AN ORDINANCE OF THE CITY OF
NATIONAL CITY, CALIFORNIA,
AMENDING ORDINANCE NO. 762
BY AMENDING SECTIONS 1 AND
8, AND ADDING SECTION 2.1 TO
SAID ORDINANCE.
The City Council of the City of
National City, California, DOES OR-
DAIN as follows:
SECTION 1. Section 1 of Ordi-
nance No. 762 is hereby amended to
read as follows:
Definitions: Whenever in this or-
dinance the following terms are used,
they shall be deemed and construed
to have the meaning ascribed to such
respective terms in this section.
GARBAGE is defined as all refuse
and waste fruit, vegetable and ani-
mal matter, prepared and intended
for human consumption, and not so
used.
RUBBISH is defined as all refuse
and waste matter, whether combus-
tible or noncombustible, not included
within the definition of garbage as
herein defined, and excluding the fol-
lowing: yard rubble, tree, bush or
vine trimmings, plaster, rock, sand,
ashes, tree trimming, old automobile
frames and fenders, or waste material
pertaining to building operations, con-
struction or repair.
PERSON is defined to mean and
include person, firm or corporation.
SECTION 2. Section 3 of Ordi-
nance 762 is amended to read as fol-
lows:
310 All garbage shall be placed for col-
lection in a receptacle made of metal
or other non -absorbent material, with
a close fitting cover, and shall not
be mingled with rubbish. Said recep-
tacle shall have a capacity of not less
than two and one-half gallons, and at
no time shall there be placed therein
a quantity of garbage which shall
make the total weight, including that
of the receptacle, in excess of one
hundred pounds. All rubbish must
be placed in a receptacle for collec-
tion, and if not so placed shall be
tied in bundles and shall not be
mingled with garbage. Said recep-
tacle for rubbish shall have a capa-
city of not more than fifty gallons
and at no time shall there be placed
therein a quantity of rubbish which
shall make the total weight, including
that of the receptacle, in excess of
100 pounds.
SECTION 3. Ordinance 762 is fur-
ther amended by adding Section 2.1
to read as follows:
SECTION 2.1: At no time shall
household refuse or garbage be
burned within the limits of the
City of National City.
SECTION 4; This ordinance shall
take effect and be in force on the
thirty-first day from and after its
passage.
SECTION 5: The City Clerk is
hereby directed to publish this ordi-
nance once in the National City
News, a newspaper of weekly circu-
lation, printed and published in the
City of National City, California.
PASSED AND ADOPTED by the
City Council of the City of National
City, California, this 1st day of No-
vember, 1949, by the following vote,
to -wit:
AYES: Councilmen Adams, Curry,
Matthews, Thatcher, Fritz.
NAYS: Councilmen None.
ABSENT: None.
