HomeMy WebLinkAboutCC ORD 1961-992 Garbage disposal; repeals Ords. 762, 769, 836 and 879 (Repealed by 1038)ORDINANCE NO. 992 AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA REGULATING THE DISPOSAL OF GARBAGE AND RUBBISH The City Council of the City of National City, California does ordain as follows: Section I. Definitions: Whenever in this ordinance the following terms are used, they shall be deemed and construed to have the meaning ascribed to such respective terms in this section. A. GARBAGE is defined as all refuse and waste, fruit, vegetable and animal matter, prepared and intended for human consumption, and not so used. B. RUBBISH is refuse and waste material, whether combustible or noncombustible, not included within the definition of garbage as herein defined, including but not limited to paper, rags, leaves, glass, cans, ashes, tree and vine trimmings. It shall not include plaster, rock, sand, dirt, automobile frames or fenders, or waste material pertaining to building operations, construction or repair, water heaters or furniture. C. PERSON is defined to mean and include person, firm or corporation. D. RESIDENTIAL UNIT shall include each building, and space primarily used as a dwelling. E. MULTIPLE RESIDENTIAL UNIT shall include: (1) Each building having two or more spaces primarily used as a separate family dwelling; or (2) Two or more residential units situated on one lot. F. COMMERCIAL UNIT shall include each building and space primarily used for distributing and selling goods, wares and merchandise. G. MANUFACTURING UNIT shall include each building and space primarily used for producing and making goods, wares and merchandise. Section 2. It shall be unlawful for any person: (a) To keep or permit to accumulate any garbage or rubbish on any premises under the control or in the possession of such person; or (b) To haul or convey, or cause to be hauled or conveyed, on or over any of the streets, lanes or alleys within the City of National City, any garbage or rubbish, without first having obtained from the City Manager of the City of National City, a Permit so to do; or (c) To throw or deposit, or cause to be thrown or deposited, any garbage or rubbish on or into any street, lane, alley, public place, or vacant property; or (d) To bury or burn, or cause to be buried or burned, any garbage or rubbish, on property owned by the said person, or in any public street, alley, public place, vacant property, or in or on any premises within the City of National City; or (e) To commingle garbage with paper, cans, glass, razor blades, any poisonous substance, or any rubbish, provided, however, that the City Council by resolution may permit such mingling; (f) Other than the owner or occupant of the premises, or an officer or employee of the City of National City, or the person holding a contract with the City of National City for the collection of garbage or rubbish, or the employee of such contractor, to take or empty any garbage or rubbish container, or to remove any such container from the location where the same was placed by or on behalf of the owner or occupant, or to remove the contents from any such container. Section 3. The City Council of the City of National City may collect and dispose of garbage and rubbish through its own employees, or it may provide such service through an independent contractor. Whether collected directly by the City or by an independent contractor, City of National City shall be entitled to receive compensation from the owner of the premises, and in such amounts as may from time to time be fixed by resolution of the City Council. The failure of any owner of the premises to pay any bill submitted for garbage or rubbish collection shall constitute sufficient cause for the City Treasurer to issue an order that no garbage or rubbish will be collected from said premises until payment has been made. Any contract awarded shall be secured by a faithful performance bond in a sum of not Tess than $25,000.00. Section 4. The terms and conditions by which garbage and rubbish will be removed from residential, multiple residential, commercial and manufacturing units, either directly by City Employees or by an independent contractor, shall from time to time be fixed by the City Council of National City. These terms and conditions may include, but are not limited to, provisions as to the types and sizes of garbage and rubbish containers, and method, hours and place of collection of garbage and rubbish. The City Council within its discretion may establish separate and different terms and conditions for residential units,for multiple residential units, for commercial units, and for manufacturing units. By resolution, the City Council of the City of National City may permit the collection of garbage and rubbish from a single container and by one contractor as a single collection operation. Section 5. Any person violating any of the provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by imprisonment in the city jail for not exceeding 30 days, or by a fine of not exceeding $50.00, or by both such fine and imprisonment. Section 6. Ordinance Numbers 762, 769, 836 and 879 of the City of National City are hereby repealed.
