No. 856 ORDINANCE NO. 356 AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA, AMENDING ORDINANCE NO. 757 OF SAID CITY BY AMENDING SECTIONS 2, 3 AND 4 THEREOF. The City Council of City of National City, California, does ordain as fol- lows: SECTION I: That Section 2 of ORDINANCE NO. 757 is hereby amend- ed to read as follows: "SECTION 2: It shall be unlawful for any person to operate in the City of National City, any device, appliance, equipment, and/or ap- paratus, generating and/or causing high frequency oscillations and/or radiations which interfere with radio broadcast receiving apparatus or wireless receiving apparatus or television receiving apparatus; pro- vided, however, that X-ray pictures, examinations or treatments may be made at any time if the machines or apparatus used therefor are properly equipped to avoid all un- necessary or reasonably prevent- able interference with radio and television reception and are not negligently operated: provided, further, complete screening of the room in which offending X-ray apparatus is operated may be re- quired when such screening is necessary in order to avoid said interference, and, provided. further, that neon signs shall be deemed to comply with the provisions of this ordinance when such signs are properly equipped to avoid all un- necessary or reasonably prevent- able interference with radio and television reception and are not negligently operated." SECTION 2: That Section 3 of ORDINANCE NO. 757 is hereby amended to read as follows: "SECTION 3: It is expressly un- derstood, and provided, however, that this ordinance shall not apply to radio or television stations, either broadcast, commercial or amateur, licensed by the federal government and/or which are engaged in interstate communica- tion. or public utilities under the supervision of the State Railroad Commission." SECTION 3: That Section 4 of ORDINANCE NO. 757 is hereby amended to read as follows: "SECTION 4: The Chief of Police is hereby charged with the enforce- ment of this ordinance. He may appoint or deputize such other per- sons as he deems necessary, to assist him in enforcing the pro- visions of this ordinance. The enforcement officer and/or his duly authorized deputies shall have the right to enter upon any premises at all reasonable hours for the purpose of inspecting the in- stallation of all apparatus or equip- ment coming within the terms of this ordinance, and it shall be un- lawful for any person to interfere with said enforcement officer, or his duly authorized deputy or deputies in making such inspection or to refuse to permit the said enforcement officer, or his duly authorized deputy and/or deputies to enter the premises for such pur- poses; provided, however. that the right to enter granted herein is not intended to grant to the en- forcing officer and/or his author- ized deputies, any right of entry into a private residence or any other premises under circum- stances prohibited by the .Con- stitution of the State of California." SECTION 4: This ordinance shall take effect and be in force on the thirty-first day from and after its passage. SECTION 5: The City Clerk of City of National City is hereby directed to publish this ordinance once in the National City News, a newspaper of general circulation, printed and pub- lished in the City of National City, California. PASSED AND ADOPTED by the City Council of the City of National City, California, this 16th day of Feb- ruary, 1954, by the following vote, to - wit: AYES: Councilmen Campbell, Par - Chen, Sarn.
