HomeMy WebLinkAboutCC ORD 1966-1147ORDINANCE NO. 7 AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA, ADOPT- ING, BY REFERENCE, THE UNIFORM PLUMBING CODE, 1964 EDITION, AND APYhNDIX A., B., C., D., E., AND F., DECLARING AND ESTAB- LISHING REGULATIONS FOR THE INSTALLATION, MAINTENANCE, AND ALTER- ATION OF PLUMBING SYSTEMS WITHIN THE CITY OF NATIONAL CITY; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; AND REPEALING ORDINANCE NO. 998 AND ALL OTHER ORDINANCES AND PARTS OF OR- DINANCES OF SAID CITY IN CONFLICT THEREWITH. The City Council of the City of National City, California, does ordain as follows: SECTION 1. That Ordinance No. 998 of the City of National City, and all other ordinances or parts of ordinances in conflict with this ordi- nance are hereby repealed. SECTION 2. There is hereby adopted by the City Council of the City of National City for the purpose of prescribing regulations for the protection of the public health and safety and the qualification and registration of persons engaged in the business of plumbing, or laboring at the trade of plumbing; requiring permits and inspection for the installa- tion or alteration of plumbing and draining systems; designating the administrative authority establishing minimum regulations for the installa- tion, maintenance, alteration, or repair of plumbing and drainage systems, that certain code known as the Uniform Plumbing Code and Appendix A., B., C., D., E., and F. thereto, prepared by the Western Plumbing Officials Association, being particularly the 1964 Edition thereof, save and except those portions as are hereinafter deleted, modified, or amended, of which code not less than three (3) copies have been and now are filed in the office of the Clerk of the City of National City and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the City of National City. SECTION 3. That Section 1.1 of the code adopted by this ordinance is hereby amended and shall read as follows: 1.1 Administrative Authority and Assistants When the term "administrative authority" is used in this code it shall be construed to mean the Director of Building and Housing or his authorized representatives. SECTION 4. That Section 1.2 of the code adopted by this ordinance is hereby amended to read as follows: 1,2 Assistants Whenever the term "assistants" is used in this code it shall be construed to mean deputy inspectors or other authorized persons/to act for the Director of Building and Housing. SECTION 5. That Section 1.7 of the code adopted by this ordinance is hereby amended to read as follows: 1.7 The issuance or granting of a permit or approval of plans and specifications shall not be deemed or construed to be a permit for, or an approval of, any violation of any of the provisions of this code. No permit pres»ming to give authority to violate or cancel the provisions of this code shall be valid, except insofar as the work or use which it authorizes is lawful. The issuance or granting of a permit or approval of plans shall not prevent the Administrative Authority from thereafter requiring the correction of errors in said plans and specifications or from preventing construction opera- tions being carried on thereunder when in violation of this code or any other ordinance or from revoking any Certificate of Approval when issued in error. Every permit issued by the Administrative Authority under the provisions of this code shall expire by limitation and become null and void, if the work authorized by such permit is not commenced within sixty (60) days from the date of issuance of such permit, or if the work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of sixty (60) days. Before such work can be recommenced a new permit shall be first obtained so to do. SECTION 6, That Section 1.10 (a) of the code adopted by this ordinance is hereby amended to read as follows: 1.10 (a) To Whom Permits May Be Issued (a) No permit shall be issued to any person to do or cause to be done any plumbing or drainage work regulated by this code, except to a person holding a valid unexpired and unrevoked plumbing contractor's license issued by the State of California, or his duly authorized representative, except when and as otherwise hereinafter provided in this code. SECTION 7. That Section 1.10 (b) o the code adopted by this ordi- nance is hereby amended to read as follows: 1.10 (b) No permit shall be i sued to any person to do, or to cause to be done, any sewer or private sewage disposal system work regulated by this ode, except to a person holding a valid unexpired and unrevoked sewer or sewer dis- posal ct3ntractor's license issued by the State of California, or his duly authorized representative, except when and as otherwise hereinafter provided in this code. SECTION g. That Section 1.10 (c) of the code adopted by this ordi- nance is hereby amended to read as follows: 1.10 (c) An owner or a member of his immediate family, re- siding at the same address, and holding a Special Homeowner's Certificate, may obtain a special owner's permit authorizing him to install plumbing work and fixtures in, on, or about any single family dwelling but not elsewhere, provided, that such single family dwelling is occupied by or designed to be occupied by said owner as his legal place of residence and that said owner shall personally purchase all material and shall personally perform all labor in connection therewith. A Special Homeownerls Certificate may be issued once every two years provided, that the owner has successfully passed an examination given by the Administrative Authority and that such owner has paid an examination fee in the amount of five dollars ($5.00). SECTION 9. That Section 1.12 of the code adopted by this ordinance is hereby amended to read as follows: 1,12 Cost of Permit Every applicant for a permit to install, add to, alter, relocate, or replace a plumbing or drainage system or part thereof, shall state in writing on the application form pro- vided for that purpose, the character of work proposed to be done and the amount and kind of material to be used in conjunction therewith, together with such information pertinent thereto as may be required. Such applicant shall pay for each permit issued at the time of issuance, a fee in accordance with the following schedule, and at the rate provided for each classification shown. therein. Any person who shall commence any plumbing work for which a permit is required by this code without first having obtained a permit therefor shall, if subsequently permitted to obtain a permit, pay double the permit fee fixed by this section for such work, provided, however, that this provision shall not apply to emergency work when it shall be proved to the satisfaction of the Administrative Authority that such work was urgently necessary and that it was not practical to obtain a permit therefor prior to the commencement of the work. For the purpose of this section a sanitary outlet on or to which a plumbing fixture or appliance may be set or attached shall be construed to be a fixture. Fees forrecon- nection and retesting of existing plumbing systems in re- located buildings shall be based on the number of plumbing water heaters, fixtures, gas systems, water systems/etc., involved. When a permit has been obtained to connect an existing building or existing work to the public sewer or to connect to a new private disposal facility, backfilling of private sewage disposal facilities abandoned consequent to such connection is included in the building sewer permit. Fee For Failure to Obtain Permit In addition to any other penalty provided in this code for violations thereof, any person who, after notification, has done any plumbing work without a permit required by this code, or who has allowed any such work to be done without a permit shall pay a fee of ten dollars (410.00) in addition to the regular permit fee for inspection of such work. Plumbing Permit Fees SCHEDULE OF FEES For issuing each permit ... 2.00 In addition -- For each plumbing fixture or trap or set of fixtures on one trap (including water, drainage, piping and backflow protection therefor) 1.50 For each }wilding sewer and each trailer park sewer ................................. 5.00 Rainwater systems - per drain .. 2.00 For each cesspool . 5.00 For each private sewage disposal system 10.00 For each water heater and/or vent 1.50 For each gas piping system of one (1) to five (5) outlets ... 1.50 For each gas piping system of six (6) or more, per outlet .30 For each industrial waste, pre-treatment interceptor, including its trap and vent, excepting kitchen type grease interceptors functioning as fixture traps 1.00 For installation, alteration or repair of water piping and/or water treatment equipaent.1.50 For repair or alteration of drainage or vent piping . 1.50 For each lawn sprinkler system on any one meter including backflow protection de- vices therefor 2.00 For vacuum breakers or backflow protective devices on tanks, vats, etc., or for in- stallation on unprotected plumbing fixtures including necessary water piping-- one (1) to five (5) . 2.00 Over five (5), each ..,. .30 The inspection of any plumbing system or equipment for which no fee is herein prescribed, for the time consumed, per hour •.*. _ $ 3.00 The above fees shall be paid to the /City Treasurer of the City of National City or hit d=zty before the issuance of a plumbing permit.. The United States, the State of California, County of San Diego, School Districts, and other public agencies shall be exempt from payments of fees prescribed by this section. Expiration of Permit Plumbing permits issued pursuant to this code shall be void at the expiration of one year from the date of issuance. Reinspection Fees Whenever it shall be necessary to make an extra in- spection trip due to the applicant for any permit giving an incorrect address or wrong location in obtaining a permit required by this code, or due to faulty or defective in- stallation, an additional fee in the amount of five dollars ($5.00) as a reinspection fee may be charged for each such additional inspection. Section 10. That Section 1.11 of the code adopted by this ordinance is hereby deleted. SECTION 11. That Section 2.9 of the code adopted by this ordinance is hereby amended to read as follows: 2.9 Expiration of Certificate of Qualifications or Registration Every Certificate of Qualification or Registration shall re- main in force and effect until its expiration date unless cancelled or revoked. (a) Plumbing Contractor's Certificates of Qualification or Registration shall expire on December 31st of each year. (b) Journeymen Plumber's Certificates of Qualification or Registration shall expire on December 31st of each year. SECTION 12. A new section is hereby added to Part 2 of the code adopted by this ordinance to read as follows: 2.12. Certificate of Qualification in Lieu of Examination The Director may at his discretion, waive the require- ments of an examination and issue a Certificate of Qualifica- tion for the City of National City to a person holding a valid current certificate of competency issued by the appropriate authority of a city within the County of San Diego or from the County of San Diego Building Inspection Department. SECTION 13. A new subsection (a) is hereby added to Section 1107 of the code adopted by this ordinance to read as follows: 1107 (a) Property Line Cleanouts: There shall be installed a cleanout in each building sewer line at the point of connection with the public sewer at the property line. Such cleanout shall be installed as close to the property line as possible, but shall be not more than three feet (3') inside the property line and shall be at grade. (1) Property line cleanouts shall be extended through finished concrete slabs, decks, paved areas, or drives and shall be so installed that the entire top of the cleanout plug shall be plainly exposed to view. (2) All property line cleanout bodies shall be a minimum of four -inch size and of the same size as the City's lateral to the sewer main, Exception: Property line cleanouts may be installed not more than 12 inches below the finished grade line of the property, provided, such cleanout is made readily accessible with a meter box and removable cover. Such covers in driveways shall be supported on concrete and shall be made of cast iron. SECTION 14. Penalty: Any person, firm, or corporation who violates or who omits, neglects, or refuses to comply with any of the provisions of this ordinance, or who maintains in service any plumbing system installed, constructed, altered, or repaired in violation of this ordinance, shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than $5.00 nor more than $500.00 or imprisonment in the County jail for a period not longer than six months, or by both fine and imprisonment. Upon proof of conviction in a court of competent jurisdiction of any person holding a certificate under the terms and provisions of this ordinance for the violation of the terms and provisions of this ordinance, the Board of Plumber Examiners shall thereupon have the power to suspend or revoke the certificate of such person so convicted for a period of time not to exceed one year. SECTION 15. Severability: If any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have adopted this code and each section, subsection, sentence, clause, phrase, or portion thereof irrespective of the fact that any one or more sections, subsections, clauses, phrases, or portions be declared invalid or unconstitutional.
