No. 853 — Page 1 ORDINANCE NO. 853 AN ORDINANCE APPROVING THE ANNEXATION 1'O CITY OF NA- TIONAL CITY, CALIFORNIA, OF CERTAIN UNINHARITED TERRI- TORY IN THE COUNTY OF SAN DIEGO, STATE OF CALIFORNIA, DESIGNATED AS "FINDAHL'. WIIEREAS, a proposal to annex cer- tain territory, hereinafter described, and herein designated "FINDAHL.", to CITY OF NATIONAL CITY has been regularly and duly submitted to the Boundary Commission of San Diego and to the City Council of San Diego, California, and that they did thereafter consent thereto. and thereafter all the owners of said property did sign and file with the City Clerk of National City a written petition requesting an- nexation of said property to National City and in said petition consenting that said property be taxed to pay its proportionate share of all indebtedness or liability of the Clty of National City contracted prior to or existing at the time of annexation thereof; and WHEREAS, pursuant to the terms and provisions of said annexation of Uninhabited Territory Act of 1939, as Amended, the Council of City of Na- tional City, at a regular meeting held on the 15th day of September, 1953, adopted a resolution giving notice of the proposed annexation, which reso- lution described the boundaries of the territory so proposed to be annexed to City of National City. and designated such territory as "FINDAHL" and said resolution provided for a hearing to be held on the 20th day of October, 1953, at the hour of 8:00 o'clock P.M. in the Council Chambers at the City Hall, National Clty, California, at a regular meeting of the City Council of said City, at which time any per- son owning real property within such territory proposed to be annexed and having any objections to the proposed annexation, might appear before said City Council and show cause why such territory should not be so annexed; and WHEREAS, the City Clerk of Nation- al City did regularly and duly cause all publications and notices to be given as required by law and particularly as required by Section 35311 of the Government Code of the State of Cali- fornia, within the times therein re- quired; and WHEREAS, on the 20th day of Octo- ber, 1953, at 8:00 o'clock P.M. at a reg- ular meeting of the City Council of said City, it was found that no protests were filed against such proposed an- nexation; NOW, THEREFORE, the City Council of City of National City, California, does ordain as follows: SECTION 1. The City Council of City of National City hereby approves the annexation to City of National City of the following described territory sit- uated in the County of San Diego, State of California, designated as "FINDAHI.", to -wit: All that portion of Lot 70 of a por- tion of Rancho Ex -Mission of San Diego (commonly known as Hor- ton's Purchase) In the County of San Diego, State of California, ac- cording to Map thereof No. 283, filed in the office of the County Record- er of said San Diego County March 9, 1887, described as follows: Beginning at a point in the South- erly line of said Lot 70, distant thereon South 71' 28' West, 648.95 feet from the Southeast corner of said Lot 70, being also a point 1n the boundary of the City of National City: thence North 0. 01' West par- allel with the East line of said Lot 70 and along the Westerly line of Sunny Knoll. according to Map thereof No. 2431, on file in the of- fice of the County Recorder of said San Diego County, a distance of 309.88 feet to the Northwest corner of said Sunny Knoll, being the Northeast corner of land described in deed to John Nonzeta, et ux re- corded March 23, 1953, in Book 1469, page 400, of Official Records: thence West along the Northerly line of said Nonzeta Land, 150.0 feet; thence South 0^ OP East parallel with the Westerly line of said Sunny Knoll, 360.16 feet to a point In the South- erly line of said Lot 70, being also a point in the boundary of the City of National City; thence North 71' 23' East along said Southerly line and said boundary of National City 158.19 feet to the point of beginning. SECTION 2. That the City Clerk of City of National City is hereby author- ized and directed to file a certified copy of this ordinance in the Office of the Secretary of the State of California, giving the date of its passage; that from and after the date of filing of said document in the office of said Secretary of State, the annexation of such territory so proposed to be an- nexed and described herein shall be deemed to be, and shall be. completed. and thenceforth such annexed territory shall be to all intents and purposes. a part of the City of National City. and such annexed territory shall be taxed to pay its proportionate share of any indebtedness or liability of the City of National City contracted prior to or existing at the time of the annex- ation thereof. SECTION 3. That the City Clerk of said City be, and said City Clerk is hereby, further authorized and direct- ed to file in the office of the Recorder of the County of San Diego an affi- davit stating that all requirements of the laws pertaining to the proceedings for the annexation of the territory hereinabove In Section 1 described have been complied with, which said affidavit shall be accompanied by a certified copy of the boundary descrip- tion as set forth in said proceedings and also by a map delineating such boundary, as required by Sections 34081) and :34081 of the Government Code of the State of California. SETCION 4. That before the expira- tion of 15 days after its passage, the City Clerk of City of National Clty shall cause this ordinance to he pub- lished once in the National City News, a newspaper of weekly circulation, printed and published in the City of National City, California. SECTION 5. This ordinance shall be in full force and effect on and after the 31st day after its passage. PASSED AND ADOPTED by the City Council of the City of National City, California, this 3rd day of Novem- ber, 1953. by the following vote, to -wit: AYES: Councilmen Campbell, Mc- Clure, Parehen, Sarn.
