HomeMy WebLinkAboutCC ORD 1964-1108 Adopts 1961 building code; repeals Ords. 840 and 905 (Repealed by 1197)ORDINANCE NO. 1108 AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA, ADOPTING THE UNIFORM BUILDING CODE, 1961 EDITION AND THE APPENDIX THERETO, PROVIDING PENALTIES FOR THE VIOLATION THEREOF; DECLARING AND F_STABLISHING FIRE ZONES AND REPEALING OR- DINANCES NO. 840, 905, AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES OF SAID CITY IN CONFLICT THEREWITH. The City Council of the City of National City, California, does Ordain as follows: SECTION 1. That Ordinance No. 840 and Ordinance No. 905 of the City of National City, and all other ordin- ances or parts of ordinances in conflict with this ordinance are hereby repealed. SECTION 2. There is hereby adopted. by the City Council of the City of National City for the purpose of prescribing regulations governing the erection, construc- tion, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment use, height, area, and maintenance of all buildings and./or structures, that certain code known as the Uniform Building Code and. Appendix thereto, prepared. by the International Conference of Building Officials being particularly the 1961 edition thereof and the whole thereof, save and except such portions as are hereinafter deleted., modified or amended, of which code not less than three (3) copies have been and now are filed in the office of the Clerk of the City of National City andthe same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the City of National City. SECTION 3. Section 201 of the building code adopted by this ordinance is hereby amended to read as follows: SECTION 201. There is hereby established in the City of National City a "Building Inspection Division" which shall be under the jurisdiction of the Chief Building Inspector designated by the appointing authority. SECTION 4. Section 307 shall be added to the building code adopted by this ordinance to read as follows: SECTION 307. No permit shall be granted by the City of National City authorizing the erection or major alteration of any building, or structure, nor shall the drawings and/or specifications for same be checked or approved by the Chief Building Inspector unless they have been prepared by or under the direct control of an architect or pro- fessional civil engineer licensed by the State of California except the following: Dwellings, single or multiple, not over two stories and basement in height, and their appurtenant buildings; Farm and Ranch buildings; Wood frame commercial buildings, not over one story in height, and where the span between bearing walls does not exceed 25 feet. This exemption does not apply to concrete or steel frame building. SECTION 5. Section 308 shall be added, to the build- ing code adopted. by this ordinance to read as follows: SECTION 308. Each occupancy or principal building or structure located. within the incor- porated. limits of the City of National City shall be identified by a designating number or letter or both as issued by the Chief Building Inspector. Said. designating number or letter shall be of a sufficient size and contrasting color to appear readable from the adjacent public way. SECTION 6. Table 5-A of the building code adopted. by this ordinance is hereby amended as follows: In Group F, the time limits for Fire Resistance of Exterior Walls for Fire Zones 1 and 2 shall be amended. as follows: a. The words "2 hour" shall be substituted. for the words "2 hour less than 20 feet 1 hour titled elsewhere" in the column/Fire Zone 1. b. The words "2 hour" shall be substituted for the words "1 hour" in the column titled Fire Zone 2. SECTION 7. That Section 1602 of said Uniform Build- ing Code 1961 Edition, adopted by this ordinance is hereby repealed; that Section 1603 of said Uniform Building Code, 1961 Edition, is hereby amended by substituting the words "Fire Zone No. 1" wherever the words "Fire Zone No. 2" appear in said Section; that Section 1604 of said Uniform Building Code, 1961 Edition, is hereby amended by substituting the words "Fire Zone No. 2" wherever the words "Fire Zone No. 3" appear in said Section. SECTION 8. Section 1603 (d) shall be added. to the building code adopted by this ordinance to read as follows: SECTION 1603 (d). Before any existing build- ing, house, or structure of any type whatsoever may be moved from one location within the city limits of the City of National City to another location within the city limits of the City of National City, application for such moving shall be made to the Building Inspection Division of the City of National City, and approved. by the City Council. Upon receipt of said application, the Building Inspection Division shall cause an inspection to be made of said building, house, or structure and a report of said inspection shall be filed. with the City Council. The City Council may approve or disapprove said application for any valid reason. No building, house or structure shall be moved from one location within the City of National City to another location within the City of National City without the express permis- sion of the City Council of the City of National City. The City Council may require the owner or his duly authorized agent to provide a certified. state- ment by a qualified contractor, currently licensed. by the State of California to the effect that such building, house, or structure is free from fungus, termites, or similar defects. Each building, house, or structure moved within the City of National City shall conform to the zoning regulations of the dis- trict in which it is to be located. and shall conform or shall be made to conform to this code and all other laws and ordinances applicable to new build- ings, houses, or structures. A fee of TWENTY-FIVE DOLLARS ($25.00) shall accompany each application to move a building, house, or structure from its present location on a building lot to a new location on the same building lot. A fee of ONE HUNDRED DOLLARS ($100.00) shall accompany each application to move a building, house or structure from one building lot to another building lot within the city limits of the City of National City. Said fees are to partially recompense the City of National City for expenses incurred.. The City Council of the City of National City may specify certain other conditions and requirements of any building, house, or struc- ture moved within the city limits of the City of National City. Permission may be granted or denied by motion of the City Council. In granting or deny- ing a permit to move an existing building, house, or structure, the City Council decision shall be final and. conclusive. In the event the City Council approves said. application, they shall cause to be issued a writ- ten permit for the moving of said building, house, or structure described in said. application. The Building Inspection Division of the City of Nation- al City shall issue said permit after prior ap- proval by the City Council. SECTION 9. Ordinance No. 905 of the ord5nances of the City of National City is hereby repealed. SECTION 10. Section 1603 (e) shall be added to the Building Code adopted by this Ordinance to read as follows: SECTION 1603 (e). The moving of any exist- ing building, house, or structure of any type whatsoever from outside the city limits of National City to within the city limits of Nation- al City is hereby prohibited, provided however, that the use of the public streets of National City for the transportation of any existing building, house or structure is not prohibited. SECTION 11. Section 1603 (f) shall be added. to the Building Code adopted. by this ordinance to read. as follows: SECTION 1603 (f). It shall be unlawful for any person, firm, or corporation to occupy any public street for the purpose of moving a build- ing without first having obtained a permit therefor from the Chief Building Inspector. The fee shall be ten dollars ($10.00) for each such permit. Said. moving permit shall be issued only to the Owner of the building to be moved or to a specialty contractor licensed. to engage in such activity by the State of California. Application for said. moving permit shall be made at least twenty-four (24) hours prior to the proposed house moving. The Chief Building Inspector shall designate which street routes shall be used. for the trans- portation of buildings, houses, or structures. A performance bond or a cash deposit in the minimum amount of fifty dollars ($50.00) shall be placed with the office of the City Clerk of the City of National City prior to the issuance of a permit to move a building. SECTION 12. That the entire incorporated area of the City of National City is hereby declared to be and. is hereby established as a Fire District and said fire district shall be divided into two (2) zones, designated as Zone No. One and Zone No. Two. Each such zone shall include such territory or portions of said. City as illustrated, outlined and designated on a certain map on file in the office of the City Clerk of said City, being marked. and/or designated. as "Map of Fire Zones of the City of National City", which is hereby adopted as the fire zoning map of said City, for the application of the regulations included in said Uniform Building Code, 1961 Edition. SECTION 13. Section 3302 (e) shall be added to the Building Code adopted by this ordinance to read as follows: SECTION 3302 (e). Each room used for sleep- ing purposes shall be provided with a window, the sill of which shall be located not more than thirty- six inches (36') above the floor level. The width of such window shall be not less than twenty-four inches (24"). Such window shall provide not less than five sq. ft. of openable area. EXCEPTION. This provision shall not apply to any sleeping room where a door opening directly onto an exterior stairway, yard, court, or public way has been provided. SECTION 14. Section 205 of the Building Code adopted by this ordinance shall be amended. to read as follows: SECTION 205. It shall be unlawful for any person, firm, or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy, or main- tain any building or structure in the city, or cause the same to be done, contrary to or in violation of any of the provisions of this Code as amended. Any person, firm, or corporation violating any of the provisions of this Code shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed, continued, or permitted, and upon con- viction of any such violation such person shall be punishable by a fine of not more than $500, or by imprisonment for not more than 180 days, or by both such fine and imprisonment.
