HomeMy WebLinkAboutCC ORD 1969-1218 Amends § 8 of Ord. 962, zoning (Repealed by 1503)r Ectj ECe Ord' (5 3 1218 ORDINANCE NO. 1218 AN ORDINANCE AMEND- ING ORDINANCE NO. 962, ZONING ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA (Delicatessen St or es and Convenience Food and Grocery Market, including off -sale alco- holic beverages, beer and wine; and Automobile Service Sta- tions) WHEREAS, pursuant to the terms and provisions of the Government Code of California, proceedings were duly initiated for the amendment of the Na- tional City Zoning Ordinance No. 962, and WHEREAS, pursuant to due and legal notice, hearings were held by the City Planning Com- mission of said City and also by the City Council of said City, and all persons interested were given an opportunity to appear and be heard before said Planning Commission and said City Council, and WHEREAS, the City Planning Commission of National City has regularly and duly certified to the City Council its report and has recommended such amendment, and WHEREAS, the City Council has appred the recom- mendation of the City Planning Commission: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALI- FORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. All protests, if any, against said rezoning and said amendments to Ordinance No. 96.2 and each of them be and hereby are denied and overruled. SECTION 2. There is hereby added to Section 8, Sub -Section K of Ordinance No. 962, a new paragraph 17 which shall read as follows; 17. Delicatessen stores and Convenience Food and Grocery Market,- including off -sale alco- holic beverages, beer and wine; and autom obile Service Stations; provided, however, a. The gross floor of any convenience food and grocery market shall not exceed 3,000 feet. b. All automobile service stations shall be constructed, installed and maintained in accordance with the re- quirements of Ordinance No. 1213 as adopted by the City of National City. c. All signs shall be of an architectural design and shall be approved by the Planning Commission. d. Decorative materials, i.e., new glass, used and new stone, wood, brick, and decora- tive masonry, shall be used to enhance the aesthetic appear- ance of any portion of the building or structure visible to the public. e. A ten (10') foot setback. shall be maintained on all property abutting upon a dedi- cated street. Said setback, ex- cluding driveways shall be landscaped and said land- scape shall be maintained with adequate watering sys- tem installed. f. Accessory uses: Each delicatessen store, convenience food and grocery market and automobile service station shall be entitled to the usual and customary incidental or accessory uses including stor- age buildings. g. No delicatessen store, convenience food and grocery market or automobile service station shall be permitted on any parcel of land without the approval of the location and plans by the City Council, upon recommendation of the P 1 a n n i n g Commission. In approving the location and plans, the Planning Com- mission shall take into con- sideration the provisions of off- street parking, appearance of the property and structures. The City Council may approve, modify, or disapprove the plans and location depending upon the evidence provided by the Planning Commission, applicant and staff.
