ORDINANCE NO. 737
AN ORDINANCE MAKING IT UN-
LAWFUL FOR ANY PERSON TO
OFFER OR AGREE TO COMMIT
PROSTITUTION, OR OFFER TO
SECURE OR TO SOLICIT AN-
OTHER FOR THE PURPOSE OF
PROSTITUTION, FORNICATION,
ASSIGNATION OR ANY OTHER
LEWD ACT, OR TO BE IN OR
NEAR ANY PUBLIC PLACE FOR
THE PURPOSE OF ENTIC
OR PROCURING ANOTHER TO
COMMIT ANY SUCH ACT, OR
TO KNOIVINGLY RECEIVE OR
AGREE TO RECEIVE ANY PER-
SON INTO ANY PLACE OR
BUILDING OR BUILDINGS FOR
THE PURPOSE OF COMMIT-
TING SUCH ACT, OR TO KNOW-
INGLY PERMIT ANY PERSON
TO BE OR REMAIN IN ANY
SUCH PLACE OR BUILDING
FOR SUCH PURPOSE OR TO A
PLACE FOR THE PURPOSE OF
COMMITTING ANY SUCH ACT,
OR IN ANY WAY TO AID OR
ABET OR PARTICIPATE IN THE
DOING OF ANY SUCH ACT.
The City Council of National City,
DOES ORDAIN as follows:
SECTION 1. It shall be unlawful
for any person to offer or agree to
commit or to solicit another to com-
mit, or to offer to secure another for
the purpose of committing or to be
in or near any thoroughfare or public
place for the purpose of soliciting,
inducing, enticing or procuring an-
other to commit, or to knowingly
transport any person to any place for
the purpose of um -mating, or to
knowingly receive, offer or .agree to
receive any person into any place or
building for the purpose of commit-
ing, or to direct any person to any
place for the purpose of committing,
any act of prostitution, or fornication,
or assignation, or any other lewd or
indecent act, or act of unlawful sexual
intercourse with any other person, or
to knowingly permit any other person
to remain at any place or building
for the purpose of doing any of the
acts prohibited herein; or for any
person to direct ancther person to any
place for the purpose of doing any or
either of the acts prohibited herein;
or in any way participate in the doing
of any of the said acts.
SECTION 2. Any person violating
any of the provisions of this ordin-
ance shall be deemed guilty of a mis-
demeanor, and upon conviction there-
of shall be punishable by a fine of
not more than Five Hundred (8500.00)
Dollars, or by imprisonment in the
City Jail for a term not to exceed
six (6) months, or by both such fine
and imprisonment.
SECTION 3. If any provision of
this ordinance, or the application
thereof, to any person or citizens is
held invalid, such invalidity shall not
affect any other provision, or the ap-
plication thereof, which can be given
effect without the invalid portion or
application, and to this end the pro-
isions of this ordinance are declared
to be severable.
SECTION 4. This ordinance will
take effect on the 31st day after final
passage. The City Clerk is directed
to publish this ordinance once in the
National City News, a newspaper of
general circulation, printed and pub-
lished in the City of National City,
California.
PASSED AND ADOPTED by the
City Council of the City of National
City, California, this 19th day of Aug-
ust, 1947, by the following vote, to -
wit:
AYES: Councilmen Cordingly, New-
berry, Thatcher, Fritz .
NAYS: Councilmen None.
ABSENT: Adams.
