HomeMy WebLinkAboutCC ORD 1970-1259 Adopts 1970 Uniform Building Code and appendix except Ch. 70; repeals Ord. 1197 (Repealed by 1421)1259 ORDINANCE NO. 1269 AN ORDINANCE OF THE CITY OF NATIONAL CITY CALIFORNIA, A D O P T I N G THE UNIFORM BUILDING CODE, VOLUME 1, 1970 EDI TION AND THE APPENDIX THERETO, EXCEPTING CHAPTER 70, PROVIDING PENALTIES FOR THE VIOLA- TION THEREOF AND RE- PEALING ORDINANCE NO. 1197, AND ALL OTHER ORDI- NANCES AND PARTS OF OR- DINANCES OF SAID CITY IN CONFLICT THEREWITH. The City Council of the City of National City, California does Ordain as follows: SECTION 1. That Ordinance No. 1197 of the City of National City, and all other ordinances and parts of ordinances in con- flict with this ordinance are hereby repealed. SECTION 2. There is hereby adopted by the City Council of the City of National City for the purpose of prescribing regu- lations governing the erection, construction, enlargement, al- teration, repair, moving, re- moval, demolition, conversion occupancy, equipment use, height, area, fire resistance, and maintenance of all build- ings and/or structures, that cer- tain code known as the Uniform Building Code, Volume 1 and the Appendix thereto, excepting Chapter 70, published by the International Conference of Building Officials, being par- ticularly the 1970 Edition thereof, save and except such portions as are hereinafter deleted modified, or amended, of which code not less than three (3) copies have been and are now on file in the office of the City Clerk of the City of National City and the same are hereby adopted and incor- porated as fully as if set out at length herein, and from the date on which this ordinance shall be controlling within the limits of the City of National City. SECTION 3. Section 204 of the code adopted by this Ordinance is hereby amended to read as follows: SECTION 204. BOARD OF APPEALS. The Building and Housing Advisory and Appeals Board, established by City Ordi- nance No. 1189 shall determine the suitability of alternate materials and methods of con- struction; provide reasonable interpretations of the provisions of this code; and shall rec- ommend to the City Council such new legislation as is con- sistent therewith. The decisions of the Director of Building and Housing in interpreting the provisions of this code; the refusal to issue any permit required by this code; and any action in issuing a Correction Notice or Notice to Abate a Public Nuisance may be appealed to the Building and Housing Advisory and Appeals Board. All such appeals shall be made in accordance with procedures set forth in Section 7 of City Ordinance No. 1189. Section 205 of the code adopted by this ordinance is hereby amended to read as follows: SECTION 205. ABANDONED CONSTRUCTION WORK Any abandoned building or structure or portion thereof in an incomplete condition inher- ently constitutes injury hazards and is otherwise dangerous to health, safety, and the public welfare by reason of unpro- tected trenches and excava- tions, projecting structural ele- ments, open pipe .systems, exposed electrical conductors, and/or other conditions charac- teristic of construction projects. (a.) General. Whenever any building or structure, for which construction work has been au- thorized by a permit issued pur- suant to this code, is abandoned in such an incomplete condition for a period in excess of 120 calendar days, said building or structure is, for the purpose of this section, an unsafe building and is hereby declared to be a public nuisance. Such public nuisance shall be abated in accordance with the procedures specified in Section 203 of this code, (b.) Notice to Permit Holder The Director of Building and Housing shall give to the permi holder of such abandoned con struction work written notice - stating that such work is in vio- lation of this section. A copy shall be provided to the owner of record. This notice may re- quire the permit holder, within 24 hours, to commence either the completion of said aban- doned construction work in accordance with approved plans and specifications or the demo- lition and removal of all por- tions of the construction work from the premises. All required corrective work shall be com- pleted within a time limit speci- fied by the Director of Building and Housing. Proper service of such notice shall be made upon such permit holder by registered or certified mail, return receipt requested. (c.) Renewal Permit Re- quired. Before construction work can be recommenced a renewal building permit shall be first obtained to do so, and the fees therefor shall be paid as specified in Section 302 (d) of this code. (d,) For the purpose of this section, the term `incomplete structure" shall be interpreted to mean any building or struc- ture described in paragraph (a.) of this section and which is open to trespass by the pub- lic, or which constitutes a hazard to any official named in Section 202 (a) and (b), any police officer, fire official, or other authorized person entering upon the premises in the perfor- mance of any official duty required by this code or other ordinance or law. Fencing shall not be deemed as closing such premises to trespass as described herein. SECTION 4. Section 104 of the code adopted by this ordinance is hereby amended by adding the following exception to sub- section (e): EXCEPTION: Replacement of glass in hazardous locations, as specified in Section 5406, shall be as required for new installations. SECTION 5. Section 201 of the code adopted by this ordinance is hereby amended to read as follows: SECTION 201. There is here- by established in the City of National City a Department of Building and Housing which shall be under the direction of the Director of Building and Housing designated by the appointing authority. SECTION 6. Section 301 (a) of the code adopted by this ordi- nance is hereby amended to read as follows: Section 301 (a). PERMITS REQUIRED. No person, firm, or corporation shall erect, con- struct, enlarge, alter, repair, move, improve, remove, con- vert, or demolish any building or structure in the City of Na- tional City, or cause the same to be done, without first ob- taining a separate building per- mit for each such building or structure from the Director of Building and Housing. EXCEPTIONS: 1. Fences and free-standing walls not over six feet (6') in height. 2. Retaining walls and plant- er boxes not over three feet (3') in height. 3. Television a nd radio towers supported on roofs. 4. Awnings projecting not over six feet (6') where sup- ported by the exterior walls of buildings of Group I or J occu- pancy. 5. Standard electroliers not over thirty-five feet (35') in height above finish grade. 6. Repairs which involve only the replacement of com- ponent parts or existing work with similar materials for the purpose of maintenance, and which do not aggregate over $100.00 in valuation in any twelve (12) month period, and which do not affect any electri- cal or mechanical installations. Repairs exempt from permit requirements shall not include any addition, change, or modi- fication in construction, exit r equirements, or permanent fix- r tures or equipment. Specifically excepted from permit require t ments without limit to valuatio - are the following. I. Painting and decorating. II. Installation of floo covering. III. Cabinet work. IV. Outside paving. SECTION 7. Section 302 (b) of the code adopted by this ordi- nance is hereby amended by deleting the second paragraph thereof. SECTION 8. Section 303 (b) of the code adopted by this ordi- nance is hereby amended to read as follows: 303 (b). PLAN CHECKING FEES. When a plan is required to be submitted by Subsection (c) of Section 301, a plan - checking fee shall be paid to the Director of Building and Housing. Said plan -checking fee shall be equal to one-half of the building permit fee as set forth in Table No. 3-A. SECTION 9. Section 303 of the code adopted by this ordinance is hereby amended by adding subsections (c), (d), and (e) to read as follows: 303 (c) REINSPECTION FEES. Whenever it shall be necessary to make an extra inspection trip due to the appli- cant for a permit giving an incorrect address or location, or due to faulty, incomplete, or defective installation, an addi- tional fee in the amount of TEN DOLLARS ($10.00) as a rein- spection ree may be charged as determined by the Director of Building and Housing. 303 (d) COMPLIANCE SUR- VEY FEE. Tne ree for conduct- ing a compliance survey of an existing building or structure shall be paid to the Director of Building and Housing at the rate of $0.50 per 100 square feet or fraction thereof of floor area. The minimum compliance sur- vey fee shall be TWENTY-FIVE DOLLARS ($25.00). 303 (e) EXCEPTIONS. The United States, the State of Cali- fr:nia, the County of San Diego, the City of National City and other public agencies shall not required to pay any fees for filing an application for a building permit pursuant to this code. SECTION 10. Section 304 of the code adopted by this ordi- nance is hereby amended by adding subsections (f) and (g) to read as follows: 304 (f) COMPLIANCE SIR- V E Y INSPECTION. Upon receipt of a written request for a compliance survey from the owner and after the fee speci- fied in this section has been paid, the Director of Building and Housing may inspect an existing building or structure to ascertain its compliance with the provisions of this code and other applicable laws and ordi- nances, and report his findings in writing to such owner. 304 (g) REINSPECTIONS. A reinspeetion fee may be assessed for each reinspection pursuant to Section 303 (c). This subsection is not to be construed to mean that reinspection fees shall be required the first time work is rejected for failure to comply with the requirements of this code, but as a control over the practice of calling for inspections before work is ready for such inspections or reinspec- tions. Reinspection fees may be assessed by the Director of Building and Housing whenever it is apparent that the inspec- tion staff is being used to pro- vide on-the-job supervision of work rather than for the perfor- mance of proper inspection duties as specified in this code. To obtain a reinspection, the permittee shall file an applica- tion therefor in writing upon a form provided for that purpose, and shall pay the reinspection fee specified in Section 303 (c). Where reinspection fees have been assessed by the Director of Building and Housing no additi-al inspection work shall be r� 'formed until the required fees 'lave been paid. SECTION 11. Section 308 is hereby added to the code adopted by this ordinance to f earl as follows: Section 308. STREET NUM- n BERS. Every principal building or structure located within the incorporated limits of the City of National City shall be identi- fied by a designating street number as issued by the Direc- tor of Building and Housing. Said designating street number shall be of sufficient size and contrasting color to appear readable from the adjacent street or public way. SECTION 12. Section 502 of the code adopted by this ordi- nance is hereby amended to read as follows: SECTION 502. No change shall be made in the character of occupancies or use of any building which would place the building in a different division of the same group or occupancy or in a different group of occu- pancies, unless such building is made to comply with the requirements of this code for such division or group of occu- pancy. EXCEPTION: The character of the occupancy of existing buildings may be changed sub- f the Drector of Builct to the ding aproval o and Hous- ing, and the building may be occupied for purposes in other groups without conforming to all the requirements of this code for those groups, provide] the new or proposed use does not result in a hazard, based on life and fire risk, greater than that of the existing use. No change in the character of occupancy of a building shall be made without a certificate of occupancy for the new use, as required in Section 306 of this code. The Director of Build- ing and Housing may issue a I certificate of occupancy pur- suant to the intent of the above exception without certifying that the building complies with all provisions of this code. SECTION 13. Section 511 is hereby added to the code adopted by this ordinance to read as follows: SECTION 511. FIRE PRO- TECTION. All premises where buildings or portions of build- ings are hereafter constructed shall comply with Section 13 of the currently adopted edition of the Uniform Fire Code. SECTION 14. Section 1502 of the code adopted by this ordi- nance 1s hereby amended by adding to the first paragraph thereof an exception to read as follows: EXCEPTION: Agricultural and nursery shade structures used only for the protection of live plants and vegetation when covered with non-combustible or plasticized materials which are inherently flame retardant and which are approved for exterior use, may exceed 1,000 square feet in area. SECTION 15. Section 1503 of the code adopted by this ordi- nance is hereby amended by adding thereto as follows: Agricultural and nursery shade structures used only for the protection of live plants and vegetation, when covered with non-combustible or plasticized materials which are inherently flame retardant and which are approved for exterior use, shall be located only in Fire Zone 2, and shall not be less than ten feet (10') from any adjacent property line if the covered area exceeds 1,000 square feet. SECTION 16.
