ORDINANCE NO. 1290
ORDINANCE NO. 902. ZONING
ORDINANCE OF THE CITY OF
NATIONAL CITY. CALI-
FORNIA. TO CREATE AN MH.
HEAVY INDUSTRIAL ZONE.
WHEREAS. pursuant to the
terms and provisions of the
Government Code of California,
proceedings were duly initiated
for the amendment of Ordi-
nance No. 962. Zoning Ordi-
nance of the City of National
City and
WHEREAS, pursuant to due
and legal notice, hearings were
held by the City Planning
Commission of said city and
glso by the City Council of said
>ity and all persons interested
were given opportunity to ap-
pear and be heard before said
Planning Commission and said
City Council, and
WHEREAS. the City Planning
Commission of the City of Na-
tional City has legally and duly
"',certified to the City Council its
report and has recommended
t h e amendments described
herein, and
WHEREAS, the City Council
has approved the recommenda-
tion of the City Planning
Commission;
NOW, THEREFORE, THE
CITY COUNCIL OF THE CITY
OF NATIONAL CITY, CALI-
FORNIA, DOES ORDAIN AS
FOLLOWS:
SECTION 1. Section 8 of Ordi-
nance No. 962 (Zoning Ordi-
nance) is herewith amended to
add thereto the following
specific provisions:
J. In the MH, HEAVY IN-
DUSTRIAL 'ZONE, the following
uses are permitted:
1. All uses permitted in the
M-4 Zone, subject to the condi-
tions a n d limitations thereof:
and
2. Me t a l salvage and
processing, except auto
wrecking yards, subject to the
following conditions:
a. STORAGE OF SALVAGE
OR JUNK
b. OTHER SALVAGE
e. FENCES AND WALLS
d. PAVING OF YARDS
e. REQUIRED PARKING
f. LANDSCAPING
g. PAINTING AND MAIN-
TENANCE
h. RUBBISH CONTAINERS
1. LITTER
j. COMPLIANCE
k. PLOT AND PRELIMIN-

n. ENFORCEMENT
a. STORAGE OF SALVAGE
OR JFNK: Shall not be placed
or allowed to remain outside of
the enclosed yard area. It may
be stored above the height of
the fence or wall provided such
storage is not within ten feet
(10') of an exterior lot line.
b. OTHER SALVAGE: No
non-metallic salvage or proces-
sing not clearly incidental to the
principal use shall be allowed.
e. FENCES AND WALLS:
The entire premises shall be
enclosed by fences and wallet
1) All fences and walls shall
be of uniform height in relation
to the ground upon which they
stand. and shall be a minimum
of eight feet (8') high and shall
not exceed fifteen (15') in
height.
2) All fences and walls open
to view from any street shall
be constructed of the following
materials:
a) Metallic panels, at least
.024 inches thick, painted with
a "baked on" enamel or similar
permanent finish. A 11 fences
constructed with metallic panels
exposed to view from the ex-
terior side shall have an interior
face of solid wood not less than
two inches (2") thick from the
ground to the top of such fence.
b) Masonry
c) Other materials com-
parable to the foregoing if
approved by the Director of
Planning.
3) All fences and walls shall
�, be constructed in workmanlike
'manner and shall consist solely
of new materials unless the
Director of Planning approves
the substitution of used
materials where, in his opinion,
such used materials will provide
the equivalent in service, ap-
pearace, and useful life.
4) All fences and walls, ex-
cluding masonry and approved
permanent finish panels, shall
be painted a uniform neutral
color. excluding black, which
blends with the surrounding
terrain and improvements and
shall be maintained in a neat,
orderly condition at all times.
Such fence or wall shall contain
no painted signs or posters
except as approved by the
Director of Planning. In all
cases, colors shall be subject
to approval by the Director of
Planning.
5) Any structures which are
used as part of the yard boun-
daries and/or are exposed to
view from a street frontage
shall be subject to painting,
maintenance and sign require-
ments for fences and walls as
hereinabove p r o v id e d. The
Director of Planning may ap-
prove other appropriate archi-
tectural treatment.
d. PAVING OF YARDS: All
areas of the yard open to
vehicular passage shall be
paved with not less than two
inches (2") thick asphalt sur-
facing or oil and aggregate
mixture to prevent emission of
dust or tracking of mud onto
public rights -of -way, provided,
however, the Director of
Planning may approve other
paving materials which provide,
in his opinion, the equivalent
in service and useful life. Areas
designated for storage or which
a r e otherwise restricted to
vehicular passage shall be indi-
cated on the plot plan and be
so maintained unless surfaced
as hereinabove provided.
e. REQUIRED PARKING:
One space for each 7,000 square
feet of yard area or fraction
thereof, up to the first 42,000
square feet. One space for each
20,000 square feet of yard area
or fraction thereof, in excess
of 42,000 square feet.
f. LANDSCAPING: Along
each street frontage all required
setbacks and the adjacent street
parkways shall be landscaped
with a plot plan which complies
with the following criteria:
1) Landscaping shall be
provided along said frontage in
accordance with the plot plan
approved by the Director of
Planning.
2) A permanent automatic
irrigation system shall be pro-
vided which satisfactorily irri-
gates all planted areas.
3) All landscaped areas
shall be continuously and prop-
erly maintained in good condition,
g. PAINTING AND MAIN-
TENANCE: All equipment,
structures, e t c . , extending
above the height of exterior
fences shall be continuously
maintained and painted in a
neat and orderly fashion.
h. RUBBISH CONTAINERS:
Containers approved by the
Fire and Sanitation Depart-
ments shall be provided for the
storage of combustible
materials removed from scrap
autos delivered to the site.
1. LITTER: The entire site
shall be continuously main-
tained to prevent accumulations
of weeds, rubbish, litter or com-
bustible waste. Any incidents of
rat or vermin harborage shall
be promptly corrected.
j. COMPLIANCE: The pro-
visions of this ordinance shall
not relieve the operators of scrap
metal processing uses from com-
plying with all city regulations,
laws and ordinances.
k. PLOT AND PRELIM-
INARY ARCHITECTURAL
PLANS: Plot and preliminary
architectural plans showing the
landscaping, and other facilities
shall be submitted to the Direc-
tor of Planning who shall ap-
prove such plans if he finds that
they comply with the standards
as hereinabove provided.
1. PERFORMANCE STAN-
DARDS
Noise
Measurement.
Noise shall be measured with
a sound level meter, octave
band analyzer or impact noise
analyzer meeting the standards
of the American National Stan-
dards Istitute (ANSI S1.4 - 1961
and ANSI S1.11 - 1966). The
Instruments shall be set to the
"A" weighting scale, and the
meter to the slow response.
Maximum permitted steady
state sound levels.
Table I below designates the
applicable levels that apply on
or beyond adjacent lot lines
within the zone and on or
beyond the appropriate district
boundaries. Noises shall not
exceed the maximum permitted
sound levels in Table I. Where
more than one set of sound -
levels apply, the most restric-
tive shall govern. Readings may
be made at points of maximum
noise intensity along lot lines
or district boundaries.

Maximum permitted impact
values.
For purposes of this Ordi-
nance, impact noises shall be
considered to be those noises
whose peak values are more
than 3 dB higher than the
values indicated on the sound
level meter.
For impact noise levels, the
values of Table II shall apply

Between the hours of 7:00
P.M. and 7:00 A.M., all of the
permissible noise levels indi-
cated in the previous tables for
resident district boundaries
shall be reduced by 10 decibels.
Noises not under direct con-
trol of an industrial operation
(such as independent trans-
portation facilities) are ex-
cluded from the above limita-
tion.
Vibration.
Ground transmitted vibration.
shall be measured sequentially
in 3 mutually perpendicular
directions with an acceler-
ometer and complement of
instruments capable of record-
ing acceleration.
Vibration levels, maximum
steady state permitted.
Table I designates the applic-
able levels that apply on or
beyond adjacent lot lines within
the zone, and on or beyond
appropriate district boundaries.
Vibration shall not exceed the
maximum permitted steady-
state values shown in Table I.
Where more than one set of
vibration levels apply, the most
r e s t r i c t i v e shall govern.
Readings may be made at
points of maximum vibration
intensity. Readings will be in

Uetween the hours of 7:00
P.M. and 7:00 A.M., all of the
permissible vibration levels
indicated in Table II for neigh-
boring residential district boun-
daries shall be reduced by one-
half of the indicated values.
Air Pollution
Any activity, operation or
device which causes, or ten
to cause, the release of
contaminants into the at
phere shall comply with the
rules and regulations of the San
Diego County Health Depart-
ment.
Smoke.
The emission of smoke as
dark or darker than the shade
db referenced to % micro-l; �db'
or equivalent opacity ofRingel-
mann No. 2 for an aggregate
of more than 3 minutes in any
one hour is prohibited.
Particulate Matter (wind-
borne dust).
The release of windborne dust
across district boundary lines
shall not become a nuisance to
persons or property outside the
MH district.
Odorous Matter.
Odorous matter released' from
any operation or activity shall
not exceed the odor threshold
concentration when measured in
a Residential District. either at
ground level or habitable eleva-
tion.
Fire and Explosion Hasarde.
A c t i v t tie s involving the
storage, use or manufacture of
fire and explosive hazard mar
terials shall be conducted is
accordance with the City Fire
Code.
Corrosive Materials.
The storage. utilization or
manufacture of corrosive mater-
ials is permitted subject to the
provisions of the City Fire Code.
m. ABATEMENT: All scrap
metal processing uses, including
the entire premises upon which
they are located. shall be im-
proved to be in full compliance
with all provisions herein within
a period of not more than one
year from the effective date oI
this ordinance. All such uses and
premises shall thereafter be
operated and maintained in com-
pliance herewith.
n. ENFORCEMENT: En-
forcement of the regulations
contained in this ordinance shall
be preceded by notice from the
enforcement officer to the prop-
erty owner andjor tenant of the
affected scrap metal processing
use and premises. This notice
shall clearly define the matter
-requiring compliance and shall
allow a reasonable period of
time, to be determined by the
enforcement officer, for such
compliance.
Said Notice shall be given by
postage in the U. S. mail.
In enforcement of those provi-
sions hereof prescribing PER-
FORMANCE STANDARDS. said
Notice shall contain an explana-
tion of the type, place, time,
method, duration and results of
measurements made by the
enforcement officer.
