HomeMy WebLinkAboutCC ORD 1962-1026 Special election (Special)ORDINANCE NO. 1026 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, CALLING, ORDERING AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN SAID CITY ON APRIL 10, 1962 FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION OF INCURRING A BONDED DEBT FOR A MUNICIPAL IMPROVEMENT, AND ORDERING SAID SPECIAL ELECTION TO BE CONSOLIDATED WITH THE GENERAL MUNICIPAL ELECTION TO BE HELD ON SAID DATE, WHEREAS, under and pursuant to Article 1 (commencing at Section 43600), Chapter 4, Division 4, Title 4 of the Government Code, the City Council of the City of National City on February 13, 1962, adopted, by a two-thirds vote of all of its members, Resolution No. $Q 6 % initiating proceedings for the incurring of an indebtedness by said city and the authorization and issuance of bonds therefor, and determining that the public interest and necessity demand the acquisition and construction of the municipal improvement set forth in said resolution and hereinafter described, NOW, THEREFORE, the City Council of the City of National City DOES ORDAIN as follows: Section 1. A special election is hereby called and ordered to be held on Tuesday, April 10, 1962 in the City of National City for the purpose of sub- mitting to the qualified voters of said city a proposition of incurring a bonded debt for the purpose and in the amount set forth in said resolution and hereinafter stated. 1, Section 2. The object and purpose of incurring said indebtedness is: The acquisition and construction by said city of the following municipal improvement, namely: a city hall, including landscaping and off-street parking facilities, and the acquisition of furniture, furnishings, fixtures, equipment and other property necessary therefor. Section 3. The estimated cost of the public improvement herein described is $750,000 and the amount of the principal of the indebtedness proposed to be incurred and of bonds proposed to be issued therefor is $750,000. Said estimated cost includes legal fees, the cost of printing the bonds and other fees, costs and expenses incidental to or connected with the issuance and sale of the bonds. The maximum rate of interest on said proposed indebtedness shall not exceed 6% per annum, payable semiannually, except that interest for the first year after the date of the bonds shall be made payable at the end of said year. The actual interest rate or rates upon all or any part of said proposed bonds shall be fixed prior to or upon their sale. Section 4. In addition to other requirements of law, the printed ballots to be used at said election shall contain substantially the following: 2. Mark crosses (-F) on Ballot ONLY WITH RUBBER STAMP; Never with Pen or Pencil. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OR PENCIL.) INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+) in the voting square after the word "Yes" or after the word "No". All marks, except the cross CO are forbidden. All distinguishing marks, except the cross (±) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another. On absent voter ballots mark a cross CO with pen or pencil. If a voter stamps a cross (-) in the voting square after the printed word "Yes", his vote shall be counted in favor of the adoption of the measure; if he stamps a cross (+) after the printed word "Noll, his vote shall be counted against the adoption of the measure. If two-thirds of the qualified electors voting on said bond proposition assent and vote in favor thereof, said bond proposition shall be deemed adopted and this City Council thereafter will be authorized to 3. and may issue and sell bonds of said city, not to exceed the principal amount stated in said bond proposition, for the object and purpose set forth in said bond proposition. Section 5. The special election herein called and ordered to be held, shall be, and hereby is,ordered to be consolidated with the general municipal election to be held in said city on Tuesday, April 10, 1962. The precincts, polling places and election officers for each precinct board for said special election shall be the same as those provided for said general municipal election. For a description of said precincts, polling places and election officers, reference is hereby made to the proposed notice listing and setting forth the precincts, polling places and election officers for said general municipal election,which said notice is proposed to be published on /41i4Rr k /s—, 1962 in the NATIONAL CITY STAR -NEWS. The hours of opening and closing the polls for said special election shall be the same as those provided for said general municipal election. The special election herein called and said general municipal election shall be held in all respects as if there were only one election, and only one form of ballot shall be used. Section 6. This City Council shall meet at its usual place of meeting on Tuesday, April 17, 1962, at 1:30 P.M. and canvass the election returns and declare the result of said special election. Section 7. Except as otherwise provided in this ordinance, the special election herein called and ordered shall be held and conducted in accordance 4. with the provisions of law governing other municipal elections in said city. Section 8. The City Clerk shall certify to the adoption of this ordinance and cause the same to be published once a week for two weeks in the NATIONAL CITY STAR -NEWS, a newspaper of general circulation published less than six days a week in said city. No other notice of said special election need be given. Section 9. This ordinance shall take effect upon its adoption. ADOPTED, SIGNED AND APPROVED this-, -day February, 1962.
