A.N ORDINANCE OF THE CITY OF
NATIONAL CITY PROVIDING
FOR THE CARE, RESTITUTION,
SALE OR DESTRUCTION OF'
UNCLAIMED PROPERTY IN
THE POSSESSION OF THE PO-
LICE DEPARTMENT OF THE
CITY OF NATIONAL CITY.
The City Coun<a1 of the City of Na-
tional City, California, DOES OR-
DAIN:
Se<tion I. Any and all unclaimed
personal property except animals and
perishable property in the possession
ofthe polite department of National
City, shall be held by said police de-
partment for a period of at least six
(6) months. That after holding said
unclaimed property for said period of
time, the same shall be sold by the
Chief of Police or his duly authorized
representative, at public auction to
the highest bidder.
Section II. Prior to the sale at
public auction, notice of the time and
place of said sale, and articles to be
sold, shall be given by the Chief of
Police at least five (5) days before the
time fixed therefore, by Publication
once in a newspaper of general circu-
;ation published in the City of Na-
tional City.
Section III. Any person may claim
said property at any time prior to
the first publication of notice of sale,
by proving to the satisfaction of the
Chief of Police, his ownership of said
property and paying all expenses in-
cluding charges for storage.
Section IV. The Chief of Police
shall be responsible for the care and
preservation of the unclaimed property
hereinbefore referred to, until the
same is sold or returned to the law-
ful owner thereof. In no event shall
the Chief of Police or the City of Na-
tional City be liable for the loss or
damage of or to the unclaimed prop-
erty.
Section V. Unclaimed perishable
property may be sold at public auc-
tion in the manner set forth in para-
graph II of this Ordinance, prior to
the expiration of the six (6) months
period. All monies, if any, derived
from said sale shall be held for the
owner or said property, providing he
shall prove ownership of the perish-
able property prior to the expiration
of a six (6) months period from date
of first possession of said property
by the Chief of Police. If no owner
claims said property within the six
(6) months period, then the monies
derived from said sale shall be placed
in the general fund of the City of
National City.
Section VI. Each article of un-
claimed property shall be identified
with a tag on the same, shown date
of possession by Chief of Police and
the circumstances surrounding said
possession.
Section VII. All monies derived from
the sale of unclaimed property shall
be deposited in the general fund of
the City of National City, and shall
belong to said City. If more than one
article is offered for safe at auction,
they may be sold individually or col-
lectively, as the Chief.of Police may
determine.

Section VIII. This Ordinance shall
not apply to lost, strayed or unclaim-
ed animals.
Section IX. This Ordinance shall
take effect and be in force on the
thirty-first day from and after its
passage.
Section X. The City Clerk is di-
rected to publish this Ordinance in
the National City News, a newspaper
of general circulation, printed and
published in the City of National
City, California.

City Council of the City of National
City, California, this 2nd day of De-
cember, 1947, by the following vote,
to -wit :
AYES: Councilmen Adams, Cording-
ly, Newberry,Thatcher, Fritz.
NAYS: None.
ABSENT: None.
