HomeMy WebLinkAboutCC ORD 1968-1193 Building moving; repeals §§ 8, 9, 10 and 11 of Ord. 1108 (15.12)• h / 9 1193 ORDINANCE NO. 1193 AN ORDINANCE ESTABLISH- ING PROCEDURE FOR THE MOVING OF BUILDINGS AND FIXING FEES FOR SECURING PERMITS TO MOVE BUILD- INGS, AND AMENDING ORDI- NANCE NO. 110S The City Council of the City of National City does ordain as follows: SECTION 1, Sections 8, 9, 10 and 11 of Ordinance No. 1108 are hereby repealed. SECTION 2. GENERAL. Be- fore any existing building, house or structure may be moved from one location within the city limits of the City of Na- tional City to another location within the city limits of the City of National City, a permit for such moving shall be ob- tained from the Department of Building and Housing of the City of National City. SECTION 3. APPLICATION FOR PERMIT. a. Fee. A fee of $25.00 shall accompany each application to move a structure from its pres- ent location on a lot to a new location on the same building lot. A fee of $100.00 shall ac- company each application to move a building, house or struc- ture from one building lot to an- other building lot within the city limits of the City of Na- tional City. b. Inspection. Upon receipt of an application under this ordi- nance the Department of Build- ing and Housing shall inspect the building, house or structure to be moved and make a report of the results of the inspection to the City Council. The Depart- ment of Building and Housing may require an applicant to pro- vide a written certification by a qualified contractor that the building, house or structure to be moved is free from fungus, termites, or similar infestations. c. The Director of Building and Housing will forward the application for a permit under this section together with his report to the City Council. d. A permit allowing the mov- ing of a building, house, or structure from one place within the limits of the City of Na- tional City to another place therein will be issued only on order of the City Council. The City Council can order the is- suance of a permit under this ordinance as hereinafter pro- vided. SECTION 4. COMPLIANCE WITH LAWS. Each building, house, or structure moved with- in the City of National City shall conform to the zoning reg- ulations of the district to which it is moved; and shall conform or shall be made to conform to the building codes and all other laws and ordinances applicable to new buildings, houses or structures. SECTION 5. GRANTING OF PERMITS BY CITY COUNCIL. a. A permit to move a build- ing, house or structure within the city limits shall be granted only if the City Council finds that the movement of the build- ing, house or structure will not have an adverse effect upon property values in the district to which the building will be moved. The Council shall fur- ther find that the moving of the building in question will not have an adverse effect on the health, safety, welfare or mor- als of the community and neigh- borhood to which the building, house or structure will be moved. The Council shall fur- ther find that the moving of the building, house, or structure in question will not have an adverse effect on the zoning regulations and plans of the City of National City. Prior to granting a permit to move a building, house or structure under this ordinance the City Council shall deter- mine that the proposed move will comply with applicable zoning laws; and that the build- ing to be moved will comply with all building codes, laws and regulations ,in force. The Council shall further find that the proposed movement of build- ings will not contribute to blight or deterioration in the neighborhood to which the building, house or structure will be moved. b. The City Council, in grant- ing a permit under this ordi- nance, may impose such addi- tional conditions, rules, and reg- ulations as are reasonably nec- essary to protect the health, safety, welfare and morals of the city and in particular the neighborhood to which a build- ing will be moved. c. To insure compliance with conditions, rules, regulations and laws relating to the move- ment of a building, house or structure under this ordinance the City Council may require the applicant to post a perform- ance bond, adequate in amount, to guarantee his faithful per- formance of all laws, rules, regulations and conditions. d. As a condition to the grant- ing of a permit under this ordi- nance the City Council may re- quire the applicant to execute a covenant running with the land which will bind the land and its successive owners to the performance of conditions imposed by the City Council in granting a permit under this ordinance. e. As a condition to granting a permit under this ordinance the City Council may require the applicant to install public and private improvements on the building site to be occu- pied by the moved building which in the judgment of the Council are reasonably required to preserve the health, safety, and welfare of the community and the neighborhood to which the building will be moved. f. As a condition to the grant- ing of a permit under this ordi- nance the City Council may re- quire the applicant to make such aesthetic improvements and re- habilitations on the moved build- ing as are necessary to preserve land values and property values in the neighborhood to which the building will be moved. SECTION 6. MOVING OF BUILDINGS INTO CITY OF NA- TIONAL CITY PROHIBITED. The moving of any building, house or structure from outside the city limits of the City of National City to a location in- side the city limits of the City of National City is absolutely prohibited. The use of public streets of the City of National City for the transportation of an existing building, house or structure is allowed as here- inafter provided. SECTION 7. PERMIT FOR MOVING A STRUCTURE THROUGH CITY. a. It is unlawful for any per- son, firm or corporation to move a building through, across or on public streets of the City of National City without first ob- taining a moving permit from the director of Building and Housing. b. The fee for permit to move the house through the City of National City is $10.00. c. An applicant for a moving permit must be a person li- censed as a specialty contractor to engage in the business of house moving in the State of California. d. Applications for house mov- ing permits must be made to the Director of Building and Housing at least 24 hours prior to the proposed time for the movement. e. The permit allowing the moving of a house across city streets within the City of Na- tional City shall have endorse thereon an approved route f the particular house moving i question. No other route shall be used. Violation of this sub- section is a separate crime for which the penalties described in Section 8 of this ordinance will apply. f. At the time of making an application for a house moving permit pursuant to this ordi- nance the applicant shall de- posit with the City Clerk of the City of National City a perfor- mance bond in the amount of $50.00 to insure faithful per- formance of all provisions of this and every other city law. g. At the time of making ap- lication for a house moving per- mit pursuant to this ordinance the applicant shall attach to his application a certificate of in- surance showing liability insur- ance in the amount of $100,000.00 for a single accident and $300,- 000.00 for two or more accidents together with liability insurance in the amount of $50,000.00 for property damage which insur- ance will be in force during the period of time during which the building in question will be moved through the City of Na- tional City. The certificate of insurance must show that the City of National City is an ad- ditional insured under the pol- icy of insurance in question. The certificate of insurance must further show that the City of National City will be entitled to at least 10 days written no- tice prior to concellation of the policy of insurance represented by the certificate of insurance. SECTION 8. VIOLATION OF THIS ORDINANCE A CRIME. Any person, firm, or corporation violating any of the provisions of this ordinance shall be deem- ed guilty of a misdemeanor. Each and every day or portion thereof during which any vio- lation of any provision of this ordinance is committed, contin- ued, or permitted is a separate violation. The penalty for the violation of this ordinance shall be a fine of not more than $500.00 and/or imprisonment for not more than 180 days, or by both such fine and imprison- ment.
