HomeMy WebLinkAboutCC ORD 1968-1197 Adopts 1967 Uniform Building Code (Repealed by 1259)• 1 197 ORDINANCE NO. 1197 AN ORDINANCE OF THE CITY OF NATIONAL' CITY, CALIFOR- NIA, ADOPTING THE UNIFORM BUILDING CODE, VOLUME 1, 1987 EDITION, EXCEPTING THE APPENDIX THERETO, PROVIDING PENALTIES FOR THE VIOLATION THEREOF, DECLARING AND ESTABLISH- ING FIRE ZONES, AND RE- PEALING ORDINANCE NO. 1108, AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES OF SAID CITY IN CONFLICT THEREWITH. The City Council of the City of National City, California, does Ordain as follows: SECTION 1. That Ordinance No. 1108 of the City of National City, and all other ordinances and parts of ordinances in con- flict with this ordinance are hereby repealed. SECTION 2. There is hereby adopted by the City Council of the City of National City for the purpose of prescribing regula- tions governing the erection, construction, enlargement, alter- ation, repair, moving, removal, demolition, conversion, occupan- cy, equipment use, height, area, fire resistance, and mainten- ance of all buildings and/or structures, that certain code known as the Uniform Building Code, Volume 1, excepting the Appendix thereto, published by the International Conference of Building Officials being partic- ularly the 1967 Edition thereof and the whole thereof, save and except such portions as are here- inafter deleted, modified, or amended, of which code not less than three (3) copies have been and are now filed in the office of the Clerk of the City of Nation- al City and the same are here- by adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the City of National City. SECTION 3. Section 201 of the Building Code adopted by this ordinance is hereby amended to read as follows: Section 201: There is hereby established in the City of National City a Department of Building and Housing which shall be under the jurisdic- tion of the Director of Build- ing and Housing, designated by the appointing authority. SECTION 4. Section 303, para- graph adopt adopted f this Buildingthe Code odis hereby amended and shall read as follows: PLAN -C HECKING FEES. When a plan is required to be submitted by subsection (c) of Section 301, a plan - checking fee shall be paid to the Building Official. Said plan -checking fee shall be equal to one-half of the build- ing permit fee as set forth in Table No. 3-A. SECTION 5. Subsection (c) shall be added to Section 303 of the Building Code adopted by this ordinance to read as fol- lows: Section 303 (c) REINSPEC- TION FEES. Whenever it shall be necessary to make an extra inspection trip due to the ap- plicant for a permit giving an incorrect address or wrong location, or due to faulty or defective installation or when work is found to be incom- plete, an additional fee in the amount of FIVE DOLLARS ($5.00) as a Reinspection Fee may be charged for each such additional inspectior,. (P ... lam SECTION 6. Section 307 shall be added to the Building Code adopted by . this ordinance to read as follows: Section 307. No permit shall be granted by the City of Na- tional City authorizing the erection or major alteration of any building, or structure, nor shall the drawings and/- or specifications for same be checked or approved by the Director of Building and Hous- ing unless they have been perpared by or under the di- rect control of an architect or professional engineer li- censed by the State of Cali- fornia except the following: Dwellings, single or mul- tiple, not over two stories and basement in height, and their appurtenant buildings; Farm and Ranch build- ings; Wood frame commercial buildings, not over one story in height, and where the span between bearing walls does not exceed 25 feet. This exemption does not apply to concrete or steel frame buildings. SECTION 7. Section 308 shall be added to the Building Code adopted by this ordinance to read as follows: Section 308. Each occupan- cy or principal building or structure located within the incorporated limits of the City of National City shall be iden- tified by a designating number or letter or both number and letter as issued by the Di- rector. Said designating num ber or letter shall be of suf- ficient size and contrasting color to appear readable from the adjacent street or public way. SECTION 8. Table 5-A of the Building Code adopted by this ordinance is hereby amended as follows: That portion of Table 5-A pertaining to Group F-1 and F-2 Occupancies within all fire zones is hereby amended to require Fire Resistance of Exterior Walls of not less than two hour fire resistive construction less than ten (10) feet. SECTION 9. Section 205 of the Building Code adopted by this ordinance is hereby amend- ed to read as follows: Section 205. It shall be un- lawful for any person, firm or corporation to erect, con- struct, enlarge, alter, repair, move, improve, remove, con- vert or demolish, equip, us` occupy, or maintain any build- ing or orcausethe structure ame1n the city, to be done, contrary to or in violation of any of the provisions of this Code as amended. Any person, firm, or corpor- ation violating any of the pro- visions of this Code shall be deemed guilty of a misdemean- or separate offense for each and every day or portion thereof during which any vio- lation of any of the provisions of this Code is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than $500.00, or by im- prisonment for not more than 180 days, or by both such fine and imprisonment. SECTION 11. Section 510 is hereby added to the Building Code adopted by this ordinance and shall read as follows: Section 510. FIRE PROTEC- TION. All premises . where buildings or portions of build- ings are hereafter construct- ed and located more than 150 feet from a public street pro- viding access to such premises shall be provided as required by the Chief of the Fire De- partment. SECTION 12. Severability: If any section, subsection, sentence, clause, phrase, or por- tion of this ordinance is for any reason held to be invalid or un- constitutional by the decision of any court of competent juris- diction, such decision shall not affect the validity of the remain- ing portions of this ordinance. The City Council hereby declares that it would have adopted this code and each section, subsec- tion, sentence, clause, phrase, or portion thereof irrespective of the fact that any one or more sections, subsections, clauses, phrases, or portions be declared invalid or unconstitutional.
