HomeMy WebLinkAboutCC ORD 1962-1050 Amends §§ 4, 8 and 9 of, and adds § 4.17 to Ord. 962, zoning (Repealed by 1503)ORDINANCE NO. 1050 AN ORDINANCE AMENDING ORDINANCE NO. 962, ZONING ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA WHEREAS, pursuant to the terms and provisions of the Government Code of California, proceedings were duly initiated for the establishment of zoning of those certain parcels of land hereinafter described, and WHEREAS, pursuant to due and legal notice, hearings were held by the City Planning Commission of said City and also by the City Council of said City, and all persons interested were given an opportunity to appear and be heard be- fore said Planning Commission and said City Council, and WHEREAS, the City Planning Commission of National City has regularly and duly certified to the City Council its report and has recommended such zoning. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, does ordain as follows: SECTION 1. All protests, if any, against said zoning, and each of them be and hereby are denied and overruled. SECTION 2. There is hereby added to Paragraph A of Section 4 of Ordi- nance No. 962 a new Sub -Section No. 4-A which shall read as follows: 4-A. C-2-A, Special Limited Commercial Zone. SECTION 3. There is hereby added to Section 8 of Ordinance No. 962 a new paragraph K which shall read as follows: K. In the C-2A, Special Limited Commercial Zone, the following uses are permitted: 1. Beauty Shops - Barber Shops. 2. Day Nurseries and Licensed Homes for Foster Children, providing there is a play area of not less than 600 square feet on the lot. 3. Rest Homes and Convalescent Homes, provided that patients are not treated for major mental sickness or disease as defined in this Ordinance. 4. Private Non -Profit Clubs and Lodges, excluding Institutions of a Phylanthropic or Eleemosnary Nature. 5. Privately or publically operated golf facilities. 6. Stores engaged in the retail sale of pet supplies, not including the selling and raising of live animals. 7. Stores engaged in retail sales and rental of garden equipment. 8. Do -It -Yourself Tool and Equipment, Sales and Rental, provided no equipment is stocked or maintained to exceed the size of a one-half sack cement mixer. 9. Hardware Stores, including retail sale of building materials, gravel, sand and top soil, but excluding general lumber yards and brick yards, subject to the following limitations: a. Sand, gravel and top soil shall be stored in bins not to exceed ten yards each in total item capacity. b. No more than 2,000 board feet of pre-cut lumber shall be stored or located on a business premise at any one time. 10. Public and private parks. 11. Stores engaged in the retail sale of nursery items and Green Houses, provided all sacked manure and fertilizers are stored within an approved, type 1 hour constructed building, and further provided that no loose manure or fertilizer shall be permitted. 12. Farming, limited to horticulture and crop raising. 13. Feed Stores. 14. Trailer and Mobile Home Parks, provided that no park is constructed on any parcel of land less than five acres in area, and further provided that a permit therefore is issued by the City Planning Commission and the plans for said trailer or mobile home park are approved by said City Planning Commission. 15. Hotels, motels, multiple dwellings, group dwellings, public recreation facilities, and private clubs which are operated for recreational purposes; such accessory uses and services as are customarily incidental to the principal use; and such accessory businesses as are customarily designed and intended for the conven- ience or necessity of the guests of the permitted use, including bars, cafes, res- taurants, lunch rooms, gift shops, florists, news and tobacco shops, travel, ticket and car rental agencies, valet service (agency for laundering, cleaning, and pressing of clothing), letting of space for professional offices, operated in con- junction with the said uses permitted in this sub -section and not as a separate enterprise, and located on the same premises, provided there shall be no entrance to such place or accessory or incidental uses, except from the lobby or the int- erior of a principal building or buildings or patio thereof. SECTION 4. There is hereby added to Paragraph A of Section 9 of 0rdi- nance No. 962 new sub -sections Nos 6 and 7 which shall read as follows: 6. A front yard of 10 feet in the C-2-A Zone. 7. An exterior side yard of 10 feet in the C-2-A Zone. SECTION 5. There is hereby added to Section 9 of Ordinance No. 962 a new Paragraph No. D which shall read as follows: D. All permitted uses in the C-2-A Zone, excluding off street parking, areas, golf courses, farming, parks, nurseries and areas for building materials shall be located and conducted entirely within buildings. SECTION 6. Section 4:17 is hereby added to Ordinance No. 962 and shall read as follows: SECTION 4:17 . That notwithstanding anything to the contrary in Section 4 of this Ordinance there is hereby established and adopted: (A) An R-2, Two Family Residence Zone, on all that portion of Lots 3, 4, 20 and 21, Lincoln Acres, Nap No. 1740, as recorded in San Diego County Recorder's Office lying within the Sweetwater Annexation No. 4 as described in Ordinance No. 1019 of the City of National City, which said description is made a part hereof as though set forth at length. (B) A C-2-A, Special Limited Commercial Zone, on the balance of the property located within the Sweetwater Annexation No. 4 which is more particularly described in Ordinance No. 1019 of the City of National City, which said descrip- tion is made a part hereof as though set forth at length. (C) A C-2-A, Special Limited Commercial Zone, for all that certain real property known as the Cypress Annexation which is more particularly described in Ordinance No. 1030 of the City of National City which said description is made a part hereof as though set forth at length. (D) A C-2, Limited Commercial Zone, on all that portion of Lots 1, 2, 3, 4, 5, and the northerly 16 feet of Lot 16, and all of Lots 17, 18, 19, and 20, Block 2, Frank P. Reed's Subdivision, Quarter Section 133, according to Nap No. 90, filed in the Office of the County Recorder of San Diego County.
