HomeMy WebLinkAboutCC ORD 1968-1200 Adopts 1967 Uniform Mechanical Code (Repealed by 1366)1200 ORDINANCE NO. 1200 AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFOR- NIA, ADOPTING THE UNIFORM BUILDING CODE, VOLUME II, MECHANICAL CODE, 19 W EDI- TION, PROVIDING PENALTIES FOR THE VIOLATION THERE- OF, AND REPEALING ALL OTHER ORDINANCES A N D PARTS OF ORDINANCES OF SAID CITY IN CONFLICT THEREWITH. The City Council of the City of National City, California, does Ordain as follows: SECTION 1. That all other ordinances and parts of ordi- nances in conflict with this or- dinance are hereby repealed. SECTION 2. There is hereby adopted by the City Council of National City for the purpose of prescribing regulations gov- erning the installation and maintenance of heating, venti- lating, comfort cooling, and re- frigeration systems within the limits of National City, and providing for issuance of per- mits therefor, that certain code known as the Uniform Building Code, Volume II, Mechanical Code, published by the.Interna- tional Conference of Building Officials and the International Association of Plumbing and Mechanical Officials being par- ticularly the 1967 Edition there- of and the whole thereof, save and except such portions as are hereinafter deleted, modified, or amended, of which code not less than three (3) copies have been and are now filed in the office of the Clerk of the City of Na- tional City and the same are hereby adopted and incorporat- ed as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the City of National City. SECTION 3. Section 202' of the Mechanical Code ordinance is hereby adoptedamthis amended read as follows: Section 202. It shall be un- lawful for any person, firm, or corporation to construct or maintain heating, ventilating, comfort cooling, and refriger- ation systems within the lim- its of National City, or cause same to be done, contrary theo or in violation of any of provisions of this Code as amended. Any person, firm, or of corth- poration violating any p'rovisiodsof this Code shall be deemed guilty of a misde- meanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is cotftmftted, con- tinued, or permitted, and up- on conviction of any such violation such person shall be punishable by a fine of not more than $500.00, or by im- 180 days,noorfby th such tf ne 180 days, and imprisonment. SECTION 4. Section 307 is hereby added to the Mechanical Code adopted by this ordinance to read as follows: Section 307. REINSPECTION FEES. Whenever it shall be necessary to make an extra inspection trip due to the ap- plicant for a permit giving an incorrect address or wrong location, or due to faulty or defective installation, or when work is found to be incom- plete, an additional fee in the amount of FIVE DOLLARS ($5.00) as a reinspection fee may be charged for each such additional inspection. SECTION 5. Section 1901 par- agraph (c) is hereby added to the mechanical code adopted by this ordinance to read as fol- lows: (c) _ KITCHEN VENTILA- TION. There shall be installed in the wall or ceiling, ap- proximately over the cooking facilities, a ventilating open- ing with a minimum area of eight inches by six inches (8" x 6") connected with an incombustible ventilating duct free to the outside of the building. The ventilating duct for each kitchen shall have a minimum cross -sectional area of twenty-eight square inches (28 sq. in.). An approved forced -draft be venti- lotion may substitut d for the natural -draft ventilating - system. Ranges or hot plates shall not be installed in rooms in- tended to be used for sleeping purposes. SECTION 6. Severability: If any section, subsection, sentence, clause, phrase, or por- tion of this ordinance is for any reason held to be invalid or un- constitutional by the decision of any court of competent juris- diction, c affect thevaliditydecision shall ofthe re- maining portions of this ordi- nance. The City Council hereby declares that it would have adopted this code and each sec- _ tion, subsection, sentence, clause, phrase, or portion thereof ir- respective of the fact that any one or more sections, subsec- tions, clauses, phrases, or por- tions be declared invalid or un- constitutional. PASSED AND ADOPTED by the City Council of the City of National City, California, this 23rd day of July, 1968, by the following vote, to -wit: AYES: Councilmen Camacho, Colburn, Hogue, Morgan.
