whenever used in this
ordinance or in the regulations
promulgated in relation thereto
shall be construed as defined
herein.
(A) INDUSTRIAL WASTES.
All wastes other than domestic
wastes.
(B) SEWAGE. Any liquid
waste containing animal or
vegetable matter in suspension
or solution, including I i q u ids
containing chemicals in solu-
tion.
(C) PLUMBING SYSTEM. The
plumbing system means and in-
cludes all potable water supply
and distribution pipes, all plumb-
ing fixtures and traps, all drain-
age and vent pipe, and all drains,
including their respective joints
and connections, devices, recep-
tacles, and appurtenances within
property lines of private prop-
erty.
(D) SEWERAGE. Sewerage is
a comprehensive term including
all construction and appurtenant
equipment utilized in the collec-
tion, trasportation, pump in g,
treatment and final disposal of
sewage.

14th day of December, 1971, by
the following vote, to -wit:
