HomeMy WebLinkAboutCC ORD 1966-1149 Amends § 1(e) of Ord. 962, zoning (Repealed by 1503)ORDINANCE NO. 1142 ORDINANCE ESTABLISHING PROCEDURE FOR EXEMPTION FROM OR DEFERRAL OF SIDEWALK, CURB AND GUTTER REQUIREMENTS Section 1: Sub -section E. Paragraph 1 or Ordinance No. 962 is hereby amended to read as follows: In all zones within the City of National City, prior to the issuance of a Certificate of Occupancy or final inspec- tion by the Building Inspector for the construction, altera- tion, repair, conversion or relocation of all structures or buildings in excess of $2,500 valuation, sidewalks, curbs and gutters in front of and on the exterior side of said property shall be installed in conformity with the Ordinances of the City of National City. Section 2: In the event that the installation of the improvements as required by this section would cause a dangerous or defective condition of the property, or it would be extremely impractical to so install or construct the same, or the installation of said improvements would be incompa- tible with the present or future development of the neighbor- bood, or the public welfare would be best served by the instal- lation of said improvements as a part of an overall plan for the development of public improvements, then the property owner or his agent may apply to the Planning Commission for an exemption from or a deferral of the effects of this sec- tion, said application to be made on a form provided by the Director of Planning. Section 3: Within 30 days of the date of the filing of said application, the Commission shall hear the applicant at a regular meeting, and within 30 days there- after recommend to the City Council the granting or denial of the application for exemption or deferral. Section 4: The action of the Planning Commission regarding the granting or denial of the application for exemption or deferral shall be filed forthwith with the City Council. Within 15 days from the filing of the Commission's recommendation, the City Council shall act upon said recom- mendation, either granting or denying the applicatbn for exemption or deferral under any or all of the conditions hereinafter stated. Section 5: In acting upon the application for ex- emption or deferral, the Council may: A: Exempt the applicant from all of the provisions of this section; or, B: Defer the application of the provisions of this section for a specific period of time. In the granting of a deferral, the Council may, as a condition thereof, require the deposit of security in the form of cash or bond in an amount sufficient to insure the installation of the said improvements at the end of the deferral period. The amount of said security deposit shall not exceed the City Engineer's estimate of the cost of the improvements plus ten percent (10%) of the costs thereof. Section 6: Failure of the Council to take action on the recommendations of the Commission within 15 days of the date of the filing of the recommendation shall be deemed a denial of the exemption or deferral. Section 7: The period of deferral may be extended from time to time in the same manner as the granting of the or iginal deferral. Section d: The applicant for an exemption or deferral of said improvements shall pay a fee in the amount of $15 at the time of making said original application or application for extension of deferral to pay the cost of investigation and pro- cessing of the said application.
