HomeMy WebLinkAboutCC ORD 1967-1167 Special election (Special)ORDINANCE NO. 1167 AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN SAID CITY ON AUGUST 1, 1967, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY THE PROPOSITION OF THE ADOPTION OF A CITY ORDINANCE DECLARING A NEED FOR A REDEVELOPMENT AGENCY TO FUNCTION IN THE CITY OF NATIONAL CITY AND DECLARING THE LEGISLATIVE BODY OF THE COMMUNITY TO BE THE AGENCY. WHEREAS, at its regular meeting of April 11, 1967 the City Council of National City adopted an ordinance en- titled "AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA, DECLARING A NEED FOR A REDEVELOPMENT AGENCY TO FUNCTION IN THE CITY OF NATIONAL CITY AND DECLARING THE LEGISLATIVE BODY OF THE COMMUNITY TO BE THE AGENCY", and WHEREAS, within30 days of the date of adopting the said ordinance a petition signed by not less than 10 percent of the voters of the City of National City on the date the petition was filed with the City Clerk protesting against the adoption of the ordinance was filed with the clerk of the legislative body, and WHEREAS, the legislative body has elected not to repeal the ordinance but to submit the ordinance to the voters at a Special Election; NOW, THEREFORE, the City Council of the City of National City, California DOES ORDAIN as follows: Section 1. That a special election be held and the same is hereby called to be held in said city on August 1, 1967, for the purpose of submitting to the qualified voters of said city the proposition of the adoption of an ordinance activating the Redevelopment Agency of said city as stated in the ballot proposition hereinafter set forth. Section 2. That the polls for said election shall be opened at seven o'clock A.M. of the day of said election and shall remain open continuously from said time until eight o'clock P.M. of the same day, when said polls shall be closed, except as provided in Section 14436 of the Elections Code of the State of California. Section 3. That on the ballots to be used at said special election, in addition to any other matters re- quired by law, there shall be printed substantially the following: MARK CROSSES (+) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OR PENCIL.) INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+) in the voting square after the word "YES" or after the word "NO." All marks except the cross (+) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of elec- tion and obtain another. On absent voter ballots mark a cross (+) with pen or pencil. That a cross (+) placed in the voting square after the word "YES" in the manner hereinbefore pro- vided shall be counted in favor of the adoption of a proposition. A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of a proposition. Section 5. That if the proposition for the adoption of the city ordinance so submitted receives the requisite number of votes, to wit, a majority of the votes of the qualified electors voting on such proposition, the ordinance shall become immediately effective. Section 6. That except as otherwise provided in this ordinance, the election called hereby shall be conducted as provided by law for other municipal elections in said city. Section 7. That the City Clerk shall cause this ordinance to be published once a week for two successive weeks in the NATIONAL CITY STAR NEWS, a newspaper of gen- eral circulation printed and published in said city. No other notice of such election need be given. Section 8. This ordinance shall take effect upon its passage. ADOPTED, SIGNED AND APPROVED this --2-arer day of 1967.
