AN ORDINANCE OF THE CITY OF
NATIONAL CITY, CALIFORNIA,
REGULATING THE ERECTION,
CONSTRICTION, ENLARGF,NENT,
ALTERATION, REPAIR. MOVING,
REMOVAL, DEMOLITION, CON-
VERSION, OCCUPANCY, EQUIP-
MENT USE. HEIGHT. AREA. AND
MAINTENANCE OF ALL BUILD-
INGS AND/OR STRUCTURES IN
THE CITY OE NATIONAL CITY,
CALIFORNIA: PROVIDING FOR
TIIE ISSUANCE OF PERMITS AND
COLLECTION OF FEES THEREFOR:
PROVIDING PENALTIES FOR THE
VIOLATION THEREOF: DECLAR-
ING AND ES'TABI.ISHING FIRE
ZONES AND REPEALING ORDI-
NANCES NO. 714, 719 AND 798 AND
ALL OTHER ORDINANCES AND
PARTS OF ORDINANCES OF SAID
CITY IN CONFLICT THEREWITH.
The City Council of the City of Na-
tional City. California, does Ordain as
follows:
SECTION 1. That Ordinance No. 714,
Ordnance No. 719 and Ordinance No.
798 of the Ordinances of the City of
National City, and each of them. and
all other ordinances or parts of ordi-
nances to conflict with this ordinance
are hereby repealed.
SECTION 2. That a certain docu-
ment. three (31 copies of which are on
file in '.he office of the City Clerk of
the City of National City, California.
marked and designated as "Document
No. 18408 Uniform Building Code, 1952
Edison and its appendix. prepared by
the Pacific Coast Building Officials'
Conference," be and the same is. here-
by adopted as the Building construc-
tion, er.iargement, alteration, repair,
moving, removal, demolition, conver-
sion. occupancy.equipment use. height,
area and maintenance of all buildings,
andor structures in the City of Na-
tional City. California, providing for
the Issuance of perrnits and collection
of fees therefor; providing penalties
:or the violation of such Code: and
each and all of the regulations, pro-
visions, penalties, conditions. and terms
of such uniform building Code pre-
pared by the Pacific Coast Building
Officials' Conference on file in the of-
fice of the City Clerk are hereby refer-
red to, adopted and made a part hereof
as if fully set out in this Ordinance.
SECTION 3. Section 1603(f) of the
Building Code adopted by this Ordi-
nance shall be added to read as fol-
lows:
SECTION 1603(f) Before any existing
building, house or structure of any type
whatsoever may be moved from outside
the city limits of the City of National
City, to within the city limits of the
City of National City, application for
such moving shall be made to the
City Council of the Clty of National
City. Upon receipt of said application
for the moving of such building, house
or structure. the City Council shall
cause an inspection to be made of said
building, house or structure and a re-
port of said inspection shall be filed
with the City Council. The City Coun-
cil may approve or disapprove said
application for any valid reason. No
building. house or structure shall be
moved from without the City of Na-
tional City to within the City of Na-
tional City without the express per-
mission of the City Council of the City
of National City.
The City Council may require the
owner. or his duly authorized agent
to provide a certified statement by a
qualified specialty contractor, current-
ly licensed hy the State of California,
to the effect that such building. house,
or structure is free from fungus, ter-
mites, or similar defects.
All buildings, houses or structures
moved into the Clty of National City
shall conform to the zoning regulations
of the district in which they are to be
located and shall conform or be made
to conform to this code.
A fee of TWENTY FIVE DOLLARS
($25.001 shall accompany each applica-
tion, which fee is to recompense the
City of National City to a degree, for
the expense involved in the inspection.
The City Council of the City of Na-
tional City may, by resolution, specify
certain minimum area requirements of
any building, house or structure to be
moved from without the city limits of
the City of National City to within the
City limits of the City of National City,
Permission may be granted or de-
nied by motion of the City Council. If
Permission is granted, applicant shall
receive a written permit to move said
building, house or structure to within
the city limits of the City of National
City: said permit shall state the time
limits within which the building is to
be moved and the place from which
the building is to be moved and the
place where it is to be permanently lo-
cated. '('he Building Inspector 0f the
City of National City shall issue said
,era:it after prior approval by the City
Counei.
SECTION 4. Section 1603(g) of the
Building Code adopted hy this Ordi-
nance shall be added to read as fol-
lows:
SECTION 16031g) Whenever an exist-
ing building, house or structure Is
,:roved from its present location to a
new location within the City of Na-
ucnal City, the said building, house
or structure shall be made to ('am-
ply with and conform to all laws and
ordinances of the City of National
City applicable to new huildings, hous-
es or structures.
Any person who desires to )hove
any building, house or structure what-
soever, si.a.l fi:e with the City Conned,
prior to such inovin.g, an application
stating h{s intention, the purpose and
extent of alterations, and rehabilita-
tions necessary to enable said build-
ing, house or structure to conform to
the Ordinances of the City of National
City relating to new structures in the
new location. Said application shall
he made upon blanks provided there-
for by the City Council, Any applica-
tion for a permit to move any huild-
ing, house or structure may be de-
nied by the City Council if in the opin-
ion of the City Council the said build-
ing, house or structure cannot be ful-
ly altered or rehabilitated to conform
to the laws and ordinances of the City
of National City. or for any other val-
id reason. In the event the Clty Coun-
cil approves said application. they
shall cause to be issued a permit for
the moving of said building. house or
structure described in said applica-
tion.
No building, house or structure shall
be moved from its present location
within the City of National City to a
different location within the City of
National City without express approval
of the City Council. The City Council
shall cause an inspection to be made
of said buildings, houses or structures
prior to the granting of permission to
move the same.
The decision of the City Council In
granting or denying a permit to move
an existing building. house or struc-
ture shall be final and conclusive.
No building. house or structure may
be moved unless it shall comply In its
new location. with the zoning laws
governing said location.
The City Council may, by resolution,
specify certain minimum area require-
ments of any building, house or struc-
ture to be moved from one location
within the city limits of National City
to another location within the city
limits of National City.
SECTION 5. That the Building Code
mentioned in and adopted by this Or-
dinanee shall be supplemented and
amended by the insertion and addition
of the following section to be number-
ed 2205 to read as follows:
SECTION 2205. "All exterior walls
of all Type V buildings having a floor
area of less than four hundred (400)
square feet shall be finished with sid-
ing or its equivalent."
"No structure or building, as defined
in this code, which has more than 75%
of its exterior wall covered or con-
structed of corrugated iron. steel or
any similar metal shall be permitted to
be erected or constructed in the City
of National City, except In an M-2
Zone, or M-3 Zone, as set forth in
the Zoning Ordinance of the City of
National City."
The aforesaid paragraphs shall be
known as Section 2205 of the aforesaid
Building Code, and shall be deemed
a part and parcel thereof, and adopted
by the said City Council in this Or-
dinance.
SECTION 6. That Section 1602 of
said Uniform Building Code, 1952 Edi-
tion contained In said Document be,
and is hereby repealed.
SECTION 7. That the entire incor-
porated area of the City of National
City is hereby declared to be, and Is
hereby established as a Fire District
and said fire district shall be divided
into two (2) zones, designated as fol-
lows: Zone No. One and Zone No. Two,
and each such zone shall include such
territory or portions of said City as
illustrated, outlined, and designated
on a certain map on file in the office
of the City Clerk of said Clty, being
marked and/or designated as "Map
of Fire Zones of the City of National
City" which is hereby adopted as the
fire zoning map of said City for the
application of the regulations includ-
ed in said Uniform Building, 1952 Ed-
ition.
SECTION 8. That all buildings or
structures In said fire zone No. One,
shall be governed by the provisions of
Section 1603, of said Building Codc
contained in said Document No. 18408
and Fire Zone No. Two shall be gov-
erned and controlled 'oy the provis-
ions of Section 1601 of said Balding
Code contained In said Document No.
18408.
SECTION 9. That the Building Code
mentioned in and adopted by this Or-
dinance shall be supplemented and
amended by the insertion and addition
of the following section to be num-
bered "Section 4501-A" to read as fol-
lows:
SECTION 4501-A: "The City Coun-
cil may upon application and for good
cause, grant exceptions to or waive
the provisions of Section 4501. When-
ever the City Council has granted all
exception or waived the provisions of
Section 4501, the Building Inspector
shall issue a building permit therefor."
SEC'i'ION 10. That Table 3-A of Sec-
tion 302 set forth In said Building
Code relating to Fees Is hereby amend-
ed to read as follows:
TABLE NO. 3-A BUILDING PERMIT
FEES.
For a total valuation of $50.00 or
iess — no fee.
For a total valuation from $50.00 to
$101.00 a $1.00 fee: and an ad-
ditional fee of $2,00 for each ad-
ditional $1,000.00 or fraction
thereof of total valuation to and
including $15,000.00 and an ad-
ditional fee of $1.00 for each ad-
ditional SI,00(1,00 or fraction there-
of of total valuation to and in-
cluding S50,009.00; and an addi-
tional fee of 50e for each addi-
tional $1.000.00 or fraction thereof
of total valuation exceeding $50,-
000.00.
The city, county, state or the United
States of America shall be exempt from
the paying of any fee for any building.
SECTION 11. Any person, firm, or
corporation violating any of the pro-
visions of said Uniform Building Code,
1952 Edition by said Document No.
18408 on file in the office of the City
Clerk of said City of National City,
California, or who shall violate any
of the provisions of this Ordinance
shall be deemed guilty of a misde-
meanor and each such person shall be
deemed guilty of a separate offense
for each and every day or portion
thereof during which any violation
of any of the provisions of said Code
or of this Ordinance is committed, con-
tinued or permitted, and upon convic-
tion of any such violation such person,
firm or corporation shall be punishable
by a fine of not more than $300.00 or
by imprisonment in the County Jail of
the County of San Diego for not more
than three months or by both such
fine and imprisonment.
SECTION 12. This Ordinance shall
take effect and be in force on and af-
ter the thirty-first day after the date
of its final passage and approval.
SECTION 13. The City Clerk of the
City of National City, California. is
hereby directed to cause this Ordinance
to be published once in the National
City News, a weekly newspaper pub-
lished and of general circulation In said
City of National City.
