AN ORDINANCE ESTABLISH-
ING OPERATING REGULA-
TIONS AND LICENSE FEES
FOR CARNIVALS, CIRCUSES,
TRAVELING SHOWS, AND
MIDWAYS
The City Council of the City
of National City DOES ORDAIN
as follows:
SECTION 1. Scope of Regula-
tions. Requirements of this ordi-
nance will apply to all carni-
vals, midways, circuses, tent
shows, and traveling shows.
SECTION 2. Applications. The
operator of a covered business
shall make an application for
a special permit as follows:
a. Shows with a "midway"
shall make their application for
a City permit at least 14 days
prior to the opening day. In
addition to the information re-
quired for a business license,
the operator shall submit a list
containing the names of each
game of skill to be operated
on the midway. In addition, the
operator shall provide a list
containing the full names, social
security number or driver's
license number and home ad-
dress of each operator of a
game of skill which will be op-
erated during the time the show
is in National City. No games
of chance will be allowed.
b. A covered business that
does not contain a "midway"
shall submit their application to
the City at least 7 days prior
to the opening day.
SECTION 3. Responsibility for
Compliance. The owner and/or
operator of a covered business
is equally responsible with the
operator of an individual con-
cession or game of skill for the
compliance with these regula-
tions.
SECTION 4. Bond Required.
The owner or operator of a cov-
ered business shall post a bond
with the City at the time of
applying for a permit. The bond
shall secure full and faithful
compliance with each require-
ment of City and State law, and
shall run to the benefit of the
City of National City and the
individual residents thereof. The
bond shall be in a form ap-
proved by the City Attorney,
prior to the issuance of a busi-
ness permit. The bond shall be
in the following amounts:
a. For businesses with a
midway: $5,000.00.
b. For business without a
midway: $2,500.00.
The bond shall also guarantee
a complete clean-up of premises
occupied by the covered busi-
ness. The bond shall remain in
force until released by the City
Attorney.
SECTION 5. Special Officers.
Covered businesses without
midways shall provide 1 special
officer during daytime hours
and 2 special officers after 6:00
p.m. until closing.
Covered businesses with a
midway shall have 2 special
officers during daylight hours
and 4 special officers from 6:00
p.m. until closing.
The identity of the special
officers shall be submitted to
the Chief of Police at the time
of applying for a permit, and
no permit shall be issued until
the Chief of Police approves of
the special officers.
SECTION 6. Insurance. The
owner and/or operator of a cov-
ered business shall submit a
Certificate of Insurance, with
his application for a permit,
showing the existence of public
liability and property damage
insurance in the amounts of
$300,000.00 - $500,000.00 public
liability and $50,000.00 property
damage. The Certificate of In-
surance shall show the City of
National City as an additional
insured, with a 10-day notice of
cancellation provision. Only the
certificate of a company author-
ized to engage in the casualty
insurance business in California
will be acceptable.
SECTION 7, Inspection Fees.
At the time of application the
applicant shall pay a $50 fee
to defray the cost of building

and fire inspectors.
SECTION 8. Safety Certificate
Required. No ride shall be oper-
ated unless the operator has in
his possession an appropriate
certificate from the State of
California showing current com-
pliance with all State safety
regulations.
SECTION 9. Fire Safety. All
tent and awning materials used
shall carry a certificate of
approval for fire proofing from
the State Fire Marshal.
SECTION 10. Compliance
With All City Codes. All facili-
ties and equipment used in a
covered business must comply
with all City Codes regarding
b u i l d i n g, fire, electrical,
mechanical, plumbing, and
heating and cooling standards.
Section 11. Shut -down of Busi-
ness. Violation of any require-
ment of this ordinance or other
City laws shall be grounds for
closing a business without no-
tice.
SECTION 12. License Fee.
The operator of a covered busi-
ness, operating with a midway,
shall pay a daily license fee
of $25.00. The operator of a cov-
ered business operating without
a midway shall pay a daily li-
cense fee of $25.00.
SECTION 13. Ordinance.
Copies of applications received
hereunder shall be sent to the
Chief of Police, Director of
Building and Housing, and Fire
Marshal upon receipt.

National City, California, this
26th day of August, 1969, by
the following vote, to -wit:
