HomeMy WebLinkAboutCC ORD 1964-1105 Amends § 10 of Ord. 962, zoning (Repealed by 1503)ORDINANCE ND. 1105 AN ORDINANCE AMENDING ORDINANCE NO. 962, ESTABLISHING PROCEDURE FOR EXEMPTION FROM CURB AND GUTTER REQUIREMENTS The City Council of the City os National City does ordain as follows: Section 1: That Section 10, sub -section E, Para- graph 1 of Ordinance No. 962 is hereby amended to read as follows: In all zones within the City of National City, prior to the issuance of a Certificate of Occupancy or final inspec- tion by the Building Inspector for all new structures or buildings in excess of $2,500 valuation, sidewalks, curbs and gutter in front of and on the exterior side of said property shall be installed in con:orni .ty with the Ordinances of the City of National City. Section 2: That Section 10, Sub -section E, Para- graph 2 of Ordinance No. 962 is hereby amended to read as follows: In the event that the installation of the improve- ments as required by this section would cause a dangerous or defective condition to the property, or it would be extremely impractical to so install or construct the same, then the property owner or his agent may apply to the Planning Commis- sion for a special exemption from the provisions of this Sec- tion, stating his grounds and reasons therefor. Within sixty (60) days of the date of filing of such petition, the Commis- sion shall take action by recommending either a granting of an exemption or a denial of an exemption. Failure of the Commission to take such action on a petition within sixty (60) days of the date of filing shall be deemed a denial of the petition, provided however, that the applicant may waive this provision, in which the Commission shall retain jurisdiction to act on the petition. Section 3: That Section 10, Sub -section E, Para- graph 3 of Ordinance No. 962 is hereby amended to read as follows: The recommendation of the Planning Commission to grant or deny an exemption from the provisions of this Section shall be filed forthwith with the City Council. Within fifteen (15) days after filing of the Commission's recommendation, the City Council shall act upon such recommendation, either grant- ing or denying an exemption from the provisions of this Section. Failure of the Council to take action on the recommendation of the Commission within fifteen (15) days of the date of filing with the Council shall be deemed a denial of the exemption.
