HomeMy WebLinkAboutCC ORD 1948-747 Water waste prohibited (14.12)74 ORDINANCE NO. 747 AN ORDINANCE DECLARING IT UNLAWFUL TO WASTE WATER SUPPLIED FROM SOURCE DED- ICATED TO PUBLIC USE: ES- TABLISHING PENALTIES FOR ITS VIOLATION AND DECLAR- ING ITS URGENCY FOR THE IMMEDIATE PRESERVATION OF THE PUBLIC PEACE, HEAL- TH AND SAFETY. THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DOES ORDAIN AS FOLLOWS: Section 1. From and after the date of the adoption of this ordin- ance it shall be and it is hereby de- clared to he unlawful for any per- son, legal or natural, to waste or to cause or permit to be wasted any water furnished, supplied or deliver- ed by any agency distributing for public benefit any water dedicated to or provided for public use within the City of National City. Section 2. It shall be prima facie evidence of the violation of this or- dinance for any person, legal or nat- ural, to permit any water suppied from such public source to the prem- ises owned, occupied or controlled by such person, to escape, flow or seep therefrom. Section 3. The person, legal or natural, ostensibly in possession, control or ownership of any prem- ises upon which water is wasted or permitted to be wasted in violation of this ordinance shall be prima facie responsible for such violation. Section 4. The violation of this ordinance shall be a misdemeanor punishable by a fine of not to exceed One hundred ($100.00) dollars or by imprisonment in the County Jail for not to exceed thirty (30) days or by both such fine and imprisonment. Section 5. This ordinance is here- by declared an urgency matter nec- essary for the immediate preserva- tion of the public peace, health and safety to take effect immediately following its final passage. The facts constituting the urgency are declared to be as follows: San Diego County is now in the third year of deficient rainfall with the result that no local storage of water has been accumulated for pub- lic supplies. The heavy draft of wa- ter during the war years and the increasing growth of population and resultant increase in water consump- tion has completely exhausted the unreplenished stored reserves of the California Water and Telephone Company, Sweetwater Division, sup- plying' the public water within the City of National City, unless all wa- ter constituting a source of the pub- lic supply is conserved to the ut- most, a curtailment in use will re- sult endangering the supply for do- mestic, sanitation and fire protec- tion purposes, with consequent threat to the public peace, health and safety. Section 6. This Ordinance shall be published once in the National City News, a newspaper of general circu- lation, printed and published in the City of National City, California. PASSED AND ADOPTED by the City Council of the City of National City, California, this 24th day of February, 1948, by the following vote, to -wit: AYES: Councilmen Adams, Cord- ingly, Thatcher, Fritz.
