AN ORDINANCE REPEALING ORDINANCE 920 AND ORDINANCE 1008,
ESTABLISHING LICENSE FEES FOR FOR -HIRE VEHICJ:FS, AND ESTABLISH-
ING PERMIT, LICENSE AND INSURANCE REQUIREMENTS FOR FOR -HIRE
VEHICLES AND DRIVERS THEREOF
The City Council of the City of National City, Calif-
ornia, does Ordain as follows:
SECTION 1: That Ordinance 920 and Ordinance 1008
be and hereby are repealed..
SECTION 2: GENERAL. It shall be unlawful to operate
a for -hire vehicle in the City limits of this City without a
permit to do so.
SECTION 3: DEFINITION. For -hire vehicles shall in-
clude but not be limited to, Ambulance and Taxicabs.
SECTION 4: PERMIT MUST BE POSTED. Any for -hire
vehicle operating in this City shall have the permit required
by this article posted on the driver's side of the rear bumper
of said. vehicle at all times. The permit mentioned in this
section will be in the form of a decal and not transferrable.
SECTION 5: ISSUANCE. All permits required by this
article shall be issued by the City Treasurer; no permit shall
be granted until a written application has been submitted to
and approved by the City Council.
SECTION 6: COUNCIL APPROVAL: INSURANCE. Approval
shall not be given until applicant submits a certificate of
insurance with a carrier approved by the City Council showing
thatapplicant is insured in the sum of at least $100,000.00
for one person injured, in the sum of at least $300,000.00 for
two or more persons injured in any one accident, and in the
sum of $50,000.00 for property damage. In no event shall any
such certificate be acceptable if it is issued by a mutual or
reciprocal company or an inter -insurance exchange.
SECTION 7: ESTABLISH REGULATIONS. The City Council
in its sole discretion may from time to time establish regula-
tions and rules for the issuance of for -hire vehicle permits.
SECTION 8: REVOCATION. The City Council at any
time in its sole discretion shall have the power to revoke or
to suspend any permit authorized by this instrument.
SECTION 9: INSURANCE TERMINATED. In the event the
insurance obtained by an applicant at the time a permit is
issued should lapse or be terminated during the period for
which a permit has been issued, the City Treasurer be and is
hereby authorized to revoke or suspend. such permit immediately
upon the effective date of such lapse or termination without
notice to the applicant. Such permit shall not be reinstated,
and no new permit shall be issued to such applicant, until ap-
propriate insurance coverage has been procured or reinstated.
In the event the certificate of insurance furnished
by applicant when applying for a permit indicates the coverage
is for a term shorter than the period for which the permit is
issued, the applicant shall be notified by the City Treasurer
at the time the permit is issued that the permit is subject to
suspension or revocation unless the assured's coverage is ex-
tended or renewed prior to its lapse or cancellation.
SECTION 10: DRIVERS PERMIT: DRIVING WITHOUT PERMIT.
It is unlawful for any person to drive or operate any of the
vehicles mentioned herein without first obtaining a per-
mit in writing from the Chief of Police.
a. Application for Permit. Fee. Applicants for
such permits shall file application therefor with the Police
Department upon blanks to be furnished by the Police Department.
The applicantshall also file with his application, two recent
photographs (size 2 " x 2"), one to be filed with his application
and. one to be permanently attachedto his Driver's Permit.
Each application shall be accompanied by the sum of two dollars
($2.00) to cover the expenses incurred in the issuance of the
permit, and no refund shall be made for any reason. Said. sum
shall not be considered a tax upon the right to do business in
the City of National City.
b. Permit Must be Posted. All permits issued under
the provisions of this ordinance shall be posted andkept in a
conspicuous part of the vehicle by the permitee during all bus-
iness hours, and shall not be transferrable.
c. Filing of Permit. Said permit shall be filed
with the City Treasurer as part of the application for license.
d. Temporary Permit. A temporary permit only shall
be granted for a period not to exceed sixty (60) days, after
which time saidlicense shall be made permanent, if after in-
vestigation, saidapplicant is found to be a fit and proper
person.
e. Duration of Permit. Annual. Said permit shall
be due andpayable from and after the first day of January of
each year, and shall expire on the last day of December of
each year.
f. Persons Ineligible for Permits. No permit shall
be issuedto any of the following persons:
(1) Any person not a citizen of the United.
States or who has not lawfully declared his intention to become
such; provided, however, that this provision shall not apply to
any person who by regulation, decree, edict or legislature en-
actment shall have been declared by an authorized agency of the
Government of the United States of America to be a "United
States National."
(2) To any person who has made any false state-
ment in his application or who has been convicted of a felony,
or who has been convicted of driving a vehicle on the high-
way under the influence of intoxicating liquor or under the
influence of narcotics or reckless driving, unless two (2)
years have elapsed since his discharge from a penal institu-
tion or after having been placed upon probation during which
period of time his record is good.
g. Forfeiture of License. The Chief of Police may
revoke or refuse to renew an operator's license if the driver
or applicant has, since the granting of his permit:
(1) Been convicted of a felony.
(2) Shall have hadhis state driver's or
chauffeur's license revoked or suspended.
(3) Been convicted of driving while under the
influence of intoxicating liquor.
(4) Been convictedof driving while under the
influence of narcotics.
(5)
During any continuous six (6) month period
he shall have had. three (3) or more convictions of any of the
offenses set .forth in Sections 22350 (basic speed law), 22351
(speed law violations), 23102 (misdemeanor drunk driving),
23103 (reckless driving), and/or 23104 (reckless driving,
bodily injury) of the Vehicle Code of the State of California,
amendments thereto, or any combination of either or any of said
offenses.
(6) When for any reason, including, or other
than the above, in the opinion of the Chief of Police, the ap-
plicant is unfit to drive a vehicle described. in this ordinance.
Any person whose operator's permit shall have been revokedor
renewal refused by the Chief of Police may within ten (10)
days after receipt of notice thereof appeal to the Council for
a hearing thereon; and the decision of the Council in this
regard shall be final. If no appeal is taken within ten (10)
days, the action of the Chief of Police shall be final.
SECTION 11: TAXI METERS. It shall be unlawful for
any owner or driver to operate any taxicabs in this City un-
less such vehicle is equippedwith a taxi meter.
a. Certificate Attached. Said meter must have af-
fixed to it a certificate of accuracy from the Department of
Weights and. Measures of San Diego County.
b. Maintenance. It shall be the duty of every
owner operating a taxicab to keep such taxi meter in perfect
condition so that said taxi meter will at all times correctly
and accurately indicate the correct charge for the distance
traveled andwaiting time.
SECTION 12: RATES OF FARES. Each person engaging
in the taxi cab business in this City shall at all times keep
on file with the City Clerk an up-to-date schedule of rates
charged for the services provided the public and no person
shall demand or charge any rate for such services which do
not conform to the schedule of rates currently on file. There
also shall be displayed in the passenger compartment of each
taxi cab in full view of the passengers, a card not less than
2" x 4" in size, which shall have plainly printed thereon a
correct schedule of the rates to be charged. for conveyance in
said vehicle.
SECTION 13: Section 29 of Ordinance 708, as amended
by Ordinance 920, is hereby amended. to read as follows:
Section 29. Every person conducting, managing or
operating a business in which taxi cabs or for -hire
vehicles are used, shall pay a license fee of $50.00 per
annum for each such taxi cab or for -hire vehicle.
