HomeMy WebLinkAboutCC ORD 1968-1196 Amends § 9 of Ord. 962, zoning (Repealed by 1503)ocd 1196 ORDINANCE NO. 1196 AN ORDINANCE AMENDING ORDINANCE NO. 962 OF THE CITY OF NATIONAL CITY, CALIFORNIA, PROVIDING FOR THE STORAGE AND/OR IM- POUNDING OF DISABLED, DIS- MANTLED OR WRECKED MOTOR VEHICLES The City Council of the City of National City, California, does ordain as follows: SECTION 1. The following regulations shall apply to the storage of disabled, dismantled or wrecked motor vehicles in the City of National City. A. Any authorized new or used automobile dealer may store, for a period of not more than sixty (60) days, disabled, dismantled or wrecked motor vehicles provided said motor vehicle is located at said estab- lishment for repair and/or pend- ing determination of repair or total loss. Storage authorized by this section shall be in an area incorporated as a part of the service area for which a dealer has a business license; and which storage area is shown upon the plans approved by the Planning Commission as re - or lred sa esfor lots.auTheobile storageorae area must be enclosed as required by the Zoning Ordinance of the City of National City for the en- closure of outdoor storage in the Manufacturing and Indus- trial Zones. The Stripping of automobiles, removal of parts and/or dis- mantling thereof, salvaging and/ or junking shall be prohibited. B. Any authorized garage and/or body shop may store, for a period riot to exceed sixty (60) days, a disabled, dismantled or wrecked motor vehicle provided said motor vehicle is located at said establishment for repair and/or pending determination of repair or total loss. Said motor vehicle shall be stored in an area which is a part of the normal area for which said es- tablishment has a business li- cense. Said storage area shall contain not more than two thousand (2,000) square feet de- voted to the storage of wrecked vehicles pending said determin- ation; provided, however, that any area may be enlarged by the Planning Commission upon a showing by the operator that the size of the repair service and number of employees within the business justifies a larger stor- age area. Any person ag- grieved by the decision of the Planning Commission in grant- ing or denying said enlargement, may within ten (10) days from date of said ruling of the Plan- ning Commission, file with the City Clerk an appeal in writing to the City Council from said ruling or decision. The City Council shall thereupon, at their next regular meeting decide said appeal. Stripping of automobiles, re- moval of parts and dismantling, salvaging or junking shall be prohibited. C. Upon the recommendation of the Planning Commission, the City Council, without a public hearing, may by resolution grant a Special Use Permit to store wrecked motor vehicles. The permittee must be a successful bidder of a contract with the City of National City to partici- pate in the assignment of ser- vice calls on police impounded automobiles. Provided further, that no permit shall be grant- ed to premises located East of National Avenue. D. In recommending the is- suance of a Special Use Permit the Planning Commission shall consider whether or not the per- mitted storage will affect ad- versely the value of adjacent lands the Planning Commission shall impose such additional re- strictions as are necessary to protect the value of adjacent land. E. To qualify for a Special Use Permit the proposed storage area shall meet the following criteria: (1) The storage area shall be in a building or enclosed by a solid fence or wall at least eight (8) feet in height. The construction and maintenance of the required fence shall meet all the requirements established by the Zoning Ordinance, as amended, of the City of National City. No sign, picture, trans- parency, advertisement or me- chanical device which is used for the purpose of, or which does advertise or bring to no- tice any person or persons, or article or articles of merchan- dise, or any business or profes- sion, or anything that is to be o.r has been sold, bartered or given away, shall be placed or maintained or caused to be maintained, upon the outward face of such fence or wall; ex- cept that a business carried on, maintained or conducted within such fenced or walled enclos- ure and in accordance with ap- plicable zoning regulations may be advertised by use of a space not exceeding six (6) feet in height and fifteen (15) feet in length in each side of such en- closure. (2) The storage area must contain a gross surface of not less than 10,000 square feet nor more than 15,000 square feet de- voted to the storage of wrecked vehicles. (3) The storage area, includ- ing driveways and access roads, shall be surfaced with asphalt, cement, or decomposed granite with oil. (4) The storage area shall be served by drainage facilities adequate to prevent the accum- ulation of standing water. The City Engineer shall determine the adequacy of proposed drain- age facilities. (5) Gates in the fence or wall surrounding the storage area shall be constructed of new material, the same height as the fence or wall. No gate shall swing outward. All gates shall be kept closed except when ve- hicles or pedestrians are exiting or entering the premises. As an alternative to closing all gates, an interior, screening fence may be erected so as to prevent pub- lic view of the contents of the storage yard, during times when the gates are open. (6) A four (4) foot setback from dedicated streets is re- quired. The setback area, and the parkway area, shall be land- scaped with trees, shrubs or oth- er ground cover, suitable to the soil's condition of the area as determined by the City Forester. (7) All exterior lighting shall be directed away from ad- jacent property and streets. (8) A Conditional Use Per- mit shall not be granted for an area visible from a freeway un- less all wrecked vehicles can be stored out of sight of adja- cent freeways. F. The Conditional Use Per- mit shall require for its issuance and continued validity that per- mitted storage operations be conducted pursuant to the fol- lowing rules: (1) Stripping of automo- biles, removal of parts and dis- mantling, salvaging or junking shall be prohibited; provided however, that the permittee may remove articles required to be removed to permit scrapping of the vehicles. Removed parts may be accumulated for thirty (30) days on the licensed prem- ises. (2) All inflammable liquids shall be removed from any un- registered or wrecked vehicle. (3) Stored material and ve- hicles shall be so arranged that reasonable inspection of all parts of the premises can be had at any time by fire, health, police, planning and building authorities. (4) Trash containers shall be installed and maintained on the premises, and the premis shall be kept free of trash all times. (5) Wrecked vehicles shall be disposed of in an expeditious manner and no vehicle shall be retained in storage in excess of three (3) months from the date of impoundment. Upon recom- mendation of the Chief of Police of the City of National City, or Order of a Court of competent jurisdiction, the City Council may extend the storage time. (6) No article shall be piled higher than the enclosing fence or wall; or nearer than two (2) feet to the enclosing fence or wall. SECTION II. A Special Use Permit granted under the pro- visions of this ordinance will expire upon the termination or cancellation of a Permittee's po- lice towing contract with the City of National City. SECTION III. Violation of any requirement of this ordi- nance is Bounds for termination of a Special Use Permit granted under the provisions of this or- dinance. SECTION IV. A Special Use Permit granted pursuant to this ordinance may be terminated after a public hearing conducted by the City Council at a regu- lar meeting or a special meet- ing called for the purpose of terminating a Special Use Per- mit. A permittee shall be giv- en ten (10) days written notice of the intention of the City Council to revoke its Special Use Permit together with a written statement of the grounds of the intended revo- cation. At a revocation hear- ing the Director of Planning shall make a report concerning the grounds, or lack thereof, for revoking the Special Use Per- mit. The report of the Direc- tor of Planning shall be mailed to the Permittee at least three (3) days prior to the revoca- tion hearing. SECTION V. Special Use Per- mits shall be granted for stor- age areas only if the proposed area is within the M-2 Light Manufacturing Zone, M-3 Limit- ed Industrial Zone, or M-4 Heavy Industrial Zone.
