AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA,
AMENDING ORDINANCE 1036 OF SAID CITY RELATING TO CONDUCT OF
SWAP MEETS
The City Council of the City of National City,
California, does hereby ordain as follows:
Section 1. Section 43.1(a) of Ordinance 1036 is
hereby repealed.
Section 2. Section 43.1(d) of Ordinance 1036 is
hereby amended to read as follows:
Section 43.1(d). The operator shall take the fol-
lowing steps to notify participants in the swap meet of
the prohibitions against selling certain property:
(1) The operator shall install and maintain a public
address system of sufficient volume to be heard in
all parts of the licensed premises during the con-
duct of the licensed business.
(2) The operator shall install and maintain signs in
the English and Spanish language announcing the
prohibitions of this ordinance. There shall be
installed one sign for every 25 vending sites
within the premises. A sign shall be of a minimum
dimension of 3 feet by 4 feet. In addition to other
required signs there shall be installed a required
sign at each entrance to the licensed premises.
Each sign shall state that the sale of forbidden
property is a crime.
(3) The operator shall give to each vendor entering his
premises written notice of the restrictions of this
ordinance.
(4) The operator shall make oral announcements in the
English and Spanish language of the restrictions of
this ordinance through the use of the required
public address system. Announcements shall be
made at least once every 60 minutes during the
operation of a swap meet as defined herein.
(5) The operator or his agent shall maintain a constant
foot patrol of the licensed premises to observe
violations of this ordinance. The foot patrol shall
be of sufficient frequency that each vending site is
passed and observed by the patrolman at least once
every 60 minutes during the operation of a swap
meet as defined herein.
(6) Upon observing a violation of this ordinance the
operator, or his agent, shall communicate with the
National City Police Department and report the vio-
lation.
Section 3. Section 43.1(e) of Ordinance 1036 is
hereby deleted. A new section is hereby added to read as fol-
lows:
Section 43.1(e). Violation of this ordinance by a
licensee shall be grounds for revocation of the license
to conduct a swap meet. Revocation of a license for
violation of this ordinance shall be accomplished in the
manner established by Article 218, Sections 2187 through
2191 of the National City Municipal Code.
