HomeMy WebLinkAboutCC ORD 1948-748 Bond issuance (Special)748 ORDINANCE NO. 748 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, AMENDING ORDINANCE NO. 716 OF SAID CITY COUNCIL RELATING TO THE ISSUANCE OF BONDS OF SAID CITY. WHEREAS, pursuant to Ordinance No. 715 of this City Council a special election was held in the City of National City on February 26, 1946, at which election the issuance of $375,000 bonds of said city for the acquisition and construction of a trunk sewer system was authorized; and WHEREAS, on April 16, 1946 this City Council adopted Ordinance No. 716 providing for the issuance of said bonds, which said ordinance set forth the form of said bonds and specified the officers authorized to sign the same; and WHEREAS, thereafter $108,000 of said bonds were issued, sold and de- li.ered to a purchaser thereof; and WHEREAS, thereafter this City Council determined to sell an addi- tional $207,000 of said bonds, being bonds numbered 109 to 315, inclusive, and on March 2, 1948 this City Coun- cil received bids for said $207,000 of bonds and awarded the same to the Bank of America National Trust and Savings Association; and WHEREAS, said Ordinance No. 716 provides that said bonds shall be countersigned by the City Clerk of said city; and WHEREAS, the City Clerk of said city has recently sustained injuries which will make it impossible for him to countersign said bonds within the immediate future; and WHEREAS, the Munt.ipal Bond Act of 1901, under which said bonds are to be issued, permits the bonds to be countersigned by a Deputy City Clerk; NOW, THEREFORE, the City Council of the City of National City DOES ORDAIN as follows: Section 1. That said Ordinance No. 716 be amended by adding thereto, immediately following Section 2 there- of, a new section, numbered Section 2.1 and reading as follows: "Section 2.1. Notwithstanding the provisions of Section 2 hereof, bonds numbered 109 to 315, inclu- sive, of said SEWER BONDS, 1946 shall be countersigned by a Deputy City Clerk of said city, and any Deputy City Clerk of said city is hereby authorized and directed to countersign said bonds numbered 109 to 315, inclusive, and to affix thereto the corporate seal of said city." Section 2. That said Ordinance No. 716 be amended by adding thereto, immediately following Section 3 there- of a new section, numbered Section 3.1 and reading as follows: "Section 3.1. Notwithstanding the provisions of Section 3 hereof bonds numbered 109 to 315, inclu- sive, of said SEWER BONDS, 1946 shall be issued in substan- tially the form set forth in Sec- tion 3 hereof, except that the word 'the' preceding the words 'City Clerk' in the last paragraph of said bond form shall be de- leted, and in place thereof there shall be inserted the words 'a Deputy', and except that follow- ing the signature line which fol- lows the word 'Countersigned:' at the end of said bond form the word 'Deputy' shall be inserted immediately preceding the words 'City Clerk'." Section 3. That the City Clerk shall certify to the passage and adop- tion of this Ordinance by the affirma- tive vote of at least four -fifths of all of the members of said City Council at an adjourned regular meeting of said City Council and its approval by the Mayor of said city and shall cause said ordinance to be published once in the NATIONAL CITY NEWS, a weekly newspaper of general circu- lation in said city. Section 4. It is hereby declared that this ordinance relates to an election, namely the special election held in said city on February 26, 1946, as aforesaid, and it is further declared that this ordinance is an urgen..y ordinance for the immediate preservation of the public health. Accordingly this ordinance shall take effect upon its passage. The facts constituting such urgency are as fol- lows: Bonds numbered 109 to 315, inclu- sive, of said SEWER BONDS, 1946 are being sold by this City Council to provide funds for additional trunk sewers urgently needed in said city, and said bonds ha,e been awarded to a purchaser as aforesaid. Due to injuries recently sustained, the City C..erk of said city is unable to coun- tersign said bonds as contemplated by Ordinance No. 716. Unless said Ordinance No. 716 is amended to por- mit a Deputy City Clerk to counter- sign said bonds and thus permit the immediate delivery thereof to the purchaser, the purchaser might seek to cancel its bid on the ground of unreasonable delay in delivery, thus making a new sale necessary and causing delay in the construction of said sewers.
