ORDINANCE NO. 742
AN ORDINANCE PROVIDING FOR
THE REGULATING OF PARK-
ING ON THE STREETS OF THE
CITY OF NATIONAL CITY,
CALIFORNIA
The City Council of the City of Na-
tional City, California, does ordain:
SECTION 1. The City Council may
by resolution determine that it is
necessary to regulate or restrict park-
ing of vehicles, including, but not
limited to, horse drawn wagons or
carts, bicycles, motorcycles and scoot-
ers, on the streets of National City,
'. California. The area to be regulated
4 or restricted, and type and time of
regulation, shall be designated in said
resolution, and the curb of said area
shall be painted as hereinafter pro-
vided.
SECTION II. The following colors
only shall be used:
(a) Red indicates and prohibits no
stopping, standing or parking
whether the vehicle is attended or
unattended, except that a bus may
stop in a red zone marked or sign -
posted as a bus loading zone.
(b) Yellow indicates and prohibits
stopping except for the purpose
of loading or unloading passengers or
freight not to exceed ten (10) minutes
for the unloading or loading passen-
gers, and not to exceed twenty (20)
minutes for loading or unloading
freight.
(c) White indicates and prohibits
stopping only for loading or
unloading of passengers for such
time as may be necessary to load or
unload passengers, not to exceed three
minutes.
(d) Green indicates and prohibits
parking in excess of 15 minutes.
SECTION III.
(a) Curb areas painted red shall be
effective 24 hours of the day,
Sundays and holidays included.
(b) All other painted curb areas
shall be effective between the
hours of 8:00 o'clock A. M., and 6:00
o'clock P. M., of each day, Sundays
and holidays excluded.
SECTION IV. When the City Coun-
cil has caused curb markings to be
placed, no person shall stop, stand or
park a vehicle adjacent to any such
legible curb marking in violation of
any of the provisions of Section II of
this Ordinance.
SECTION V. Police, Fire, City
owned vehicles and authorized emer-
gency vehicles are exempted from the
provisions of this Ordinance.
SECTION VI. Illegal Parking.
(a) In any prosecution charging a
violation of any regulation gov-
erning the standing or parking of a
motor vehicle under this code or any
ordinance enacted by local authorities,
proof by the people of the State of
California that the particular vehicle
described in the complaint was parked
in violation of any provision of this
.ode or such ordinance, together with
proof that the defendant named In the
complaint was at the time of such
parking the registered owner of such
vehicle, shall constitute in evidence
a prima facie presumption that the
registered owner of such motor vehicle
was the person who parked or placed
such motor vehicle at the point where,
and for the time during which, such
violation occurred. The above provis-
ions shall apply only when the follow-
ing conditions are complied with:
(1) During the time of such illegal
parking a notice thereof shall
be securely attached to said vehicle
setting forth the fact of such illegal
parking including reference to the
section of this code or of such ordin-
ance so violated, the approximate time
thereof and the location where such
violation occurred and fixing a time
and place for appearance on the steer-
ing post or front doer handle thereof.
Such notice shall be attached to said
vehicle either by the registered owner
in answer to said notice, or in such
other conspicuous place upon the ve-
hicle as to be easily observed by the
person in charge of such vehicle upon
his return thereto.
(2) Before any warrant of arrest
shall issue following the filing
of a Complaint charging the offense
of illegal parking, a notice of such II -
legal parking must be given to the
person so charged. Such notice shall
contain the information required in
paragraph (1) above and shall also
inform such registered owner that un-
less he appears in the court to be des-
ignated in said notice within five days
after service of such notice and an-
swers said charge, a warrant or ci-
tation to appear will be issued against
him.
Such notice shall be given, either by
personal delivery thereof to such
owner or by deposit in the United
States mail of an envelope with post-
age prepaid which said envelope shall
contain such notice and shall be ad-
dressed to such owner at his address
a.s shown by the records of the de-
partment. The giving of notice by
personal delivery is complete upon
delivery of a copy of said notice to
said person. The giving of notice by
mail is complete upon the expiration
of ten (10) days after said deposit of
such notice.
Proof of giving such notice may be
made by the certificate of any traffic
or police officer or affidavit of any
person over 18 years of age naming
the person to whom such notice was
given and specifying the time, dace
and manner of the giving thereof.
SECTION VII. It is unlawful for
any person to, and no person shall
paint or cause to be painted, any
curb or portion of a curb on any
street or streets in the City of Nation-
al City.
SECTION VIII. The Chief of Police
of National City is authorized to pro-
hibit parking on any street or alley
in National City, during periods of
emergency or during civic functions
or parades After suitable signs or.
barricades are placed on said street
or alley indicating "no parking", It
shall be unlawful for any person to
park or leave standing, any vehicle on
said street or alley.
SECTION IX. Each and every per-
son violating any of the provisions of
this Ordinance shall be guilty of a
misdemeanor and upon conviction
thereof, shall be punished by a fine
of not exceeding $50.00 or imprison-
ment in the City or County Jail for
not more than 25 days or by both
such fine and imprisonment.
SECTION X. This ordinance shall
be in full force and effect on the 314
day after date of final passage.
SECTION XI. The City Clerk is
hereby directed to publish this ordin-
ance once in the National City News,
a newspaper of weekly circulation,
printed and published in the City of
National City, California.

City Council of the City of National
City, California, this 2nd day of De-
cember, 1947, by the following vote,
to -wit :
