HomeMy WebLinkAboutCC ORD 1969-1232 Amends § 5 of Ord. 707, food establishments (Repealed by 1366)1232 ORDINANCE NO. 1232 AN ORDINANCE AMENDING SECTION 5 OF ORDINANCE NO. 707 RELATING TO AN- NUAL INSPECTION FEES FOR FOOD ESTABLISHMENTS The City Council of the City of National City, California DOES ORDAIN as follows: SECTION 1. The first para- graph of Section 5 of Ordinance No. 707, as amended by Ordi- nance No. 881 and 1056, is amended to read as follows: "ANNUAL INSPECTION FEE. Every person applying for a permit under the provisions of this section shall at the time of making application for the permit pay the following annual inspection fees: 1. For each establishment, other than a vehicle or vending machine, a fee based on the average number of employees during the preceding year or, if in the opinion of the Health Officer said average number does not reflect the number of employees during the year for which the permit is sought with reasonable accuracy, the esti- mated average number of em- ployees. 1 to 10 employees $15.00 11 to 99 employees 1.50 per employee 100 or more employees 150.00 2. For one or two vehicles under the same ownership and operating out of the same estab- lishment $15.00 3. For each vehicle in excess of two under the same owner- ship and operating out of the same establishment $15.00 4. For each vending machine dispensing milk, ice cream, or milk products or other kinds of perishable foods or beverages, or dispensing unbottled or un- canned liquid foods or bever- ages, excepting vending ma- chines which dispense un- wrapped, non-perishable, non - liquid food products $ 3.00 5. For each duplicate permit replacing a permit previously issued $15.00 In any case where the applicant has failed for a period of 30 days to file the application and obtain the permit required by this ordi- nance, there shall be added to and collected with the in- spection fee a penalty equal to 10 percent of the fee or one dollar ($1.00) whichever is the greater; and for each additional month or fraction of a month after the expira- tion of said 30-day period that the applicant fails to file such application and obtain such permit, there shall be added to and collected with the inspection fee an additional penalty equal to 10 percent of the inspection fee; pro- vided, however, in no event shall the total penalty added to the inspection fee pursuant to this section be more than 60 percent of the inspection fee. The imposition or pay- ment of the penalty imposed by this section shall not pre- vent the imposition of any other penalty prescribed by this ordinance or a criminal prosecution for violation of this ordinance. Institutions exempt from real property assessments and taxation are exempt from paying the fees established by this paragraph. SECTION 2. EFFECTIVE DATE. This ordinance shall take effect and be in force 30 days after the date of its pas- sage, and before the expiration of fifteen days after its passage it shall be published once, with the names of the members voting for and against the same, in the National City Star -News, a newspaper of general circula- tion published in the County of San Diego.
