AN ORDINANCE AMENDING ORDINANCE 1163 PROVIDING A
PROCEDURE DETERMINING WHETHER OR NOT THE PUBLIC
OONVENIENCE AND NECESSITY REQUIRE THE ISSUANCE OF
TAXICAB PERMITS
BE IT ORDAINED by the City Council of the City of
National City that Ordinance 1163 be amended by adding Section
3 thereto as follows:
Section 3. No certificate shall be granted until
the City Council shall after hearing declare by resolution
that the public convenience and necessity require the proposed
taxicab service. In determing whether or not the public con-
venience and necessity require the operation of a taxicab or
taxicabs for which application is made, the Council shall
hold such public hearings as may be necessary to determine
that fact.
At the time of public hearings ordered by the City
Council pursuant to this ordinance, the City Manager shall
present such staff reports as the Council may direct.
In ordering public hearings the Council shall
cause at least 10 days notice of the hearings to be given to
applicants. Hearings pursuant to this ordinance may be con-
tinued from time to time.
Applicants for certificates under this ordinance
shall have the burden of producing clear and convincing evidence
of the public convenience and necessity. The Council's decision
in granting or denying a certificate shall be final and con-
clusive.
