HomeMy WebLinkAboutCC ORD 1950-802 Annexation (Special)802 ORDINANCE NO. 802 AN ORDINANCE APPROVING THE ANNEXATION TO THE CITY OF NATIONAL CITY, CALIFORNIA, OF CERTAIN UNINHABITED TERRITORY, IN THE COUNTY OF SAN DIF,GO, STATE OF CAL- IFORNIA, DESIGNATED AS "PAL)t VALLEY." wuER1•:As. on the twentieth day of July, 1930, the City Council of the City of National City, California, pur- suant to Section No. 35310 of the Gov- ernment Code of the State of Califor- nia. initiated proceedings for the an- nexation to. incorporation and inclu- sion in the City of National Ctty, of certain uninhabited territory herein- after described, in the County of Fan Diego, State of California. and desig- nated as "Palm Valley." pursuant to the annexation of the uninhabited ter- ritory Act of 1939. as amended: and WHEREAS. pursuant to the terms and pro,. isions of said annexation of Uninhabited Territory Act of 1939. as amended. the Council of the City of National City, at a regular Meeting, held on th.- twentieth day of July, 1950, adopte( a resolution giving notice of the pro, oleo annexation. which reso- lntion described the baundarles of the territory so proposed to be an- nexed to the City of Natitnal City. and Prnated such territory a "Palm Valley"; and said resolution provid- ed for a hearing to he held on the fifteenth dray of August, 1930. at the hour of S:00 P.M. in the Council Chambers at the City alai. National City. Califc:'ni s, at a regular meeting of the City Council of said Clty, at which time any person owning real property within such territory pro - nosed to be annexed and having any nbjec (ions to the proposed annexation, might appear before said City Council and show why- such territory should not he so annexed: and R'HT.iREAS. the ('Ity Clerk of tic City of National City caused a copy of said resolution to be published once weak for two successive weeks Prier to said fifteenth ,try of August. 1950. in the National City News, a weekly r ewspaper of general circulation. pub- lished in said City to -wit: Upon the fourth day of August, 19So, and upon the eleventh day of August, 1930: and R-HEREAS, on the fifteenth day of Acust. 19b0, at 5:00 I'.'.t. at a regular meeting nt the City Council of said City. it was found that no protests were Wed against such proposed an- nexation. The City Council of the City of National City hereby ap- nr„ces the annexation to the City of Nr tlanal City of the following de- scribed territory situated in the Coun- ty of San Diego. State of California. designated as "Palm Valley" to -wit; Beginning at the Northwesterly corner of ly Section 127 of Rancho de In Nacion. according to Map thereof No. 100, on file in the office of the Recorder of San Diego Coun- ty; thence Northeasterly along the northerly- line of said di Section 127. being along the southerly boundary line of the City of National Clty. to the most northwesterly corner of Lincoln Acres. according to Mao thereof No. 1710 on filo in the of- fice of the Recorder of San Diego County: thence southerly- and south- westerly along the westerly line of said Lincoln Acres to the westerly, line of sold ra Section 127. thence northerly along said westerly line of di Section 127. being along said southerly line of the City of Na- tional City to the point of begin - ring. SECTION 2. That the City Clerk of said City Is hereby authorized and directed to file a certified copy of this ordinant•e in the Office of the Secre- tary of State of the State of California; giving the date of its passage; and from and after the date of filing of said document in the office of said Secretary of State the annexation of such territory so proposed to be an- nexed and described herein shall be deemed to be and shall be completed: and thence forth such annexed terri- tory shall be. to all intents and pur- poses. a part of the City of National City. and such annexed territory shall be taxer: to pay- its proportionate share of any- Indebtedness or liability of the City of National City contracted prior to or existing at the time of the an- nexation thereof. SECTION 3. That the City Clerk be, and said City Clerk Is hereby further authorized and directed to file in the Office of the Recorder of the County of San Diego an affidavit stating that all requirements of the laws pertain- ing to the proceedings for the annexa- tion of the territory hereinabove In Section 1 described have been cour- Plied with. which said affidavit shall be accompanied by a certified copy of the boundary description as set forth in said proceedings and also by a map delineating such boundary, as required by Sections 340(0 and 34031 of the Oovernnent Code of the State of Cali- fornia. The City- Clerk is here- by directed to cause this Ordinance to be published once in the National City News. a newspaper printed and Pub- lished in said City. and of general cir- culation therein.
