HomeMy WebLinkAboutCC ORD 1948-754 False crime reports (Repealed by 1044)754 ORDIiNANCE NO. 754 AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA, PROHIBITING FILING OF FALSE CRIME REPORTS WITH THE POLICE DEPARTMENT OF THE CITY OF NATIONAL CITY, CALI- FORNIA. The City Council of the City of National City, California, DOES OR- DAIN: SECTION 1. It shall be unlawful for any person, firm or corporation, either as principal, agent, servant or employee, to wilfuly and knowingly report to the Police Department of the City of National City, or any member or agency thereof or to any law enforcement agency or officer of the City of National City, County of San Diego, State of California, and/or of the United States of Ameri- ca, within the City of National City, any false event, circumstance, fact or accusation, calculated, designed or intended to furnish the basis for any investigation, arrest or prosecution. SECTION 2. Proof under the fore- going section that any person, firm or corporation, either as principal, agent, servant or employee, did in fact report to the Police Department of the City of National City, or any member or agency thereof or to any law enforcement agency or officer of the City of National City, County of San Diego, State of California, and/or of the United States of America, within the City of National City, any false event, circumstance, fact or ac- cusation, calculated, designed or in- tended to furnish the basis for any investigation, arrest, or prosecution, shall constitute prima facie proof that he did so, wilfully and know- ingly. SECTION 3. Any person, firm or corporation violating any of the pro- visions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be pun- ished by a fine of not more than Five Hundred Dollars ($500.00), or by imprisonment in the City or Coun- ty Jail for a period of not more than six (6) months, or by both such fine and imprisonment. SECTION 4. If any section, sub- section, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordin- ance. The Council hereby declares that it would have passed this or- dinance and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact of any one or more other sections, subsections, sentences, clauses or phrases being declared unconstitutional. SECTION 5. This ordinance shall take effect and be in force on the thirty-first day from and after its passa ge. SECTION 6. The City Clerk is hereby directed to publish this or- dinance once in the National City News, a newspaper of weekly cir- cu'ation, printed and published in the City of National City, California. PASSED AND ADOPTED by the City Council of the City of National C'ty, California, this 3rd day of No- vember, 1948, by the following vote, to -wit : AYES: Councilmen Adams, Curry, Matthews, Thatcher, Fritz.
