ORDINANCE NO. 846
AN ORDINANCE REGULATINi; AND
IMPOSING A PERMIT FEE UPON
REFRIGERATION PLANTS AND
REPEALING ORDINANCE NO. 814.
The City Council of CITY OF NA-
TIONAL CITY does ordain as follows:
SECTION 1. PERMIT AND FEE. It
shall be unlawful for any person. firm
or corporation to operate. maintain or
keep in CITY OF NATIONAL CITY
any facility or equipment for:
(a) The refrigerated storage for
compensation of meat not own-
ed by the person maintaining
the refrigeration equipment. or
for
(b) The sale of frozen meat at
wholesale or retail without first
obtaining a permit therefor
from the Director of Public
Health. A fee of $10.00 per
calendar year or portion there-
of is hereby Imposed for such
permit, which sum shall be
paid to the Director of Public
Health and deposited in the
,.—• General Fund.
As used in this ordinance "refri-
t . 7 .ategeration plant" and "locker plant"
HCYshall include any plant required to
4. it�> obtain a permit hereunder.
SECTION 2. RENEWAL. REVOCA-
TION OF PERMIT. Each such permit
shall be renewed annually by the per-
mittee. Any such permit may he
revoked by the Board of Health upon
proof of violation by the permitter of
any provision of state law. or City
ordinance. or rule of the Board of
Health pertaining to health or sanitary
matters.
SECTION 3. SANITATION RE-
QUIREMENTS. Every refrigeration
plant where meat is stored shall be
maintained and operated in a clean
and sanitary manner. Every such
plant shall be open at all times to in-
spection by the Department of Public
Health.
SECTION 4. STAMPING OF UN -
INSPECTED MEAT. All uninspected
beef, veal or lamb kept or placed in
any refrigeration plant shall be stamp-
ed immediately upon arrival with a
roller stamp so as to be legibly mark-
ed "Uninspected Meat —Not for Sale".
All uninspected pork kept or placed
in any refrigeration plant shall be
stamped immediately upon arrival with
a hot stamp so as to be legibly marked
"Uninspected Meat ---Not for Sale".
Every stamp required by this section
shall also legibly show the plant per-
mit number issued to the plant by the
Director of Public Health.
SECTION 5. HIDES MUST ACCOM-
PANY CARCASSES. Every refrigera-
tion plant shall accept and store beef,
veal and lamb carcasses only when the
hide accompanies the carcasses. Every
refrigeration plant shall keep a record
of the disposition of each such hide
which record shall be available at all
times to the Department of Public
Health and the State Hide and Brand
Inspector.
SECTION 6. BOND REQUIRED.
Every refrigeration plant handling in-
spected and uninspected beef, lamb,
pork or veal shall post with the De-
partment of Public Health a surety or
cash bond in the sum of $1,000.00 con-
ditioned upon the compliance by the
permittee with all the terms and pro-
visions of this ordinance and subject
to forefeiture upon the conviction of
the permittee of violation of any pro-
vision of this ordinance.
SECTION 7. DESIGNATION OF
MEAT PROCESSING DAYS. Every
refrigeration plant handling or process-
ing inspected and uninspected meat
shall designate different days of the
week upon which inspected meat will
be processed and uninspected meat will
be processed, and shall notify the De-
partment of Public Health in writing
of such designation and of any change
thereof together with the effective
date of such change. It is unlawful
for any refrigeration plant to process
both in:peeled a d uninspected meat
on the same day. except with the per-
missior, of the Department of Public
Health.
SECTION a. UNINSPECTED MEAT
INCIVDES DEER, GAME. FOWL. The
handling of meat or deer or other
game or fowl shall be classified as
handling of uninspected meat and sha:i
not be handled on days designated for
inspected meat. Except as In this
section provided this ordinance shall
not apply to carcasses of deer, game
or fowl.
SECTION 9. Whenever the term
"Board of Health" appears in this
ordinance, the Board of Health of Clly
of National City, California, is meant.
Whenever the term "Department of
Health" or "Department of Public
Health" or "Health Department" is
mentioned in this ordinance, the Health
Department of City of National City,
California, Is meant.
SECTION 10. PENALTY. Every
violation of any provision of this ordin-
ance is a misdemeanor and shall be
punished by fine n.': exceeding S500.00
or imprisonment .n the City jail or
County jail not exceeding six months,
or by both such fine and imprison-
ment, and bond forfeiture.
SECTION 11. REPEAL. Ordinance
No. 814 of City of National City is
hereby repealed, and all ordinances or
parts of ordinances in conflict with or
Inconsistent with the provisions of this
ordinance are hereby repealed, except
that this repeal shall not affect or
prevent the prosecution c4 punishment
of any person for any act done or com-
mitted in violation of any ordinance
hereby repealed prior to the taking
effect of this ordinance.
SECTION 12. EFFECTIVE DATE.
This ordinance shall be in Lull force
and effect on the thirty-first day after
its passage.
SECTION 13. PUBLICATION. Before
the expiration of fifteen days after its
passage, the City Clerk of City of
National City, California, shall cause
this ordinance to be published once in
the National City News, a newspaper
of weekly circulation, printed and
published in the City of National City,
California.

Council of the City of National City,
California, this 19th day of May, 1953,
by the following vote, to -wit:
