HomeMy WebLinkAboutCC ORD 1947-730 Amends Ord. 656, building code (Repealed by 798)730 ORDINANCE NO. 730 AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFOR- NIA, AMENDING ORDINANCE NO 656 OF THE ORDINANCES OF THE CITY OF NATIONAL CITY BY AMENDING SECTIONS 1603-G and 1603-H OF THE BUILDING CODE ADOPTED BY SAID ORDINANCE. THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALI- FORNIA, DOES ORDAIN: SECTION 1: Section 1603-G of the Building Code adopted by Ordinance No. 656 of the Ordinances of the City of National City shall be amended to read as follows: "SECTION 1603-G: Before any existing building, house or struc- ture of any type whatsoever may be moved from outside the city limits of the City of National City, to within the city lim- its of the City of National City, application for such moving shall be made to the City Coun- cil of the City of National City. Upon receipt of said application for the moving of such building, house or structure, the City Coun- cil shall cause an inspection to be made of said building, house or structure and a report of said inspection shall be filed with the City Council. The City Council may approve or disapprove said application for any valid reason. No building, house or structure shall be moved from without the City of National City to within the City of National City without the express permission of the City Council of the City of National City. The City Council may require the owner, or his duly authorized agent, to provide a. certified state- ment by a qualified specialty con- tractor, currently licensed by the State of California, to the effect that such building, house or struc- ture is free from fungus, termites or similar defects. All buildings, houses cr struc- tures moved into the City of Na- tional City shall conform to the zoning regulations of the district in which they are to be located and shall conform or be made to conform to this code. A fee of TWENTY FIVE DOL- LARS' ($25.00) shall accompany each application, which fee is to recompense the city of National City, to a degree, for the ex- pense involved in the inspection. The City council of the City of National City may, by reso- lution, specify certain minimum area requirements of any build- ing, house or structure to be moved from without the city lim- its of the City of National City to within the city limits of the City of National City. i97i9 Permission may be granted or denied by motion of the City Council. If permission is grant- ed, applicant shall receive a writ- ten permit to move said building, house or structure to within the city limits of the City of Nation- al City; said permit shall state the time limits within which the building is to be moved and the place from which the building is to be moved and the place where it is to be permanently located. The Building Inspector of the City of National City shall is- sue said permit after prior ap- proval by the City Council." SECTION 2: Section 1603-H of the Building Code adopted by Ordinance No. 656 of the Ordinances of the City of National City shall be amended to read as follows: "SECTION 1603-H: Whenever an existing building, house or struc- ture is moved from its present lo- cation to a new location within the City of National City, the said building, house or structure shall be made tocomply with and conform to all laws and ordinan- ces of the City of National City applicable to new buildings, houses or structures. Any person who desires to move any building, house or structure whatsoever, shall file with the City Council, prior to such mov- ing, an application stating his intention, the purpose and extent of alterations and rehabilitations necessary to enable said building, house or structure to conform to the Ordinances of the City of National City relating to new structures in the new location. Said application shall be made upon blanks provided therefor by the City Council. Any application for a permit to move any build- ing, house or structure may be denied by the City Council if in the opinion of the City Council the said building, house or structure cannot be fully altered or re- habilitated to conform to the laws and ordinances of the City of National City, or for any other valid reason. In the event the City Council approves said ap- plication, they shall cause to be issued a permit for the moving of said building, house or structure described in said application. No building, house or structure shall be moved from its present location within the City of Na- tional City to a different location within the City of National City without express approval of the City Council. The City Council shall cause an inspection to be made of said buildings, houses or structures prior to the granting of permission to move the same. The decision of the City Coun- cil in granting or denying a per- mit to move an existing building, house or structure shall be final and conclusive. No building, house or structure may be moved unless it shall com- ply. in its new location, with the zoning laws governing said lo- cation. The City Council may, by res- olution, specify certain minimum area requirements of any build- ing, house or structure to be moved from one location within the city limits of National City to another location within the city limits of National City." SECTION 3: The City Council of the City of National City does here- by find and determine that an em- ergency exists within said city; that for the preservation of the peace, health and safety of the citizens of National City, the City Council does hereby declare that this or- dinance shall be in full force and effect as and of the date of its final passage. SECTION 4; The City Clerk of the City of National City is directed to publish this ordinance once in the National City News, a newspaper of general circulation, printed and pub- lished in National City, California. PASSED AND ADOPTED by the City Council of the City of National City, California, this 21st day of January, 1947, by the following vote, to -wit: AYES: Councilmen Adams, Cord- ingly, Newberry, Thatcher, Fritz.
