C I T Y, CALIFORNIA, AMENDING ORDINANCE NO. 707 OF SAID CITY BY AMENDING SECTIONS 5 AND 38 OF SAID ORDINANCE AND BY ADDING THERETO SECTIONS NUMBERED 30.1 and 31.1 OF SAID ORDINANCE. The City Council of CITY OF NA- TIONAL CITY does ordain as follows: SECTION 1: That SECTION 5 of ORDINANCE NO. 707 is hereby amend- ed to read as follows: "SECTION 5: ANNUAL INSPEC- TION FEE. Every person, firm or corporation applying for a permit under the provisions of this ordin- ance shall at the time of making application for the permit pay the annual inspection fee of Ten Dollars (S10.00) to the Clerk of employee authorized by the Board of Health to receive such fees. All moneys received as inspection fees under the provisions of this ordinance shall be paid into the City Treasury. A permit, for which application is made, under the provisions of this ordinance, may be granted at any time during the year, but all per- mits granted hereunder shall ex- pire on the 31st day of December of the year in which the same are granted. A permit shall not be trans- ferrable from one person, firm or corporation to another. and shall be deemed invalid upon removal from a place or location other than that specified in the written applica- tion and in the permit as originally issued. Every permit issued shall be kept posted :n a conspicuous place in the establishment for which the permit is issued under the provisions of this ordinance." Section 2: That SECTION 38 of ORDINANCE NO. 707 is hereby amend- ed to read as follows: "SECTION 38: PENALTY. Any person, firm or cerporation violat- ing any of the provisions of this ordinance shall he deemed guilty of a misdemeanor, and upon con- viction thereof shall be punished by a fine of not less than Ten Dollars ($10.001 nor more than Five Hundred Dollars ($500.00), or by imprisonment in the county jail of County of San Diego for a period of not less than five (5) days, nor more than six (6) months, or by both such fine and imprisonment; provided, however. that in the isolated or rural districts where running water, electricity or other modern conveniences are not avail- able, a special permit may be issued if in the opinion of the Health Officer it be deemed advisable. and consistent with the preservation of public health and safety. All special permits shall be revokable for cause which may affect public health and safety. SECTION 3: That SECTION 30.1 is hereby added to Ordinance No. 707 and shall read as follows: "SECTION 30.1: CONTAINERS FOR STORAGE OF FOODS. No tin can, lard stand, or other such container shall be used for the pur- pose of cooking, preparing, or stor- ing of food stuffs. All canned goods shall be transferred immediately upon opening from the original container to one of glass. crockery, agate ware, glass ware. or other approved receptacle, intended for that purpose. The Health Officer shall condemn and/or destroy all food held in storage contrary to the provisions of this section." SECTION 4: That SECTION 31.1 is hereby added to Ordinance No. 707 and shall read as follows: "SECTION 31.1: MALTED AND OTHER MILK DRINKS. 11) MALTED MILK shall be de- fined as a mixture of Grade "A" Raw or Pasteurized milk, contain- ing not less than 3.3% of milk fat, with malted milk and flavoring substances, and ice cream contain- ing not less than 10 q milk fat, or shall contain ice milk containing not less than 4',. milk fat; and all ice cream or ice milk shall con- form to the provisions of the Agri- cultural Code. (21 It shall be unlawful to pre- pare. serve, sell, or distribute in any establishment any malted milk unless Grade "A" Raw or Pasteur- ized whole milk is used in the pre- paration of the mixture and the milk has been poured from the original standard bottle from which the cap has been removed in the presence of the customer or patron, and the contents of said bottle shall contain no more than the in- dividual requirements of the cus- tomer at the time of serving: and/ or a standard milk bottle may be used providing that the maximum content does not exceed one quart and that said miik bottle shall have attached a metal top which has been designed to cover the pouring lip and approved by the Director of Health; said top to be sterilized as soon as said bottle is empty; pro- vided that any establishment serv- ing malted milk, malted sklre milk, milk shakes or other milk drinks may hold the milk in a special container having a capacity of not more than two gallons and approved by the Director of Health. Said container shall be constructed of stainless steel or similar metal with detachable valve and surrounded by a suitable jacket so constructed as to contain ice or other means for refrigeration whereby the temper- ature may be held at 50' Fahrenheit or below until it reaches the con- sumer, and the entire apparatus shall be sterilized before being re- filled in a manner approved by the Director of Health. (3) MALTED SKIM MILK shall be defined as a mixture of skim milk with malted milk and flavor- ing substances and ice cream or ice milk containing not less than 4Tee milk fat. All skim milk used in any establishment where skim malted milk is prepared, served or distributed shall have met the re- quired standards of Grade "A" Pasteurized milk and shall be pasteurized and bottled in standard milk bottles in an approved pas- teurizing and bottling plant and whenever used for the preparation of Malted Skim Milk mixture, it shall be poured from the original, standard milk bottle, as provided in previous subsection 2 of this Section 31.1. (41 MILK SHAKES AND OTHER MIILK DRINKS, served or prepared with the addition of flavoring sub- stances or other ingredients added thereto, shall be prepared from whole milk or skim milk which has met the required standards of Grade "A" and shall be poured from the original standard milk bottle, as provided In previous subsection 2 of this Section 31.1. (5) The establishment shall dis- play a sign in legible lettering at least four (4) inches high, which shall state that Malted Skim Milk or Malted Milk is served. The bac- terial count of skim milk shall not exceed the minimum standard for Grade "A" Pasteurized Milk." SECTION 5: This ordinance shall be in full force and effect on the thirty-first day after its passage. SECTION 6: Before the expiration of fifteen days after its passage, the City Clerk of City of National City, California, shall cause this ordinance to be published once in the National City News, a newspaper of weekly circulation, printed and published in the City of National City, California. 7 Ord.
