ORDINANCE NO. 1229
AN ORDINANCE AMENDING
ORDINANCE 962, ZONING OR-
DINANCE OP THE CITY OF
NATIONAL CITY, PROVIDING
REGULATIONS FOR TIIE CON-
VERSION OF RESIDENTIAL
STRUCTURES TO COMMERCIAL
USAGE
BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY
OF NATIONAL CITY, CALI-
FORNIA, as follows:
SECTION 1. Section 3, Para-
graph 27 of Ordinance No. 962
is hereby amended to read as
follows:
27. Dwelling Unit. Dwell-
ing unit is a suite of two
or more habitable rooms
which are occupied or which
are intended or designed to
be occupied by one family
with facilities for living,
sleeping, cooking and
dining.
SECTION 2. There is hereby
added to Section 3 a new Para-
graph A-1 to read as follows:
A-1. Assembly Building,,
Assembly building is a
building or a portion of a
building used for the
gathering for such purposes
as deliberation, worship,
auditorium, churches or
chapel, dance floor, lodge
rooms, conference rooms,
dining rooms, drinking es-
tablishments, exhibit rooms,
lounges.
SECTION 3. Section II, sub-
section B, Paragraph 10 of Or-
dinance No. 1173, is hereby
amended to read as follows:
10. No business, retail,
wholesale, manufacturing or
industrial use may be con-
ducted within a dwelling
unit other than a permitted
home occupation; provided,
however, that a structure or
building intended or de-
signed to be used as a
dwelling unit may be used
in the Commercial, Manu-
facturing and Industrial
Zones for a permissible
business, retail, wholesale,
manufacturing or industrial
use, subject to the follow-
ing:
a. Approval of the
location and plans by the
Planning Commission.
b. A11 residential facili-
ties outlined within the defi-
nition of a dwelling unit
shall be removed.
c. All other provisions
of the zoning ordinance are
complied with.
d. Any change of occu-
pancy shall comply with all
requirements of the Build-
ing Code and related ordi-
nances as adopted by the
City of National City.
e. Said Structure or
building shall not be used
or occupied until after the
issuance of a Certificate of
Occupancy by the Director
of Building and Housing.
SECTION 4. There is hereby
added to Section II, Sub -section
B of Ordinance No. 1173 new
Paragraphs 9-A and 9-B, which
shall read as follows:
9-A. The Planning Com-
mission by Resolution may
permit a dwelling unit of
a historical character to be
converted and used as a
commercial usage.
9-B. A dwelling unit or
any portion thereof shall be
permitted to be converted
and/or used as an assembly
building as defined by this
ordinance only by the issu-
ance of a Conditional Use
Permit and only in such
location and under such
conditions and methods of
operation as in the opinion
of the City Council will pro-
tect the public health, safety
and general welfare. In
such case the City Council,
upon recommendation of the
Planning Commission, may
issue a Conditional Use Per-
mit by Resolution; pro-
vided, however, the follow-
ing requirements shall be
complied with:
a. The location of
parking and increase of
traffic will not create a
traffic hazard.
b. The structure shall be
located within the proper
zone as established by the
Zoning Map of the City of
National City for the pro-
posed use.
c. The development
shall conform with all re-
quirements of the Zone in
which said property is lo-
cated (Le. parking, set-
backs, etc.)
d. Any change of occu-
pancy shall comply with all
requirements of the Build-
ing Code and related Ordi-
nances as adopted by the
City of National City.
e. Said Structure or
building shall not be used
or occupied until after the
issuance of a Certificate of
Occupancy by the Director
of Building and Housing.
SECTION 5. In the approval
of any plans for the conversion
of a residential structure for
any of the uses permitted under
this section, the Planning Com-
mission shall take Into con-
sideration the architectural de-
sign of the structure as well
as the esthetic appearance of
the structure and the property.

the City Council of the City of
National City, California, this
2nd day of September, 1969, by
the following vote, to -wit:
