ORDINANCE NO. 1182
AN ORDINANCE OF THE CITY
OF NATIONAL CITY, CALIFOR-
NIA, PROVIDING FOR THE IN-
TERIM ZONING ESTABLISHING
THE CRITERIA FOR STORAGE
AND/OR IMPOUNDING OF
WRECKED AUTOMOBILES
WHEREAS, the Department of
Planning of the City of National
City in good faith is conduct-
ing studies for the purpose of
holding a hearing by the Plan-
ning Commission of the City of
National City wherein and
whereby requirements for stor-
age and/or impounding of
wrecked automobiles will be es-
tablished; and
WHEREAS, Section 65853 of
the Government Code of the
State of California authorizes
this City Council to protect the
public safety, health and wel-
fare, to adopt a temporary inter-
im ordinance as urgency meas-
ure to remove from the streets
and highways of the City of Na-
tional City and to store vehicles
because they are illegally park-
ed, abandoned, involved within
an accident or obstructing traf-
fic because of mechanical fail-
ure.
NOW. THEREFORE, THE
CITY: COUNCIL OF THE CITY
OF NATIONAL CITY, CALIFOR-
NIA, DOES ORDAIN AS FOL-
LOWS:
SECTION I. The City Council
of the City of National City does
hereby adopt this temporary in-
terim zoning ordinance pursu-
ant to the provisions of Section
6585S of the Government Code
of the State of California.
SECTION II. The following
regulations shall apply to the
storage of disabled, dismantled
or wrecked motor vehicles with-
in the City of National City.
A. Any legally authorized
garage, body shop, new or used
auto dealer may store, for a
period not to exceed thirty (20)
days, within a building, out of
sight of public view, disabled,
dismantled or wrecked motor
vehicles provided said motor
vehicle is located at said estab-
lishment for repair.
11. Upon the recommenda-
tion of the Planning Commission,
the City Council, without a pub-
lic hearing, may by Resolution
grant a special use permit to any
duly licensed automobile storage
yard, with an automobile towing
service duly licensed to operate
within the City of National City,
and who is a successful bidder
of a contract with the City of
National City to participate in
the assignment of service calls
on police -impounded automobiles,
to store in conjunction with an
accepted towing contract with
the City, motor vehicles which
have been removed from the
streets and highways of the City
of National City and impounded
by the Police Department be-
cause they are illegally parked,
abandoned, involved within an
accident, or obstructing traffic
because of mechanical failure.
Provided further, that no
permit shall be granted to prem-
ises located east of National
Avenue.
1. Said storage shall be
within a building or an enclosed
storage area approved by the
Planning Commission.
a. The Planning Commis-
sion in approving the storage
of said motor vehicle location
shall take under consideration
the compatibility to adjacent
land use with restrictions neces-
sary to protect the abutting
property.
2. An approved storage
area shall:
a. Contain a gross area
of not less than 10,000 square
feet and not more than 15.000
square feet in which said wreck-
ed vehicle may be located.
b. Be surfaced with as-
phalt, cement or decomposed
granite with oil, including all
driveways and access roads.
c. Have installed and
maintained approved drainage
facilities to prevent standing or
accumulation of water.
3. Stripping of automobiles,
removal of parts and disman-
tling, salvaging or junking shall
be prohibited, provided however,
that required articles to be re-
moved by authorized scrapping
operation may be permitted to
be accumulated for thirty (30)
days behind said fence out of
view of adjacent properties and
adjacent streets.
4. All gasoline, oil or oth-
er inflammable liquid and all
gas shall be drained and re-
moved from any unregistered or
wrecked vehicle.
5. Material located in or
on the premises shall be so ar-
ranged that reasonable inspec-
tion or access to all parts of the
premises can be had at any time
by the proper fire, health, po-
lice, planning and building au-
thorities.
6. Trash containers shall
be installed and maintained
throughout the area and said
storage area shall be maintained
free of trash at all times.
7. Said vehicles shall be
disposed of in an expeditious
manner and no vehicle shall be
retained in storage in excess of
three (3) months from the date
of impoundment. Upon recom-
mendation of the Chief of Po-
lice of the City of National City
or Order of a Court of Compe-
tent Jurisdiction, the City Coun-
cil may grant an extended per-
iod of time for the storage of
vehicles.
8. Said storage shall be
carried on, maintained or con-
ducted entirely inside an en-
closed building or buildings, or
on property entirely enclosed
by a solid fence or wall at least
eight (8) feet in height.
a. Said fence shall be
constructed in accordance with
all the requirements established
by the Zoning Ordinance No. 962
as amended by the City of Na-
tional City.
b. No sign, picture,
transparency, advertisement or
mechanical device which is used
for the purpose of, or which
does advertise or bring to notice
any person or persons, or article
or articles of merchandise, or
any business or profession, or
anything that is to be or has
been sold, bartered or given
away, shall be placed or be main-
tained, or caused to be main-
tained, upon the outward face
of such fence or wall; except
that a business carried on,
maintained, or conducted within
such fenced or walled enclosure
and in accordance with applic-
able zoning regulations may be
advertised by use of a space
not exceeding six (6) feet in
height and fifteen (15) feet in
length in each side of such en-
closure.
c. Gates for access shall
be constructed of new material,
eight (8) feet in height, mini-
mum; no gate shall swing out-
ward and shall be kept closed
except when vehicles or pedes-
trians are exiting or entering
the premises. As an alternative
to closing the gate, an interior,
screening fence may be erected
so as to prevent public view of
the contents of the storage yard
when the gate is open.
d. No article shall be
piled, or permitted to be piled,
in excess of the height of the
enclosing fence or wall or nearer
than two feet thereto.
9. No storage area shall
be permitted to be located ad-
jacent to a freeway unless the
storage area of all wrecked ve-
hicles can be screened from view
from said freeway.
10. All storage areas shall
maintain a four -foot setback
from all property abutting up-
on a dedicated street. Said set-
back along with the parkway
in front of and on the exterior
side of subject property shall
be landscaped with trees, shrubs
or other approved ground cover.
11. Any lighting of said
storage area shall be so installed
and maintained as to be directed
away from abutting property
and streets.
12. Any special use permit
granted under the provisions of
this ordinance shall expire upon
the termination of the contract,
or with the cancellation of said
contract, with the City of Na-
tional City.
13. In the event the Plan-
ning Commission determines
that any of the conditions set
forth in this ordinance, or within
the resolution approving a stor-
age area, it shall be deemed
prima facie evidence of a zon-
ing violation and said special
use permit shall ipso facto term-
inate.
SECTION III. This Interim
Ordinance is hereby declared to
be an emergency measure neces-
sary for the immediate preserva-
tion of the public peace, health
and safety and due to the fact
the City Police Department has
problems of removing from the
streets and highways of the
City of National City and to
store vehicles because they are
illegally parked, abandoned, in-
volved within an accident or ob-
structing traffic because of me-
chanical failure, under present
zoning laws which have no
means to provide for their re-
moval and storage; therefore,
this ordinance shall be adopted
on an emergency basis pending
the public hearings as required
by law.

National City, California, this
12th day of December, 1967, by
the following vote, to -wit:
