AN ORDINANCE OF THE CITY OF NATIONAL CITY,
CALIFORNIA, ESTABLISHING THE REQUIREMENTS
TO ENGAGE IN THE BUSINESS OF TATTOOING,
PROVIDING REGULATIONS OF THE TATTOO ARTIST
AND OF THE FACILITIES USED HEREFOR.
The City Council of the City of National City does
ordain as follows:
SECTION 1: That it is in the public interest and
welfare that any person engaging in the business of tattooing
should be required to meet certain minimal standards and that
the business itself should be regulated for the health and
safety of the general public and this Ordinance is therefore
passed.
SECTION 2: The owners and managers of tattooing
establishments and personnel employed therein shall conform or
secure confirmation to the following regulations:
A. STORING OF INSTRUMENTS. All needles and instru-
ments shall be kept in a closed glass case while not in use.
B. STERILIZATION OF TATTOOING INS1'RUMENTS. All in-
struments, including the needles used in tattooing human beings,
shall be wrapped, and sterilized by steam in an autoclave with
at least 15 pounds pressure per square inch for at least 15
minutes at 240o F. before each use.
C. STERILIZING SOLUTION. Sterilizing solutions, ap-
proved by the health officer may be used on instruments whenever
it can be shown to the health officer that such instruments,
other than needles, are damaged by boiling in a sterilizer.
D. PREPARATION OF THE SKIN. The skin shall be pre-
pared first by thorough soaping with an antiseptic soap such
as hexachlorophene. If the skin is shaved it also shall be
prepared by soaping and further disinfected with antiseptic
solution such as 70% alcohol.
E. APPLICATION OF STENCIL. Before each use all sten-
cils shall be disinfected. These stencils shall be disinfected
by use of an antiseptic soap, preferably hexachloraphene.
F. USE AND ADMINISTRATION OF PIGMENTS. All pigments
used shall be dispensed from individual paper dispensers. The
containers shall be used for one person only. Only sterile
pigments shall be used.
G. DRESSING TATiU0 AFTER COMPLETION. A sterile
dressing shall be applied and securely bound by adhesive tape
at site of tattoo after a person is tattoed.
H. STERILIZATION OF RAZOR AND OTHER EQUIPMENT. All
razors used in this operation shall be sterilized in an auto-
clave or in a boiling water solution before use.
I. OPERATING TABLES. All operating tables shall be
constructed with metal, with white enamel or porcelain finish,
or stainless steel.
J. MINORS. It shall be unlawful to tattoo any person
under the age of twenty-one years, unless the written consent of
the parent or guardian is obtained, and such written consent shall
be kept on file for two years in the office of said establishment.
K. INFECTIONS. All infections resulting from the prac-
tice of tattooing shall be reported to the health officer by the
person owning or operating the tattooing establishment.
L. CUSPIDORS. Adequate cuspidors must be furnished,
but shall be cleaned daily; shall be kept in a clean and sanitary
condition, and shall be provided at all times with a disinfecting
solution approved by the health officer.
M. MINIMUM FLOOR SPACE. Any such tattooing establish-
ment shall have not less than 150 square feet of floor space,
and the light and ventilation shall be of a standard approved by
the health officer.
N. It shall be unlawful for any person engaged in the
tattoo business, whether as an operator or owner, to tattoo
anyone that is under the influence of intoxicating liguors.
O. No other business shall be conducted within the
same business area in which a tattoo parlor is housed. This
provision shall not be construed so as to prohibit different
businesses within the same building or store, but the parti-
tions shall comply with all of the provisions of the Building
Code and this Ordinance.
P. Any tattoo shop in the City of National City
shall be so located or constructed as to prevent the contamina-
tion of the work area of such shop by dust or other forms of
dirt from the street or sidewalk.
Q. The tattoo shop shall be at all times maintained
in a sanitary condition and all walls, ceilings and floors shall
be smooth and easily cleaned. Walls and ceilings must be painted
a light color and all walls, ceilings and floors shall be kept
clean and free from dust and debris. The floors shall be swept
and wet mopped daily. Floors, walls and ceilings shall not be
swept or cleaned while tattooing is in operation.
R. Adequate light and ventilation must be provided.
S. Each tattooing shop shall contain a sink for the
exclusive use of the tattoo artists to wash their hands and
prepare the customers for tattooing. The sink shall be provided
with adequate hot and cold running water. There shall also be
available at the sink approved soap, clean individual towels
and refuse containers.
T. Adequate toilet, and handwashing facilities shall
be available on the shop premises for the use of customers and
tattoo artists. Toilets, urinals, and hand - washing facilities
shall be maintained in a sanitary condition at all times.
U. An adequate number of work tables shall be provided
for each tattoo artist. The surface of all work tables shall
beconstructed of metal or other material which is smooth,
light-colored, non - absorbent, corrosive -resistant and easily
sanitized.
V. The tattooing shop shall have proper facilities
for the disposition of waste materials.
W. Each tattoo artist shall be provided with in-
dividual hand brushes and fingernail files.
SECTION 3: The term tattooing means any method of
placing designs, letters, scrolls, figures, symbols or any
other marks up -on or under the skin with ink or colors, by the
aid of needles or instruments.
SECTION 4: It is unlawful for any person, firm or
corporation to engage in the business of operating a tattoo
establishment within the City of National City without first
applying for and receiving from the health department of the
City of National City a permit therefor, in the manner herein-
after provided, or without complying with the provisions of
this Ordinance.
SECTION 5: Every person, firm or corporation ap-
plying for a permit shall file with the health department of
the City of National City a written application which shall
state the name and address of the applicant, a description of
the property wherein or where -upon it is proposed to conduct
the tattoo establishment, and such other information as the
department of health will require.
SECTION 6: Every applicant for such permit shall be
at the time of making such application deposit with and pay to
the City Treasurer the annual inspection fee hereby established
at $25.00 per year. This fee shall not be pro -rated by reason
of the time of application, and shall be in addition to the
business license fee.
SECTION 7: Upon the filing of the application ac-
companied by the fee, it shall be the duty of the health officer
to investigate the information contained in the application
and the sanitary conditions in and about the place wherein or
whereon it is proposed to conduct the establishment, and
whether or not said place conforms to the requirements of the
Ordinances of this City and with the rules and regulations of
the department of health.
SECTION 8: Unless it shall appear to the satisfaction
of the health officer that such place conforms to the require-
ments of the laws of the City of National City and with the
general health laws of the State of California, the application
shall be denied, and the permit may be suspended by the Board
of Health for good cause.
SECTION 9: The owner, proprietor or manager, and
any of the employees therein of such tattooing establishment,
shall keep a copy of this Ordinance posted in a conspicuous
place in his establishment, which copy shall be furnished by
the City Clerk of the City of National City.
SECTION 10: This Ordinance shall take effect and be
in force on the 31st day from and after its adoption.
SECTION 11: That the City Clerk of the City of Nat-
ional City be and he is hereby directed to cause this Ordinance
to be published once in the National City Star News, a newspap-
er published and of general circulation in the said City of
National City.
