HomeMy WebLinkAboutCC ORD 1964-1098 Adds § 4 to Ord. 1067, food handling regulations (9.04)ORDINANCE NO. 1098 AN ORDINANCE AMENDING ORDINANCE NO. 1067 INCORPORATING AMENDMENTS TO SAN DIEGO COUNTY ORDINANCE NO. 2443 WHEREAS, Ordinance 1067 adopted by reference San Diego County Ordinance No. 2443, with certain amendments, such ordinance relating to the preparation and disposition of food, and WHEREAS, Ordinance No. 2663 (new series) has been adopted by the San Diego County Board of Supervisors, such ordinance amending certain sections of the San Diego County Code, as said code codified said County Ordinance No. 2443, and WHEREAS, the City Council of the City of National City is desirous of incorporating said amendments into the provisions of National City Ordinance No. 1067 in order to provide for uniformity of the County and City ordinances; NOW, THEREFORE, the City Council of the City of National City does hereby ordain as follows: That ordinance No. 1067 of the City of National City be and hereby is amended by adding Section 4 as fol- lows: SECTION 4: The City Council of National City hereby adopts San Diego County Ordinance No. 2663 pertain- ing to amendments to the San Diego County Code, as said code codifies San Diego County Ordinance No. 2443, said adoption being by reference to a copy of said ordinance which is attached hereto and by this reference is made a part hereof. ATTEST: ORDINANCE NO. 2663 (NEW SERIES) AN ORDINANCE AMENDING SECTION 61.177 OF THE SAN DIEGO COUNTY CODE, RELATING TO PREPARED FOOD VENDING VEHICLES The Board of Supervisors of the County of San Diego do ordain as follows: Section 1. Section 61.177 of the San Diego County Code is hereby amended to read as follows: Sec. 61.177. PREPARED FOOD VENDING VEHICLES. No person shall operate or cause to be operated a prepared food vending vehicle without complying with all of the following requirements: (a) Such person shall establish, within the County, a service room which meets all of the requirements of this chapter applicable to food establishments. The service room shall be used for the preparation and/or temporary storage, at temperatures required by this chapter, of food and beverage products prior to the delivery thereof to a food vending vehicle. Unless written authorization from the Director of Public Health to do otherwise is first obtained, food vending vehicles shall be stocked only at and with food and beverage products prepared or stored at the service room. No food or beverage product shall be sold or otherwise distributed from a food vending vehicle unless such product was prepared in a service room or in a food establishment, for either of which a valid permit is held, or in some other sanitary location appropriate for such preparation which is regularly inspected by some recognized health department inspection service approved by the Director of Public Health. Food or beverage products not prepared in such service room or establishment shall be stored at a service room prior to delivery to the food vending vehicle. (b) No hot prepared food or beverage product, except coffee or tea, shall be sold from a food vending vehicle. -1- in the respects contemplated by said subsections (b), (c) and (d) of said Section 61.177. (e) No prepared foods, except donuts and coffee cake, shall be sold more than 24 hours after the preparation thereof, and all such prepared foods shall be clearly marked with the date of preparation thereof. (d) Every prepared food vending vehicle shall be inspected, on dates scheduled by the Health Officer, as often as he deems:such inspections to be necessary. The vending vehicle shall be fully loaded and ready for operation at the time of such inspection. The Health Officer shall issue a certificate of inspection if his inspection discloses that the vehicle conforms to the requirements of this code. The certificate of inspection shall expire one month from and after the date of its issue, and shall specify the particular food and beverage products authorized to be sold or otherwise distributed from the vehicle. Section 2. URGENCY MEASURE. This ordinance is declared to be an ordinance necessary for the immediate preservation of the public peace, health and safety within the meaning of Section 3751 of the Elections Code and shall take effect immediately. The facts constituting such necessity are as follows: Section 61.177 of the San Diego County Code, amended herein, was heretofore amended by Ordinance No. 2632 (New Series) at which time subsections (b), (c) and (d) thereof were inadvertently omitted. Said subsections contain regulations of prepared food vending vehicles necessary for the protection of the public health. This ordinance is necessary to correct the inadvertent omissions aforesaid and to provide immediate protection of .the public health in the respects contemplated by said subsections (b), (c) and (d) of said Section 61.177. -2- Section 3. Before the expiration of fifteen (15) days after its passage it shall be published once, with the names of the members voting for and against the same, in the San Diego Union, a newspaper of general circulation published in the County of San Diego.
