ORDINANCE NO. 803
AN ORDINANCE PROVIDING REG-
ULATIONS FOR TILE SUBDIVIS-
ION OF LAND, FOR TILE DEDI-
CATION OF STREETS, AND FOR
THE APPROVAL OF ?LAPS
THEREOF IN TI(E CITY OF N.1-
TIONAL CITY AND RE.L'EALING
ORDINANCE NO. 550 OF THE OR-

NATIONAL, CITY, ('ALIFO1{Nf.1.
The City Council of the City of Na-
tional City-, California does ordain as
follows:
SECTION 1. That Ordinance No.
MO of the Ordinances of the City of
National City, California. Is hereby
repealed.
S'I•:CTIOX S. Pursuant to the author-
ization contained in the Subdivision
Map Act of the State of California, this
ordinance is adopted supplemental
thereto. :and in furtherance thereof and
Is to he construed and enforced In con-
nection and in conformity therewith.
SECTION 8 Whenever any subdi-
vision of land, as defined in the Sub-
division Map Act. and any amend-
ments thereto, of the State of Cali-
fornia. shall hereafter be laid out
within. or partly- within. the: incor-
porated limits of the City of National
City. the Subdivider thereof. or his
agent, shalt submit both a tentative
and a final clap thereof to the C'.ly
Planning Cmundssinn of said city.
Said maps and all procedure relating
thereto shall in all respects he in
fall cnrnplia nee with the provisions
of said Act, and any a!nendnn ents
thereto. and with the regulations here-
inafter contained In this ordinance.
SECTION 1. (A) Master Street Plan.
The subdivision of Land, ne the dedi-
cation of land. for streets. highways,
alleys. or other public use. shall con-
form. in so for as may be neeea sa ry

(1!) Relations to the Adjoining Street.

the continuation of the principal exist-

to the boundary of the subdivision to

(1)) Street raid .111e. Widths. The
minimum width of streets and other
public ways shall be as follows:
(a) Arterial streets. eighty (s0)
feet. minor streets. sixty ((10) feet, ex-
cept where the toaster street plan
shows a greater width In which case
the minimum width shall be that
shown on the plaster street plan.
(b) if Alleys ore provided, they
shall be not less than twenty (20) feet.
(e) The street or alley lying along
the boundary of a new subdivision may
be dedicated one-half Use required

portion of a street shall be distinctly

(e) Private streets shall be pro-
hibited.
(E) Intersections.
(1) Intersections of streets shall
be at an angle of ninety (90) degrees or
as close to such an angle as practic-
able.
(2) Block eornsrs may be required
to be rounded or cut off in such man-
na' .and In such location :as may be re-
quired by the City Council upon rec-
ommendation of the City Planning

more than one block, the blocks may be
numbered or lettered in numerical or
alphabetical order, respectively, cum-
mele•ing with the numeral "1" or the
letter "A" and continuing without
omission or duplication: or the lots
only may be numbered, conuneneing
with the numeral "V' and continuing
without n:rission or duplication.

Information. The tentative map or pre-
liminary plan shall contain the follow-
ing' information:
(I) The name or title under which
the proposed subdivision is to he re-
corded.
(2) The name and address of the
record owner of subdivider and the
name and address of the person pre-
paring the map,
(3) The name. location, width, ap-
proximate grades, and radii of pro -
Posed and existing streets, alleys,
highways, and ways included In the
plat: also, similar facts regarding the

(4) The locatInn of existing condi-
tions affecting the subdivision, includ-
ing easements, ditches. water mu rags,
and other natural features and exist-

In the event that any subdivider is dis-
satisfied with the findings of the Plan-
ning Comndssion or the City Council,

SECTION (I. Survey,
r \) Each subdivision shall, sub-
serimdt to the approval of the ten-
t:rtive map thereof and prior to the
filing of the final map with the Plan-
ning Commission, be surveyed accur-
ately. in accord:in". with the tenta-
tive neap and all alterations and chang-
es required: exc,'pt, however, 1n cases
whore the map is exclusively a re-
version to acreage, such survey shall
not be required.
(11) The procedure and practice of
all survey work done upon such sub•
division shall conform to the accepted
standards of the surveying profession, :

(B) ('crtificates.
(1) The Final Map shall bear the
certificates required by the Subdivision
Map Act of the State of California and
amendments thereto.
(2) There shall bo :t certificate for
the execution of the Chairman and
Secretary of the Planning Commis -
Sinn upon the approval of the map by
said Commission as herein Provided.
(3) Thera shall be a certificate for
the approval by the Clty Attorney of
the oral) and certificates appearing
thereon.
(4) There shall be n certificate for
the City Engineer and Chairman of
the Planning Commission certifying
that they have examined each lot In
the subdivision as to Its value for
residential or commercial purposes and
found ft suitable for such purposes.
(C) Procedure. Final IMP.
(2) All street and alley corners
shall be marked by galvanized Iron
pipes not less than three quarter Inches
In diameter by eighteen Inches In
length, or by Iron pins not less than
5/$ Inch in diameter by 18 Inches In
length; all to be driven flush with
the ground.
(3) Teta corners shall be marked
with a two Inch Cedar or Redwood
stake twelve Inches long, centered
with a copper tack driven at least
ten Inches Into the ground or not
less than a half Inch steel rod or pipe
not less than twelve inches long driv-
en at least ten Inches Into the ground.
(4) Said monuments mentioned
above need not he set prior to the fil-
ing of the Final Map provided that a
bond in an amount acceptable to the
City Engineer, has been deposited
with the City Clerk to Insure com-
pletion of this work at a later date.
SECTION 7. Final Nha.p
Within one (I) year after the ap-
proval of a tentative map by the
Planning Commission and the City
Council, the subdivider shall submit
to the Planning Comtnlssion at final
map thereof.
(A) Information. The final roan

Subdivision Map Act.

(C) Ni final map shall be accepted
by the City Council until detailed plans
and specifications have been submitted
to and approved by the City Engineer
for all the improvements to be made,
and until all such work has been com-
pleted and approved by the City En-
gineer, and accepted by the City Coun-
cil or a cash bond in an amount ac-
ceptable to the City Engineer has been
deposited with the City Clerk; except
that in lieu of the completion or the
cash hand the subdivider, prior to or
simultaneously with the presentation
thereof to the City Council, may com-
ply with and perform the following
r•'quirenents. to -wit:
(1) The final map shall be referred
to the city Engineer for examination
and approval. The City Engineer shall
examine the map for correctness of
survey data. mnthematical data and
computations and setting of monu-
ments.
(2) The Planning Commission shall
examine the map for compliance with
the tentative map and approved chang-
es thereof. When the Clty Planning
Commission Is satisfied that the sub-
division complies with the provisions
of this ordinance and the Subdivision
M:ap Act, It may. by a majority- vote.
approve the map and recommend its
adoption by the Clty Council.
(a) After the map has been signed
by the Secretary and Chairman of the
Planning- Commission, it shall be for-
warded to the City Clerk for submis-
sion to the City Council.
SECTION .S. Improvements. (A) The
Subd+vtrler shall Improve all land ded-
icated for streets. alleys or other pub-
lic ways In the following manner:
(1) Grading: All streets and alleys
or other public ways shall be graded
according to plans and profiles ap-
proved by the City Engineer and City
Council.
(2) Curbs: Curbs shall be con-
structed on both sides of all streets
within the subdivision and on the sub-
dividers side of all streets bounding
the r: ibd Ivisinu, where curbs are not

curbs shall be constructed on primary
streets and either verticle or rolled
curbs .shall be constructed on all other

(31 Sidewalks: All sidewalks shall

the City Clerk detailed estimates made
or approved by the City Engineer of
the cost of such improvements and an
estimate of tone reasonably necessary
to complete the same. In compliance
with the approved plans and specifi-
cations filed In the Clty Engineers Of-
fice.
2. The subdivider shall enter in-
to a contract with the City of National
City approved as to form and legality
by the City Attorney. to make. install,
and complete all the Improvements not
already installed and completed, and
shall accompany- the same by a. Faith-
ful Performance Itond, issued by a
Surety Company acceptable to the
City. in favor of the City, in a penal
sum equal to the estimated cost of
the Improvements, which bond shall
have been approved as to form and
legality by the City Attorney and
approved by the City- Council.
The time of the performance of said
contract shall he the period estimated
by the City Engineer as reasonably
necessary to complete the improve-
ments, subject to the right of the
City Council to extend the saute, as
public expediency may demand.
3. The subdivider shall submit
evidence, approved :as to form and
legality by the City- Attorney. that he
has completed arrangements with a
public utility company or public agency
whose business or function includes the
supply of domestic water to Install
the required water mains.
SEC'rr(IN 9. Recording.
R'henever such final mop shall
have been accepted by the City Coun-
cil It shall be signed by the Mayor
and City Clerk and recorded in the
office of the Heeorder of San Dietgo
County-, Calif.. as required by the
Subdivision Map Act. After the map
has been recorded the subdivider shall
furnish the City of National City
with two (2) blue line prints on cloth.
SECTION 10. Record of Survey. Ex-
cept as otherwise provided in the Sub-
division Map Act as amended, the
provisions and procedure relating to
final maps shall apply to Record of
Su rv:,y maps of unimproved property.
SECTION 11. If any section. sub-
section. sentence, clause. phrase, or
provision of this ordinance is, for any
reason, held to be Invalid. such de-
cision shall not affect the validity of
the remaining portion. The City Conn-
ell hereby declares that had It known
of the Invalidity of any such section,
subsection. sentence. clause, phrase• or
portion thereof. a1 the time of the
Passage of this ordinance. it would
have passed the remainder thereof
without such Invalid portion.
SECTION 12. This ordinance shall
take effect and be in three on the thlr-
ty-first day front and after It: passage.
