HomeMy WebLinkAboutCC ORD 1962-1036ORDINANCE NO. 1036 AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA, AMEIOING ORDINANCE NO. 708 OF SAID CITY BY ADDING THERETO SECTION NO. 43.1 The City Council of the City of National City, California does hereby ordain as follows: SECTION 1: Section 43.1 is hereby added to Ordinance No. 708, and shall read as follows: SECTION 43.1. S+rAP MEETS: (a) Every person conducting, managing, carrying on, or operating a swap meet, shall pay a license fee of $500.00 per year. (b) Definitions - "Swap Meet" means the act or practice of carrying on a single location or premises, the exchange, barter, trade, sale or purchase of personal property among or between (25) or more persons, not otherwise licensed to do business in the City of National City. "Operator" means any person conducting or operating the business of a swap meet on a premises in the City of National City, not including any participants therein. (c) It shall be unlawful for any person to exchange, barter, trade, or sell in a swap meet, the following items of personal property: fire arms, ammunition, business machines, bicycles, animals and livestock, and any and all other items of personal property which may be prohibited from being exchanged, bartered, traded or sold by Ordinance or Resolution made by the City Council of National City, or the laws of the State of California, or by any and all laws regulating the health and welfare of the City of National City, the County of San Diego, or the State of California. (d) The operator of any swap meet shall take reasonable steps to notify all participants of the regulations and prohibitions contained in this Section 43.1, including but not limited to the posting of notices in conspicuous places on the premises where such swap meet is conducted. (e) The owner or operator of each swap meet shall be responsible for compliance with the provisions of this Section 43.1 on the part of each participant therein, and shall be responsible for compliance with the provisions of this Section 43.1 Axtdmike as to all items or articles of property sold, traded, exchanged or bartered in connection with the operation of such business. Viola- tion of any provision of this Section 43.1 by any person, firm or corporation under this Ordinance, shall be proper ground for suspension or revocation, after hearing before the City Council, of any or all business licenses issued by the City of National City to such person, firm or corporation, or to the owner or operator of said swap meet. (f) Any person, firm or corporation who shall violate any pro— vision of this Section 43.1 shall be deemed guilty of a misdemeanor and shall be punishable by fine of not more than $500.00 or by imprisonment in the County Jail for a period of not to exceed six months, or by both such fine and imprison— ment. Such fine shall be in addition to, and not in lieu of or dependent on any suspension or revocation of business licenses as mentioned in Section 43.1, sub— section (e). (g) The City Treasurer shall not issue a license to any swap meet operator until the application for such license has been referred to the Chief of Police of the City of National City for investigation and a favorable report on such investigation has been received from the Chief of Police.
