ORDINANCE NO. 770
AN ORDINANCE OF THE CITY OF
NATIONAL CITY REGULATING
THE OPERATION OF MASSAGE
PARLORS.
The City Council of the City of Na-
tional City. California, DOES OR-
DAIN as follows:
SECTION 1. For the purposes of
this ordinance massage parlor is de-
fined as an establishment having a
fixed place of business in the City
of National City in which establish-
ment any one or more of the follow-
ing types of treatment, or any sim-
ilar type of treatment, is performed;
massage, alcohol rub, fomentation,
bath, including Turkish bath, electric
or magnetic treatment in connection
with any massage or bath. This or-
dinance shall not apply to any treat-
ment administered in good faith in
the course of practice by a person
licensed by the State of California
as an Osteopath, Doctor of Medicine,
Physician and Surgeon, Chiropractor,
Registered Nurse or Student Nurse in
a licensed hospital or rest home.
SECTION 2. It shall be unlawful
for the operator of any massage par-
lor or for any employee, agent or
servant of the operator to adminis-
ter any treatment therein to a mem-
ber of the opposite sex.
SECTION 3. The City Council of
the City of National City, may by
resolution, adopt and promulgate
rules and regulations with respect to
the management and operation of
massage parlors and respecting the
qualification and examination of per-
sons operating or employed by such
establishments. Such rules and reg-
ulations may require a practical or
other examination concerning the
possession of knowledge or skill by
the licensee to furnish the treatment
or therapy which the licensee profes-
ses or advertises to be competent to
furnish.
SECTION 4. Violation of any pro-
vision of this ordinance shall con-
stitute a misdemeanor and shall be
punished by imprisonment in the City
or County Jail for not more than
six months or by fine not exceeding
$500.00 or by both such fine and im-
prisonment.
SECTION 5. This ordinance shall
take effect and be in force on the
31st day from and after its final
passage.
SECTION 6. The City Clerk shall
cause this ordinance to be published
once in the National City News, a
weekly newspaper of general circula-
tion printed and published in the
City of National City, California.

City Council of the City of National
City, California, this 1st day of No-
vember, 1949, by the following vote,
to -wit:
AYES: Councilmen Adams, Curry,
Matthews, Thatcher, Fritz.
NAYS: Councilmen None.
ABSENT: None.
