HomeMy WebLinkAboutCC ORD 1959-956 Special election (Special)ORDINANCE NO. 956 AN ORDINANCE OF THE CITY OF NATIONAL CITY CALLING A SPECIAL ELECTION TO BE HELD ON THE IOth DAY OF NOVEMBER, 1959, PERTAINING TO THE ANNEXATION OF 'SWEETWATER ANNEXATION UNIT NO. I' TO THE CITY OF NATIONAL CITY WHEREAS, by Resolution No. 7564, the City Council of the City of National City declared its intention to call a special election to be held in certain inhabited territory contiguous to said city proposed to be annexed to the city, for the purpose of submitting to the qualified electors residing in said territory the question whether or not the territory shall be annexed to the city; and WHEREAS, a copy of said resolution was published as required by law; and WHEREAS, at a time not later than the hour set by said resolu- tion for hearing objections to the proposed election protests were not made by the owners or by public and private owners equal to one- half of the value of the territory proposed to be annexed; and WHEREAS, all proceedings have been had in accordance with said resolution and the Annexation Act of 1913, reference thereto hereby being made for further particulars; NOW, THEREFORE, the City Council of the City of National City does ordain as follows: 1. A special election is hereby called to be held on the IOth day of November, 1959, in the territory hereinafter described and proposed to be annexed to the City of National City, for the purpose of submitting to the qualified electors residing in said territory the question whether or not such territory shall be annexed to, incorporated in, and made a part of said City of National City, and whether or not the property in said territory shall, after such annexation, be subject to taxation, equally with the property within the City of National City, to pay the entire bonded indebtedness of the City of National City outstanding or authorized at the date of the first publication of the notice of election for the acquisition, construction or completion of municipal improvements. Said territory is described as follows: All that unincorporated area situated within the County of San Diego, State of California, described as follows: 1. Beginning at the Southeasterly corner of the Westerly Quarter of 10 Acre Lot 9, Quarter Section 152 of Rancho de la Nacion, according to Map thereof No. 166 filed in the office of the County Recorder of San Diego County, May II, 1869; 2. Thence Northerly along the Easterly line of said Westerly Quarter and the Easterly line of the Westerly Quarter of 10 Acre Lot 10 in said Quarter Section 152 and its Northerly prolongation, a distance of 700 feet, more or less, to the boundary of the City of National City; 3. Thence Westerly along said boundary a distance of 370 feet, more or less, to the Northerly prolongation of the Easterly line of Block 4 of Copeland Subdivision, according to Map thereof No. 978 filed in the Office of the County Recorder of San Diego County, March 19, 1906; 4. Thence Southerly along said Northerly prolongation and said Easterly line a distance of 330 feet, more or less, to the Southeast corner of Lot 11, Block 4, Copeland Sub- division, according to Map thereof No. 978 filed in the Office of the County Recorder of San Diego County, March 19, 1906; 5. Thence Westerly along the Southerly line of Block 4, Copeland Subdivision, a distance of 135 feet, more or less, to the West line of the alley in Block 4, Copeland Subdivision, according to Map thereof No. 978 filed in the Office of the County Recorder of San Diego County, March 19, 1906; 6. Thence Northerly along the said West line of the alley in Block 4, Copeland Subdivision and the Northerly prolongation of said West line a distance of 330 feet, more or Tess, to a corner in the boundary of the City of National City; 7. Thence Westerly along said boundary a distance of 155 feet, more or less, to the Northerly prolongation of the centerline of C Avenue, according to Map thereof No. 978 filed in the Office of the County Recorder of San Diego County, March 19, 1906; 8. Thence Southerly along the Northerly prolongation and the centerline of C Avenue, and the Southerly prolonga- tion of the centerline a distance of 700 feet, more or Tess, to the Southerly line of 10 Acre Lot 8, Quarter Section 152; 9. Thence Easterly along said Southerly line and its Easterly prolongation a distance of 330 feet, more or less, to the North -South centerline of Quarter Section 151, Rancho de la Nacion; 10. Thence Southerly along said centerline of Quarter Section 151 a distance of 1,320 feet, more or Tess, to the Southerly line of 10 Acre Lot 13, of Quarter Section 151; II. Thence Easterly along said Southerly line a distance of 235 feet, more or less, to an intersection with the centerline of Sweetwater River; 12. Thence Northeasterly along said centerline of Sweetwater River a distance of 145 feet, more or Tess, to an intersection with the Easterly line of the Westerly one -quarter of 10 Acre Lots 13, 14, 15 and 16 of said Quarter Section 151; 13. Thence Northerly along said Easterly line a distance of 1,210 feet, more or Tess, to the point of beginning. 2. The polls at said election shall be opened at 7:00 o'clock a.m. of the day herein fixed for the holding of said election and shall be kept open until 7:00 o'clock p.m. of the same day, when the polls shall be closed. 3. Upon the ballots to be used at said election there shall be printed the words: SHALL "SWEETWATER ANNEXATION UNIT NO. I" BE ANNEXED TO THE CITY OF NATIONAL CITY, AND THE PROPERTY IN SUCH TERRITORY BE, AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY WITHIN THE CITY OF NATIONAL CITY, TO PAY THE ENTIRE BONDED INDEBTEDNESS OF THE CITY OF NATIONAL CITY OUTSTANDING OR AUTHORIZED AT THE DATE OF THE FIRST PUBLICA- TION OF THE NOTICE OF ELECTION, FOR THE ACQUISITION, CON- STRUCTION OR COMPLETION OF MUNICIPAL IMPROVEMENTS? Opposite these words there shall be printed the words "Yes" and "No," and to the right of each of these last two words there shall be a voting square. If an elector shall stamp a cross (X) in the voting square after the printed word "Yes" the vote of such elector shall be counted in favor of the annexation of said territory to the City of National City; and if an elector shall stamp a cross (X) in the voting square after the printed word "No" the vote of such elector shall be counted against such annexation. In all particulars not herein recited said election shall be held in conformity, as near as may be, with the laws of the State of California concerning general elections and with said Annexation Act of 1913. 4. (a) For the purpose of said election there hereby is established in the territory described herein one (I) voting precinct, which shall include all of said territory. The following is the polling place of said election precinct and the following named persons hereby are named officers of election and shall constitute the board of election for such election precinct: Polling Place: 316 E. 31st Street San Diego County, California Inspector: Mildred 0. Huchell Judges: Virginia M. Wayne Rachael J. Jones (b) For their services in connection with said election, said inspector shall receive $12.00 and said judges$1O.00 each; and the person in possession of the polling place named herein shall receive for the use of such premises in connection with said election the sum of $8.00. 5. The City Clerk shall publish a notice of said special election as required by the Annexation Act of 1913, at least once a week for the four (4) weeks prior to the date of the election on November 10, 1959, in The Independent, a newspaper of general circu- lation printed and published outside of the City of National City but in the County of San Diego, California. 6. This ordinance shall take effect upon its publication.
