HomeMy WebLinkAboutCC ORD 1968-1210 Delivery service deposit materials on private premises (6.34)21© ORDINANCE NO. 1210 AN ORDINANCE PROVIDING FOR THE REGULATION OF PRIVATE DELIVERY SERVICE DEPOSITING MATERIALS UPON PRIVATE PREMISES SECTION 1. Private delivery service as used in this ordinance means any business enterprise which has as one of its purposes the delivery of unsolicited or un- ordered merchandise, circulars, hand bills, or other publications, materials, substances, or objects of any nature or kind. Provided however, that nothing in this ordinance purports to regulate the operation of the United States mail. SECTION 2. Delivery Agent. As used in this ordinance, deliv- ery agent means any person em- ployed by a private delivery ser- vice to deliver, deposit, or place the cargo of a private delivery service upon premises in the City of National City. SECTION 3. Littering prohib- ited. Except as provided and authorized by this ordinance no private delivery service or de- livery agent shall deposit, throw, place, or deliver any merchan- dise, sample, circular, hand bill, or any other advertising mater- ials, or substance of any nature whatsoever upon public or pri- vate premises in the City of Na- tion City. SECTION 4. Delivery of sam- ple merchandise, hand bills, bulk mail, circulars, pamphlets, ad- vertising materials authorized. A private delivery service licens- ed to do business in the City of National City may deposit, in conformity with this ordinance, upon private premises hand bills, circulars, merchandise samples, advertising circulars, and other types of bulk mail. The delivery authorized by this ordinance must be accom- plished in the following man- ner: (a) Containers are required in all circumstances and materials delivered pursuant to this sec- tion must be deposited upon a private premise in a contain- er which will prevent the scat- tering of the materials delivered by the action of wind, or rain. Materials delivered pursuant to this ordinance must be deposited upon or in a structure uponthe private premise upon which the delivery is made. No materials may be deposited upon a vacant p-roperty. The container in which materials are delivered must be manufactured with a strap or hook which will allow the attaching of the container to some part of the private prem- ise, without damaging the pri- vate premise at which the deliv- ery is made. A delivery agent in making a delivery shall at- tach the materials delivered to the private premises, in the con- tainer required by this ordinance, in a fashion which will prevent the scattering of the materials by the actions of the wind and rain. SECTION 5. Trespassing Pro- hibited. In the event that the owner or occupant of a private premise declines delivery of un- solicited materials a delivery agent must immediately remove himself and the unsolicited ma- terials from the private prem- ises. A refusal to leave a pri- vate premises after having been requested so to do by an own- er or occupant shall constitute a criminal trespass and a viola- tion of this ordinance. SECTION 6. Hours of opera- tion. No delivery pursuant to this ordinance shall be made except between the hours of 8:00 A.M. and 5:00 P.M. SECTION 7. Violation and mis- demeanor. Conducting a private delivery service in violation of this ordinance by a person or firm or corporation; or doing any act contrary to the provis- ions of this ordinance shall con- stitute a misdemeanor punish- able by a fine of not more than $500 and/or imprisonment for a maximum period of 6 months.
