AN ORDINANCE AMENDING ORDINANCE NO. 1124 OF THE CITY OF
NATIONAL CITY, CALIFORNIA, AND MAKING CERTAIN MODIFIC-
ATIONS TO THE UNIFORM HOUSING CODE, 1964 EDITION.
The City Council of the City of National City, Calif-
ornia, does Ordain as follows:
Section 1. That Section H-203 of the code adopted
by Ordinance No. 1124 is hereby amended to read as follows:
H-203. HOUSING ADVISORY AND APPEALS BOARD. In order to
provide for reasonable interpretation of the provisions of this
Code, there is hereby added two members to the Board of Appeals
as set forth in the Uniform Building Code, 1961 Edition, Section
204. The two additional members shall be qualified by training
and experience to pass upon matters pertaining to housing.
The Director of Building and Housing shall be an ex-officio
member and shall act as secretary of the Board. The Housing
Advisory and Appeals Board shall be appointed by the Mayor and
shall hold office at his pleasure. The Board shall adopt reason-
able rules and regulations for conducting its investigations
and shall render all decisions and findings to the Director of
Building and Housing with a duplicate copy to the appellant and
may recommend to the City Council such new legislation as is
consistent therewith.
Section 2. That Section 2 of Ordinance No. 1124 is
hereby deleted in its entirity.
Section 3. Section H-304 of the Code adopted by Ordin-
ance No. 1124 is hereby added and shall read as follows:
H-304. Housing Permit. (a) It shall be unlawful for any
person, firm, partnership, or corporation, either for himself
or itself, or for any other person, firm, partnership, or corp-
oration to own or operate an apartment house or hotel without
first obtaining a Housing Permit therefor.
(b) The annual Housing Permit provided in this Ordinance
shall be due and payable to the City of National City on the
first day of January of each year, in advance.
(c) If any person, firm, partnership, or corporation
commences the operation of an apartment house or hotel during
the calendar year, his Housing Permit shall be prorated on a
quarterly basis for the calendar year.
(d) A permit to operate and maintain an apartment house
or hotel is not transferable.
Section 4. That Section H-305 of the Code adopted
by Ordinance No. 1124 is hereby added and shall read as follows:
H-305. Housing Permit Fees. The fee for a Housing Permit
required by Section H-304 of this Ordinance shall be as follows:
(a) For each apartment house or hotel containing not more
than six (6) units: Six Dollars ($6.00).
(b) For each apartment house or hotel containing not less
than seven (7) but no more than ten (10) units: Nine Dollars
($9.00).
(c) For each apartment house or hotel containing not less
than eleven (11) but no more than fifteen (15) units: Ten Dollars
($10.00).
(d) For each apartment house or hotel containing more than
fifteen (15) units: Ten Dollars ($10.00) plus Twenty -Five Cents
($.25) for each unit in excess of fifteen (15).
(e) For the purpose of this Section, a "unit" shall mean
each apartment in an apartment house, each sleeping zoom in
each hotel, and each apartment and each hotel sleeping room in
a building containing both apartments and hotel sleeping rooms.
Separate apartment house buildings and separate hotel
buildings, or combination thereof, located upon a single parcel
•
of land or contiguous parcels of land, under the same owner-
ship shall be treated as one apartment house or hotel for the
purpose of computing the fee prescribed by this Section.
Section 5. That Section H-306 of the code adopted
by Ordinance No. 1124 is hereby added and shall read as follows:
H-306. Disposition of Monies Collected. All monies
received under the provisions of this Ordinance shall be paid
to the City Treasurer and credited to the General Fund.
Section 6. That Section H-307 of the Code adopted
by Ordinance No. 1124 is hereby added and shall read as follows:
H-307. Suspension and Revocation of Housing Permit. When-
ever it is found that any apartment house or hotel is not being
conducted in conformity with the provisions of this ordinance or
the Uniform Housing Code, 1964 Edition, the Housing Permit to
operate same shall be subject to suspension or revocation by
the Department of Building and Housing.
