ORDINANCE NO. 1247
AN ORDINANCE AMENDING
ORDINANCE NO. 1021 RELAT-
ING TO PAWNSHOPS
The City Council of the City
of National City DOES ORDAIN
that Ordinance No. 1021 is
amended and changed in the
following respects:
SECTION 1. Section 2 is
hereby amended to read as
follows:
Section 2. Reports to Police.
(a) Every pawnbroker or
second-hand dealer shall daily
before the hour of 10:00 o'clock
in the morning make out and
deliver to the office of the
Police Department, on blank
forms approved by the Chief of
Police, a full, true and complete
report of all goods, or things
received on deposit, pledged or
purchased during the preceding
business day. Said report shall
be LEGIBLE and contain signa-
ture, address, identification and
physical description of the per-
son by whom such article was
left on deposit, pledged, or sold.
Such report shall show the num-
ber of the pawn ticket, amount
loaned, amount purchased, and
an accurate description of each
article left on deposit, pledged
or purchased. This includes thn
model, make, style, color, iai
number or any other identifying
marks when possible.
(b) A copy of this section,
to be furnished by the City
Clerk, shall be kept conspicu-
ously posted in the place of
business of every such pawn-
broker or secondhand dealer.
SECTION 2: Section 6 is
hereby amended to read as
follows:
Section 6. Disposal of Mer-
chandise Acquired in This Busi-
ness.
(a) Such articles must be
held separate and for a period
of thirty (30) days before being
resold or disposed of, except
upon approval of the Chief of
Police.
(b) Articles shall not be al-
tered, painted or repaired
during this period.
SECTION 3: The following
paragraphs are hereby added as
Section 8, 9, and 10 of Ordinance
1021.
Section 8. Use of Fictitious
Name on Bill of Sale.
(a) It shall be unlawful for
any person to sign or give a
false name or address on Bill
of Sale Form.
(b) Bill of Sale for any
specified term is strictly pro-
hibited.
Section 9. Suspension of Li-
cense.
The Chief of Police may sus-
pend a license for violations
regulating this business and for
conducting business in an
unlawful manner. Persons who
continue business after suspen-
sion of license are subject to
arrest.
Section 10. Right of Appeal.
A licensee may appeal a re-
fusal of his application for a
license or a refusal to renew
a license, The applicant shall
make his appeal within ten (10)
days after receiving notice of
an appealable action. The ap-
peal < shall be directed to. the
City 'Council, in writing, stating
the grounds for appeal.
Upon receipt of the appeal,
the City Council shall fix a time
for hearing the appeal, which
hearing shall be within thirty
(30) days of receipt of the
appeal.
At the hearing on the appeal,
the City Council shall consider
the reports of appropriate staff
members, together with the
statements or evidence sub-
mitted by the appellant. Within
ten (10) days of the hearing
of the appeal, the City Council
shall act to either sustain or
deny the appeal.
Failure to appeal within ten
(10) days from the action of
the Chief of Police shall be con-
clusive consent to said action.
